1010 candy; (5) snack chips; and (6) cookies; with SNAP benefits. Requires
1111 the office of the secretary of family and social services (office) to
1212 provide to an individual, at the time the office approves the individual's
1313 application to receive SNAP benefits, specified educational materials
1414 regarding the effects of diet on an individual's health. Requires the
1515 office to apply for a waiver or authorization to implement the
1616 prohibition if a waiver or authorization from a federal agency is
1717 required, and allows a delay in implementation until the waiver or
1818 authorization is received.

3838 1 SECTION 1. IC 12-7-2-77.3 IS ADDED TO THE INDIANA CODE

5151 14 SECTION 4. IC 12-14-30-9 IS ADDED TO THE INDIANA CODE
5252 15 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
5353 16 1, 2025]: Sec. 9. (a) As used in this section, "energy drink" means
5454 17 a beverage that:

5656 1 (1) contains at least sixty-five (65) milligrams of caffeine per
5757 2 eight (8) fluid ounces; and
5858 3 (2) is advertised or marketed as being specifically designed to
5959 4 provide metabolic stimulation or an increase to the
6060 5 consumer's mental or physical energy.
6161 6 The term does not include coffee or any substantially coffee based
6262 7 beverage.
6363 8 (b) As used in this section, "snack chip" means a small portion
6464 9 of potato, corn, or another ingredient that:
6565 10 (1) has been:
6666 11 (A) sliced, shaped, formed, or otherwise segmented from
6767 12 the potato, corn, or other ingredient; and
6868 13 (B) fried or baked; and
6969 14 (2) is packaged in multiples that are sold for consumption
7070 15 without further preparation.
7171 16 (c) As used in this section, "sweetened beverage" means a
7272 17 nonalcoholic beverage:
7373 18 (1) to which a natural or artificial sweetener is added; and
7474 19 (2) that is sold for human consumption;
7575 20 including a soft drink, fruit juice, vegetable juice, and other
7676 21 flavored beverages.
7777 22 (d) Except as provided in subsection (e), a SNAP recipient may
7878 23 not use SNAP benefits to purchase any of the following:
7979 24 (1) An energy drink.
8080 25 (2) A sweetened beverage.
8181 26 (3) A carbonated beverage.
8282 27 (4) Candy ordinarily packaged and sold for consumption
8383 28 without further preparation.
8484 29 (5) Snack chips.
8585 30 (6) Cookies ordinarily packaged and sold for consumption
8686 31 without further preparation.
8787 32 (e) This section does not apply to the following:
8888 33 (1) A milk product or a product, other than a carbonated
8989 34 beverage or energy drink, containing milk or milk protein.
9090 35 (2) A milk substitute, including soy milk, rice milk, or almond
9191 36 milk.
9292 37 (3) A beverage, other than a carbonated beverage or energy
9393 38 drink, in which the only added sweetener does not add
9494 39 calories to the beverage.
9595 40 (4) A beverage that is:
9696 41 (A) intended by the manufacturer for consumption by an
9797 42 infant; and

9999 1 (B) commonly referred to as infant formula.
100100 2 (5) A beverage, other than a carbonated beverage or energy
101101 3 drink, intended by the manufacturer for use for weight
102102 4 reduction.
103103 5 (6) A fruit or vegetable juice, other than a carbonated
104104 6 beverage or energy drink, to which no sugar has been added.
105105 7 (7) A beverage or other product, other than a carbonated
106106 8 beverage or energy drink, intended for use as recommended
107107 9 by a health care professional.
108108 10 (8) A beverage or other product, other than a carbonated
109109 11 beverage or energy drink, that contains plant protein sources.
110110 12 (9) A product, other than a carbonated beverage or energy
111111 13 drink, that:
112112 14 (A) is fortified with a vitamin or mineral; and
113113 15 (B) contains a source of protein.
114114 16 (f) The office shall provide to an individual, at the time the office
115115 17 approves the individual's application to receive SNAP benefits,
116116 18 educational materials that:
117117 19 (1) impart information regarding:
118118 20 (A) the importance of eating healthy food; and
119119 21 (B) the negative effect of foods described in subsection (d)
120120 22 on the human body; and
121121 23 (2) include:
122122 24 (A) statistical data regarding the information described in
123123 25 subdivision (1); and
124124 26 (B) information in graphical, pictorial, or video form that
125125 27 allows the recipient to visualize the manner in which an
126126 28 individual's diet can affect the individual's health
127127 29 outcomes.
128128 30 (g) If the office determines that a waiver or authorization by a
129129 31 federal agency is needed to implement this section, the office:
130130 32 (1) shall, not later than September 1, 2025, request the
131131 33 necessary waiver or authorization; and
132132 34 (2) may delay implementation of this section until the waiver
133133 35 or authorization is granted.
