40+A BILL FOR AN ACT to amend the Indiana Code concerning state
41+and local administration.
1442 Be it enacted by the General Assembly of the State of Indiana:
15-SECTION 1. IC 5-14-9 IS ADDED TO THE INDIANA CODE AS
16-A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE JULY
17-1, 2025]:
18-Chapter 9. Disclosure of Appointing Authority
19-Sec. 1. As used in this chapter, "appointed officer" means an
20-unelected or elected officer of the state or a political subdivision
21-who is appointed to serve on a board by an appointing authority.
22-Sec. 2.As used in this chapter, "appointing authority" means:
23-(1) an elected officer; or
24-(2) a board of members who are all elected officers;
25-of the state or a political subdivision.
26-Sec. 3. As used in this chapter, "board" means a board, body,
27-committee, commission, or any other instrumentality of the state
28-or a political subdivision.
29-Sec. 4. As used in this chapter, "political subdivision" has the
30-meaning set forth in IC 36-1-2-13.
31-Sec. 5. As used in this chapter, "state" means any of the
32-following:
33-(1) A department, commission, division, authority, board,
34-bureau, or office of state government that exercises any:
35-(A) executive including administrative; or

37-(B) legislative;
38-powers.
39-(2) Any statewide elected official.
40-(3) A body corporate and politic of the state created by state
41-statute.
42-(4) A state educational institution (as defined in
43-IC 21-7-13-32).
44-Sec. 6. Any board meeting notice or agenda must provide the
45-following information regarding each appointed officer serving on
46-the board:
47-(1) The officer's name.
48-(2) The appointing authority.
49-(3) The beginning and expiration date of the officer's term of
50-appointment.
51-Sec. 7. The information under section 6 of this chapter
52-regarding a board's appointed officers shall be:
53-(1) published on:
54-(A) the board's website, if any; or
55-(B) the appointing authority's website, if any; or
56-(2) published on the Internet through the computer gateway
57-administered by the office of technology established by
58-IC 4-13.1-2-1, if the board or appointing authority does not
59-have a website.
