25	25	A BILL FOR AN ACT to amend the Indiana Code concerning
26	26	general provisions.
27	27	Be it enacted by the General Assembly of the State of Indiana:
28	28	1 SECTION 1. IC 1-1-9-1 IS AMENDED TO READ AS FOLLOWS
29	29	2 [EFFECTIVE JULY 1, 2025]: Sec. 1. (a) The following are legal
30	30	3 holidays within the state of Indiana for all purposes:
31	31	4 New Year's Day, January 1.
32	32	5 Martin Luther King, Jr.'s Birthday, the third Monday in January.
33	33	6 Abraham Lincoln's Birthday, February 12.
34	34	7 American Professional Football Day, the Monday following
35	35	8 the day on which the championship game of the world's
36	36	9 largest American professional football league is played.
37	37	10 George Washington's Birthday, the third Monday in February.
38	38	11 Good Friday, a movable feast day.
39	39	12 Memorial Day, the last Monday in May.
40	40	13 Independence Day, July 4.
41	41	14 Labor Day, the first Monday in September.
42	42	15 Columbus Day, the second Monday in October.
43	43	16 Election Day, the day of any general, municipal, or primary
44	44	17 election.

50	50	5 (b) When any of these holidays, other than Sunday, comes on
51	51	6 Sunday, the following Monday shall be the legal holiday. When any of
52	52	7 these holidays comes on Saturday, the preceding Friday shall be the
53	53	8 legal holiday.
54	54	9 (c) This section does not affect any action taken by the state, the
55	55	10 general assembly while in session, or a political subdivision (as defined
56	56	11 in IC 36-1-2-13). Any action taken by the state, the general assembly,
57	57	12 or a political subdivision on any such holiday shall be valid for all
58	58	13 purposes.
59	59	14 SECTION 2. IC 15-17-5-12, AS ADDED BY P.L.2-2008,
60	60	15 SECTION 8, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
61	61	16 JULY 1, 2025]: Sec. 12. (a) Except as provided in subsection (b), the
62	62	17 board is not required to furnish meat or poultry inspection under this
63	63	18 chapter:
64	64	19 (1) for more than eight (8) hours in one (1) day;
65	65	20 (2) for more than forty (40) hours in one (1) calendar week; or
66	66	21 (3) on Saturdays, Sundays, or the following legal holidays:
67	67	22 (A) New Year's Day.
68	68	23 (B) Washington's Birthday.
69	69	24 (C) Memorial Day.
70	70	25 (D) Martin Luther King, Jr. Day.
71	71	26 (E) Columbus Day.
72	72	27 (F) Independence Day.
73	73	28 (G) Labor Day.
74	74	29 (H) Veterans Day.
75	75	30 (I) Thanksgiving Day.

78	78	33 (b) If the operator of an establishment under inspection pays to the
79	79	34 board an hourly fee for each hour of state meat or poultry inspection
80	80	35 furnished:
81	81	36 (1) more than eight (8) hours in one (1) day;
82	82	37 (2) more than forty (40) hours in one (1) calendar week; or
83	83	38 (3) on Saturdays, Sundays, and legal holidays;
84	84	39 the board shall furnish the inspection service.
85	85	40 (c) Subject to the approval of the budget agency, the board shall
86	86	41 establish an hourly rate for overtime at an amount sufficient to defray
87	87	42 the cost of the inspection service. The establishment shall reimburse

89	89	1 the board not later than thirty (30) days after assessment for overtime
90	90	2 or legal overtime fees collected under this chapter. The fees must be
91	91	3 deposited with the treasurer of state. All overtime fees deposited with
92	92	4 the treasurer of state under this subsection are appropriated to the
93	93	5 budget agency for allotment to the board for the administration and
94	94	6 enforcement of this chapter.
95	95	7 (d) The board may assign inspection personnel to more than one (1)
96	96	8 establishment in order to efficiently use board personnel and resources.
