31	29		A BILL FOR AN ACT to amend the Indiana Code concerning
32	30		human services and to make an appropriation.
33	31		Be it enacted by the General Assembly of the State of Indiana:
34	32		1 SECTION 1. IC 12-17-12-11 IS AMENDED TO READ AS
35	33		2 FOLLOWS [EFFECTIVE JULY 1, 2025]: Sec. 11. The division may
36	34		3 approve a grant from the fund to an applicant if the applicant
37	35		4 demonstrates to the division that the applicant is able to do the
38	36		5 following:
39	37		6 (1) Provide a physical environment that is safe and appropriate to
40	38		7 the various age levels of the children to be served.
41	39		8 (2) Provide transportation, if necessary, to and from a school or
42	40		9 schools to the facility operated by the applicant.
43	41		10 (3) (2) Provide program activities that are appropriate to the
44	42		11 various age levels of the children to be served and that meet the
45	43		12 developmental needs of each child.
46	44		13 (4) (3) Provide efficient and effective program administration.
47	45		14 (5) (4) Provide a staff that meets standards set by the division
48	46		15 under section 17 of this chapter.
49	47		16 (6) (5) Provide for nutritional needs of children enrolled in the
50	48		17 program.

53	51		2 the program.
54	52		3 (8) (7) Operate a school age child care program in accordance
55	53		4 with the cost and expense standards set by the division under
56	54		5 section 17 of this chapter.
57	55		6 SECTION 2. IC 12-17-12-16 IS AMENDED TO READ AS
58	56		7 FOLLOWS [EFFECTIVE JULY 1, 2025]: Sec. 16. (a) The division
59	57		8 may make grants from the fund to approved applicants for the
60	58		9 establishment and maintenance of a school age child care program.
61	59		10 (b) Except as provided in subsection (d), the amount of each grant
62	60		11 awarded by the division must be an amount that is not more than nine
63	61		12 (9) times the monetary value of the approved applicant's contribution.
64	62		13 (c) The amount granted by the division for use by a single program
65	63		14 may not exceed forty thousand dollars ($40,000).
66	64		15 (d) The division may waive an approved applicant's
67	65		16 contribution if the approved applicant is an organization with an
68	66		17 operating budget of less than one hundred thousand dollars
69	67		18 ($100,000).
70	68		19 SECTION 3. IC 12-17-12-17 IS AMENDED TO READ AS
71	69		20 FOLLOWS [EFFECTIVE JULY 1, 2025]: Sec. 17. The director of the
72	70		21 division shall adopt rules under IC 4-22-2 necessary to carry out this
73	71		22 chapter, including rules specifying the following:
74	72		23 (1) Standards for the hiring of staff for a school age child care
75	73		24 program.
76	74		25 (2) Cost and expense standards for the following:
77	75		26 (A) Establishing and operating a school age child care
78	76		27 program within a school and within a facility other than a
79	77		28 school.
80	78		29 (B) Transporting a child to a facility where the child does
81	79		30 not attend school.
82	80		31 (3) A sliding fee scale for use by school age child care programs
83	81		32 that are operating under a grant from the fund.
84	82		33 (4) Minimum staff to child ratios for a school age child care
85	83		34 program.
86	84		35 (5) Physical space requirements for a school age child care
87	85		36 program, including indoor and outdoor space.
88	86		37 (6) Nutrition requirements for a school age child care program.
89	87		38 (7) Standards for the provision of emergency health services in a
90	88		39 school age child care program.
91	89		40 (8) Application guidelines and deadlines.
92	90		41 (9) A method for establishing priority of applicants.
93	91		42 SECTION 4. [EFFECTIVE JULY 1, 2025] (a) There is

95	93		1 appropriated from the state general fund to the school age child
96	94		2 care project fund established by IC 12-17-12-7 four million dollars
97	95		3 ($4,000,000) for the biennium beginning July 1, 2025, and ending
98	96		4 June 30, 2027, for use by the division of family resources in
99	97		5 providing grants under IC 12-17-12.
