3129 A BILL FOR AN ACT to amend the Indiana Code concerning
3230 human services and to make an appropriation.
3331 Be it enacted by the General Assembly of the State of Indiana:
3432 1 SECTION 1. IC 12-17-12-11 IS AMENDED TO READ AS
3533 2 FOLLOWS [EFFECTIVE JULY 1, 2025]: Sec. 11. The division may
3634 3 approve a grant from the fund to an applicant if the applicant
3735 4 demonstrates to the division that the applicant is able to do the
3836 5 following:
3937 6 (1) Provide a physical environment that is safe and appropriate to
4038 7 the various age levels of the children to be served.
4139 8 (2) Provide transportation, if necessary, to and from a school or
4240 9 schools to the facility operated by the applicant.
4341 10 (3) (2) Provide program activities that are appropriate to the
4442 11 various age levels of the children to be served and that meet the
4543 12 developmental needs of each child.
4644 13 (4) (3) Provide efficient and effective program administration.
4745 14 (5) (4) Provide a staff that meets standards set by the division
4846 15 under section 17 of this chapter.
4947 16 (6) (5) Provide for nutritional needs of children enrolled in the
5048 17 program.

5250 1 (7) (6) Provide emergency health services to children served by

5452 3 (8) (7) Operate a school age child care program in accordance
5553 4 with the cost and expense standards set by the division under
5654 5 section 17 of this chapter.
5755 6 SECTION 2. IC 12-17-12-16 IS AMENDED TO READ AS
5856 7 FOLLOWS [EFFECTIVE JULY 1, 2025]: Sec. 16. (a) The division
5957 8 may make grants from the fund to approved applicants for the
6058 9 establishment and maintenance of a school age child care program.
6159 10 (b) Except as provided in subsection (d), the amount of each grant
6260 11 awarded by the division must be an amount that is not more than nine
6361 12 (9) times the monetary value of the approved applicant's contribution.
6462 13 (c) The amount granted by the division for use by a single program
6563 14 may not exceed forty thousand dollars ($40,000).
6664 15 (d) The division may waive an approved applicant's
6765 16 contribution if the approved applicant is an organization with an
6866 17 operating budget of less than one hundred thousand dollars
6967 18 ($100,000).
7068 19 SECTION 3. IC 12-17-12-17 IS AMENDED TO READ AS
7169 20 FOLLOWS [EFFECTIVE JULY 1, 2025]: Sec. 17. The director of the
7270 21 division shall adopt rules under IC 4-22-2 necessary to carry out this
7371 22 chapter, including rules specifying the following:
7472 23 (1) Standards for the hiring of staff for a school age child care
7573 24 program.
7674 25 (2) Cost and expense standards for the following:
7775 26 (A) Establishing and operating a school age child care
7876 27 program within a school and within a facility other than a
7977 28 school.
8078 29 (B) Transporting a child to a facility where the child does
8179 30 not attend school.
8280 31 (3) A sliding fee scale for use by school age child care programs
8381 32 that are operating under a grant from the fund.
8482 33 (4) Minimum staff to child ratios for a school age child care
8583 34 program.
8684 35 (5) Physical space requirements for a school age child care
8785 36 program, including indoor and outdoor space.
8886 37 (6) Nutrition requirements for a school age child care program.
8987 38 (7) Standards for the provision of emergency health services in a
9088 39 school age child care program.
9189 40 (8) Application guidelines and deadlines.
9290 41 (9) A method for establishing priority of applicants.
9391 42 SECTION 4. [EFFECTIVE JULY 1, 2025] (a) There is

9593 1 appropriated from the state general fund to the school age child
9694 2 care project fund established by IC 12-17-12-7 four million dollars
9795 3 ($4,000,000) for the biennium beginning July 1, 2025, and ending
9896 4 June 30, 2027, for use by the division of family resources in
9997 5 providing grants under IC 12-17-12.
