28	28	A BILL FOR AN ACT to amend the Indiana Code concerning
29	29	elections.
30	30	Be it enacted by the General Assembly of the State of Indiana:
31	31	1 SECTION 1. IC 3-11-8-1.2, AS AMENDED BY P.L.128-2015,
32	32	2 SECTION 174, IS AMENDED TO READ AS FOLLOWS
33	33	3 [EFFECTIVE JULY 1, 2025]: Sec. 1.2. (a) As used in this section,
34	34	4 "facility" refers to the facility in which a polling place is located.
35	35	5 (b) For purposes of this chapter, a facility is an "accessible facility"
36	36	6 for elderly voters and voters with disabilities only if the following
37	37	7 apply:
38	38	8 (1) The facility meets the standards for accessibility for elderly
39	39	9 voters and voters with disabilities established under 52 U.S.C.
40	40	10 20101 through 52 U.S.C. 20107.
41	41	11 (2) All the following are accessible to elderly voters and voters
42	42	12 with disabilities in a manner that provides the same opportunity
43	43	13 for access and participation (including privacy and independence)
44	44	14 as for other voters:
45	45	15 (A) Parking spaces marked and available to conform with
46	46	16 IC 5-16-9.
47	47	17 (B) The path to the facility that an individual must travel on

49	49	1 the property where the facility is located.
50	50	2 (C) The entrances of the facility to be used by voters.
51	51	3 (D) The paths of travel within the facility to the rooms or areas
52	52	4 where the voting systems are located.
53	53	5 (E) The rooms or areas in the facility where the voting systems
54	54	6 are located.
55	55	7 (c) In addition to the requirements of subsection (b), a facility
56	56	8 must do the following:
57	57	9 (1) Implement a policy that allows an elderly voter, a voter
58	58	10 with a physical disability, or a visibly pregnant voter to
59	59	11 request to bypass other voters who are in line to vote and cast
60	60	12 a vote before the other voters at the facility. The policy must
61	61	13 identify to whom a voter is required to make a request under
62	62	14 this subdivision.
63	63	15 (2) Display a notice that describes the policy required under
64	64	16 subdivision (1) in at least 24 point font size on a poster in a
65	65	17 conspicuous place that is readily accessible to a voter upon
66	66	18 arrival to the facility.
67	67	19 (d) The requirements of subsection subsections (b) and (c) are
68	68	20 satisfied if a facility will comply with subsection subsections (b) and
69	69	21 (c) by implementing temporary measures.
70	70	22 SECTION 2. IC 3-11-18.1-4, AS AMENDED BY P.L.278-2019,
71	71	23 SECTION 115, IS AMENDED TO READ AS FOLLOWS
72	72	24 [EFFECTIVE JULY 1, 2025]: Sec. 4. The plan required by section 3
73	73	25 of this chapter must include at least the following:
74	74	26 (1) The total number of vote centers to be established.
75	75	27 (2) The location of each vote center.
76	76	28 (3) The effective date of the order.
77	77	29 (4) The following information according to the computerized list
78	78	30 (as defined in IC 3-7-26.3-2) as of the date of the order:
79	79	31 (A) The total number of voters within the county.
80	80	32 (B) The number of active voters within the county.
81	81	33 (C) The number of inactive voters within the county.
82	82	34 (5) For each vote center designated under subdivision (2), the
83	83	35 number of precinct election boards that will be appointed to
84	84	36 administer an election at the vote center.
85	85	37 (6) For each precinct election board designated under subdivision
86	86	38 (5), the number and name of each precinct the precinct election
87	87	39 board will administer consistent with section 13 of this chapter for
88	88	40 an election that is not being held in each precinct of the county.
89	89	41 (7) For each vote center designated under subdivision (2), the
90	90	42 number and title of the precinct election officers who will be

92	92	1 appointed to serve at the vote center.
93	93	2 (8) For each vote center designated under subdivision (2):
94	94	3 (A) the number and type of ballot variations that will be
95	95	4 provided at the vote center; and
96	96	5 (B) whether these ballots will be:
97	97	6 (i) delivered to the vote center before the opening of the
98	98	7 polls; or
99	99	8 (ii) printed on demand for a voter's use.
100	100	9 (9) A detailed description of any hardware, firmware, or software
101	101	10 used:
102	102	11 (A) to create an electronic poll list for each precinct whose
103	103	12 polls are to be located at a vote center; or
104	104	13 (B) to manage data in an electronic poll book through a secure
105	105	14 electronic connection between the county election board and
106	106	15 the precinct election officials administering a vote center.
107	107	16 (10) A description of the equipment and procedures to be used to
108	108	17 ensure that information concerning a voter entered into any
109	109	18 electronic poll book used by precinct election officers at a vote
110	110	19 center is immediately accessible to:
111	111	20 (A) the county election board; and
112	112	21 (B) the electronic poll books used by precinct election officers
113	113	22 at all other vote centers in the county.
114	114	23 (11) This subdivision applies to a county in which ballot cards are
115	115	24 used at a vote center. For each vote center designated under
116	116	25 subdivision (2), whether each ballot card printed will have the
117	117	26 printed initials of the poll clerks captured through the electronic
118	118	27 signature pad or tablet at the time the poll clerks log into the
119	119	28 electronic poll book system printed on the back of the ballot card
120	120	29 immediately before the ballot card is delivered to a voter.
121	121	30 (12) The security and contingency plans to be implemented by the
122	122	31 county to do all of the following:
123	123	32 (A) Prevent a disruption of the vote center process.
124	124	33 (B) Ensure that the election is properly conducted if a
125	125	34 disruption occurs.
126	126	35 (C) Prevent access to an electronic poll book without the
127	127	36 coordinated action of two (2) precinct election officers who are
128	128	37 not members of the same political party.
129	129	38 (13) A certification that the vote center complies with the
130	130	39 accessibility requirements applicable to polling places under
131	131	40 IC 3-11-8, including facility requirements under IC 3-11-8-1.2.
132	132	41 (14) A sketch depicting the planned layout of the vote center,
133	133	42 indicating the location of:

135	135	1 (A) equipment; and
136	136	2 (B) precinct election officers;
137	137	3 within the vote center.
138	138	4 (15) The total number and locations of satellite offices to be
139	139	5 established under IC 3-11-10-26.3 at vote center locations
140	140	6 designated under subdivision (2) to allow voters to cast absentee
141	141	7 ballots in accordance with IC 3-11. However, a plan must provide
142	142	8 for at least one (1) vote center to be established as a satellite
143	143	9 office under IC 3-11-10-26.3 on the two (2) Saturdays
144	144	10 immediately preceding an election day.
145	145	11 (16) The method and timing of providing voter data to persons
146	146	12 who are entitled to receive the data under this title. Data shall be
147	147	13 provided to all persons entitled to the data without unreasonable
148	148	14 delay.
149	149	15 (17) In a county in which a majority of votes are cast on optical
150	150	16 scan ballot cards, any additional procedures to provide for
151	151	17 efficient and secure voting at each vote center, including ballot on
152	152	18 demand printing.
