2828 A BILL FOR AN ACT to amend the Indiana Code concerning
2929 elections.
3030 Be it enacted by the General Assembly of the State of Indiana:
3131 1 SECTION 1. IC 3-11-8-1.2, AS AMENDED BY P.L.128-2015,
3232 2 SECTION 174, IS AMENDED TO READ AS FOLLOWS
3333 3 [EFFECTIVE JULY 1, 2025]: Sec. 1.2. (a) As used in this section,
3434 4 "facility" refers to the facility in which a polling place is located.
3535 5 (b) For purposes of this chapter, a facility is an "accessible facility"
3636 6 for elderly voters and voters with disabilities only if the following
3737 7 apply:
3838 8 (1) The facility meets the standards for accessibility for elderly
3939 9 voters and voters with disabilities established under 52 U.S.C.
4040 10 20101 through 52 U.S.C. 20107.
4141 11 (2) All the following are accessible to elderly voters and voters
4242 12 with disabilities in a manner that provides the same opportunity
4343 13 for access and participation (including privacy and independence)
4444 14 as for other voters:
4545 15 (A) Parking spaces marked and available to conform with
4646 16 IC 5-16-9.
4747 17 (B) The path to the facility that an individual must travel on

4949 1 the property where the facility is located.
5050 2 (C) The entrances of the facility to be used by voters.
5151 3 (D) The paths of travel within the facility to the rooms or areas
5252 4 where the voting systems are located.
5353 5 (E) The rooms or areas in the facility where the voting systems
5454 6 are located.
5555 7 (c) In addition to the requirements of subsection (b), a facility
5656 8 must do the following:
5757 9 (1) Implement a policy that allows an elderly voter, a voter
5858 10 with a physical disability, or a visibly pregnant voter to
5959 11 request to bypass other voters who are in line to vote and cast
6060 12 a vote before the other voters at the facility. The policy must
6161 13 identify to whom a voter is required to make a request under
6262 14 this subdivision.
6363 15 (2) Display a notice that describes the policy required under
6464 16 subdivision (1) in at least 24 point font size on a poster in a
6565 17 conspicuous place that is readily accessible to a voter upon
6666 18 arrival to the facility.
6767 19 (d) The requirements of subsection subsections (b) and (c) are
6868 20 satisfied if a facility will comply with subsection subsections (b) and
6969 21 (c) by implementing temporary measures.
7070 22 SECTION 2. IC 3-11-18.1-4, AS AMENDED BY P.L.278-2019,
7171 23 SECTION 115, IS AMENDED TO READ AS FOLLOWS
7272 24 [EFFECTIVE JULY 1, 2025]: Sec. 4. The plan required by section 3
7373 25 of this chapter must include at least the following:
7474 26 (1) The total number of vote centers to be established.
7575 27 (2) The location of each vote center.
7676 28 (3) The effective date of the order.
7777 29 (4) The following information according to the computerized list
7878 30 (as defined in IC 3-7-26.3-2) as of the date of the order:
7979 31 (A) The total number of voters within the county.
8080 32 (B) The number of active voters within the county.
8181 33 (C) The number of inactive voters within the county.
8282 34 (5) For each vote center designated under subdivision (2), the
8383 35 number of precinct election boards that will be appointed to
8484 36 administer an election at the vote center.
8585 37 (6) For each precinct election board designated under subdivision
8686 38 (5), the number and name of each precinct the precinct election
8787 39 board will administer consistent with section 13 of this chapter for
8888 40 an election that is not being held in each precinct of the county.
8989 41 (7) For each vote center designated under subdivision (2), the
9090 42 number and title of the precinct election officers who will be

9292 1 appointed to serve at the vote center.
9393 2 (8) For each vote center designated under subdivision (2):
9494 3 (A) the number and type of ballot variations that will be
9595 4 provided at the vote center; and
9696 5 (B) whether these ballots will be:
9797 6 (i) delivered to the vote center before the opening of the
9898 7 polls; or
9999 8 (ii) printed on demand for a voter's use.
100100 9 (9) A detailed description of any hardware, firmware, or software
101101 10 used:
102102 11 (A) to create an electronic poll list for each precinct whose
103103 12 polls are to be located at a vote center; or
104104 13 (B) to manage data in an electronic poll book through a secure
105105 14 electronic connection between the county election board and
106106 15 the precinct election officials administering a vote center.
107107 16 (10) A description of the equipment and procedures to be used to
108108 17 ensure that information concerning a voter entered into any
109109 18 electronic poll book used by precinct election officers at a vote
110110 19 center is immediately accessible to:
111111 20 (A) the county election board; and
112112 21 (B) the electronic poll books used by precinct election officers
113113 22 at all other vote centers in the county.
114114 23 (11) This subdivision applies to a county in which ballot cards are
115115 24 used at a vote center. For each vote center designated under
116116 25 subdivision (2), whether each ballot card printed will have the
117117 26 printed initials of the poll clerks captured through the electronic
118118 27 signature pad or tablet at the time the poll clerks log into the
119119 28 electronic poll book system printed on the back of the ballot card
120120 29 immediately before the ballot card is delivered to a voter.
121121 30 (12) The security and contingency plans to be implemented by the
122122 31 county to do all of the following:
123123 32 (A) Prevent a disruption of the vote center process.
124124 33 (B) Ensure that the election is properly conducted if a
125125 34 disruption occurs.
126126 35 (C) Prevent access to an electronic poll book without the
127127 36 coordinated action of two (2) precinct election officers who are
128128 37 not members of the same political party.
129129 38 (13) A certification that the vote center complies with the
130130 39 accessibility requirements applicable to polling places under
131131 40 IC 3-11-8, including facility requirements under IC 3-11-8-1.2.
132132 41 (14) A sketch depicting the planned layout of the vote center,
133133 42 indicating the location of:

135135 1 (A) equipment; and
136136 2 (B) precinct election officers;
137137 3 within the vote center.
138138 4 (15) The total number and locations of satellite offices to be
139139 5 established under IC 3-11-10-26.3 at vote center locations
140140 6 designated under subdivision (2) to allow voters to cast absentee
141141 7 ballots in accordance with IC 3-11. However, a plan must provide
142142 8 for at least one (1) vote center to be established as a satellite
143143 9 office under IC 3-11-10-26.3 on the two (2) Saturdays
144144 10 immediately preceding an election day.
145145 11 (16) The method and timing of providing voter data to persons
146146 12 who are entitled to receive the data under this title. Data shall be
147147 13 provided to all persons entitled to the data without unreasonable
148148 14 delay.
149149 15 (17) In a county in which a majority of votes are cast on optical
150150 16 scan ballot cards, any additional procedures to provide for
151151 17 efficient and secure voting at each vote center, including ballot on
152152 18 demand printing.
