43+A BILL FOR AN ACT to amend the Indiana Code concerning
44+education.
1345 Be it enacted by the General Assembly of the State of Indiana:
14-SECTION 1. IC 20-28-3-1, AS AMENDED BY P.L.150-2024,
15-SECTION 21, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
16-JULY 1, 2025]: Sec. 1. (a) As used in this section, "teacher candidate"
17-means an individual recommended for an initial teaching license from
18-a teacher preparation program located in Indiana.
19-(b) As used in this section, "teacher preparation program" includes,
20-but is not limited to, the following:
21-(1) A teacher education school or department.
22-(2) A transition to teaching program under IC 20-28-4.
23-(3) Any other entity approved by the department to offer a course
24-of study leading to an initial teaching license.
25-(c) The department shall:
26-(1) arrange a statewide system of professional instruction for
27-teacher education;
28-(2) accredit and review teacher preparation programs that comply
29-with the rules of the department;
30-(3) approve content area licensure programs for particular kinds
31-of teachers in accredited teacher preparation programs; and
32-(4) specify the types of licenses for individuals who complete
33-programs of approved courses.
34-(d) The department shall work with teacher preparation programs to
35-develop a system of teacher education that ensures individuals who

37-complete teacher preparation programs are able to meet the highest
38-professional standards.
39-(e) Before July 1, 2015, the department shall establish standards for
40-the continuous improvement of program processes and the performance
41-of individuals who complete teacher preparation programs. The state
42-board shall adopt rules containing the standards not later than two
43-hundred seventy (270) days after the department finishes the standards.
44-(f) The standards established under subsection (e) must include
45-benchmarks for performance, including test score data for each teacher
46-preparation entity on content area licensure tests and test score data for
47-each teacher preparation entity on pedagogy licensure tests.
48-(g) Each teacher preparation program shall annually report the
49-program's performance on the standards and benchmarks established
50-under this section to the department. The department shall make the
51-information reported under this subsection available to the public on
52-the department's website. Each teacher preparation program shall make
53-the information reported under this subsection available to the public
54-on the teacher preparation program's website. In addition to reporting
55-performance, each teacher preparation program must report to the
56-department the following:
57-(1) The attrition, retention, and completion rates of teacher
58-candidates for the previous three (3) calendar years. The teacher
59-preparation program must also provide underlying data, as
60-determined by the department, used as part of calculating the
61-teacher preparation program's retention rates.
62-(2) The number of teacher candidates in each content area who
63-complete the teacher preparation program during the year,
64-disaggregated by ranges of cumulative grade point averages.
65-(3) The number of teacher candidates in each content area who,
66-during the year:
67-(A) do not pass a content area licensure examination; and
68-(B) do not retake the content area licensure examination.
69-(h) In making information available to the public on the
70-department's website, the department shall include in the report under
71-subsection (g), in addition to the matrix ratings described in subsection
72-(i), the following information:
73-(1) Average scaled or standard scores of teacher candidates who
74-complete teacher preparation programs on basic skills, content
75-area, and pedagogy licensure examinations.
76-(2) The average number of times teacher candidates who
77-complete a teacher preparation program take each licensing test
78-before receiving a passing score and the percentage of teacher
79-HEA 1634 — Concur 3
80-candidates who receive a passing score on each licensing test on
81-the teacher candidates' first attempts.
82-(i) Not later than July 30, 2016, the department and the commission
83-for higher education, in conjunction with the state board, the
84-Independent Colleges of Indiana, Inc., and teacher preparation
85-programs, shall establish a matrix rating system for teacher preparation
86-programs based on the performance of the programs as demonstrated
87-by the data collected under subsections (g) and (h). The matrix rating
88-system may not rank or compare teacher preparation programs. The
89-matrix rating system must be based on data collected for teachers who
90-initially receive their teaching license during the previous three (3)
91-years. The department shall make the matrix ratings available to the
92-public on the department's website.
93-(j) Each teacher preparation program shall report to the department,
94-in a manner prescribed by the department, the teacher preparation
95-program's admission practices, in accordance with:
96-(1) the Council for the Accreditation of Educator Preparation
97-standards, for teacher preparation programs accredited by the
98-Council for the Accreditation of Educator Preparation;
99-(2) rigorous academic entry requirements for admission into a
100-teacher preparatory program that are equivalent to the minimum
101-academic requirements determined by the Council for the
102-Accreditation of Educator Preparation, for teacher preparation
103-programs that are not accredited by the Council for the
104-Accreditation of Educator Preparation; or
105-(3) the Association for Advancing Quality in Educator
106-Preparation standards, for teacher preparation programs
107-accredited by the Association for Advancing Quality in Educator
108-Preparation.
109-The department shall include information reported to the department
110-on the department's website.
111-(k) Not later than July 30, 2016, the department and the commission
112-for higher education, in conjunction with the state board, the
113-Independent Colleges of Indiana, Inc., and teacher preparation
114-programs, shall establish a minimum rating under the matrix rating
115-system established under subsection (i) that teacher preparation
116-programs must achieve to avoid referral under subsection (l).
117-(l) Not later than July 1 of each year, the department shall submit a
118-list of teacher preparation programs that do not meet the minimum
119-rating established under subsection (k) or the requirements of section
120-3.1 or 3.2 of this chapter to the commission for higher education and
121-the Independent Colleges of Indiana, Inc. for one (1) of the following
122-HEA 1634 — Concur 4
123-actions:
124-(1) In the case of a state educational institution, the commission
125-for higher education shall place the teacher preparation program
126-on an improvement plan with clear performance goals and a
127-designated period in which the performance goals must be
128-achieved.
129-(2) In the case of a proprietary postsecondary educational
130-institution, the commission for higher education shall recommend
131-to the teacher preparation program an improvement plan with
132-clear performance goals and a designated period in which the
133-performance goals should be achieved.
134-(3) In the case of a nonprofit college or university, the
135-Independent Colleges of Indiana, Inc., shall coordinate a peer
136-review process to make recommendations to the peer institution
137-in achieving the department's performance metrics.
138-(m) The department shall approve at least two (2) accreditors that:
139-(1) accredit teacher preparation programs; and
140-(2) are recognized by the Council for Higher Education
141-Accreditation;
142-to accredit teacher preparation programs for use in Indiana.
143-(n) Not later than December 31, 2024, the department and the
144-commission for higher education, in conjunction with the state board,
145-shall partner with teacher preparation programs to receive an outside
146-evaluation by a nationally recognized nonprofit, nonpartisan
147-organization that leverages evidence based approaches on the science
148-of reading to evaluate teacher preparation reading instruction programs.
149-SECTION 2. IC 20-28-3-3.2, AS ADDED BY P.L.150-2024,
150-SECTION 22, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
151-JULY 1, 2025]: Sec. 3.2. (a) As used in this section, "teacher
152-candidate" has the meaning set forth in section 3.1(a) of this chapter.
153-(b) As used in this section, "teacher preparation program" includes
154-the following:
155-(1) A teacher education school or department.
156-(2) A transition to teaching program under IC 20-28-4.
157-(3) Any other entity approved by the department to offer a course
158-of study leading to an initial teaching license.
159-(c) The department shall develop guidelines for accredited teacher
160-preparation programs regarding the use of curriculum or content that
161-prepares elementary school teacher candidates to:
162-(1) effectively teach foundational math skills explicitly and
163-systematically; aligned with evidence based instructional
164-strategies to promote:
165-HEA 1634 — Concur 5
166-(A) conceptual understanding;
167-(B) procedural fluency; and
168-(C) real world problem solving;
169-(2) implement math instruction using high quality instructional
170-material; and
171-(3) understand and use student data to make instructional
172-decisions.
173-(d) The department shall conduct a review of accredited teacher
174-preparation programs for alignment with the requirements of
175-subsection (c) on a schedule determined by the department.
176-(e) Upon review by the department under subsection (d), an
177-accredited teacher preparation program that is not in alignment
178-with the requirements of subsection (c) shall be submitted for a
179-referral under section 1(l) of this chapter.
180-(f) If an accredited teacher preparation program:
181-(1) has been submitted for a referral under subsection (e); and
182-(2) fails to meet the criteria of the improvement plan
183-developed under section 1(l) of this chapter;
184-the department shall revoke the teacher preparation program's
185-right to use the word "accredited".
186-SECTION 3. IC 20-30-18 IS ADDED TO THE INDIANA CODE
187-AS A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE
188-JULY 1, 2025]:
189-Chapter 18. Middle School Advanced Math Course
190-Requirements
191-Sec. 1. As used in this chapter, "charter middle school" means
192-a charter school that is a middle school.
193-Sec. 2. As used in this chapter, "middle school" means any
194-school of a school corporation or charter school that provides
195-instruction to students in any combination of grades 6, 7, or 8.
196-Sec. 3. (a) Each school corporation and charter middle school
197-shall automatically enroll in a middle school advanced math course
198-a student who:
199-(1) scores "above proficient" on the ILEARN assessment for
200-math in grade 5, 6, or 7; and
201-(2) earns a "C" or higher in the student's math course work.
202-(b) A parent of a student described in subsection (a) may opt the
203-student out of automatic enrollment under subsection (a).
204-(c) If a student is automatically enrolled in a middle school
205-advanced math course under this section, the school corporation or
206-charter school in which the student is enrolled shall provide notice
207-to a parent of the student that the:

209-(1) student has been automatically enrolled; and
210-(2) parent may provide notice to the school to opt the student
211-out of the automatic enrollment.
212-Sec. 4. Not later than July 1, 2026, and not later than July 1 each
213-year thereafter, the department shall do the following:

244+9 Sec. 4. Not later than July 1, 2026, and not later than July 1 each
245+10 year thereafter, the department shall do the following:
246+11 (1) Prepare a report that includes the following information:
247+12 (A) The percentage of students, disaggregated by grade
248+13 and school, who:
249+14 (i) scored "above proficient" on the ILEARN assessment
250+15 for math in grades 5, 6, and 7; and
251+16 (ii) were enrolled in an advanced math course in the
252+17 subsequent school year.
253+18 (B) The percentage of students, disaggregated by grade
254+19 and school, who:
255+20 (i) scored "above proficient" on the ILEARN assessment
256+21 for math in grades 5, 6, and 7; and
257+22 (ii) were not enrolled in an advanced math course in the
258+23 subsequent school year.
259+24 (2) Submit the report to the legislative council in an electronic
260+25 format under IC 5-14-6.
261+26 SECTION 4. IC 20-32-6.5 IS ADDED TO THE INDIANA CODE
262+27 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
263+28 1, 2025]:
264+29 Chapter 6.5. Mathematics Screening, Evaluations, and
265+30 Interventions
266+31 Sec. 1. As used in this chapter, "school" means any of the
267+32 following:
268+33 (1) A public school, including a charter school.
269+34 (2) A state accredited nonpublic school.
270+35 (3) An eligible school (as defined in IC 20-51-1-4.7).
271+36 Sec. 2. (a) Beginning with the 2026-2027 school year, each school
272+37 shall administer to all students of the school in kindergarten, grade
273+38 1, and grade 2 screeners approved by the department to identify
274+39 students at risk of not meeting grade level proficiency.
275+40 (b) The screeners must:
276+41 (1) align to Indiana academic standards for mathematics;
277+42 (2) measure foundational numeracy and computation skills;

279+1 (3) receive a convincing or partially convincing rating for
280+2 accuracy, reliability, and validity by:
281+3 (A) the National Center on Intensive Intervention; or
282+4 (B) another third party approved by the department;
283+5 (4) provide parents and schools with data analysis guides for
284+6 interpreting results and comprehensive support for schools to
285+7 guide classroom instruction and the implementation of
286+8 mathematics interventions; and

288+10 statewide data trends to support identification of deficiencies
289+11 in mathematics and guide targeted intervention efforts.
290+12 Sec. 3. (a) Beginning with the 2026-2027 school year, if a school
291+13 determines that a student in kindergarten through grade 8 is at
292+14 risk of not achieving grade level proficiency in mathematics as
293+15 determined by an analysis of the student's data from:
294+16 (1) a grade level screener approved by the department; or
295+17 (2) a through-year statewide assessment;
296+18 the school must provide intervention that meets the requirements
297+19 under subsection (b).
298+20 (b) A school shall provide intervention to a student described in
299+21 subsection (a) that meets the following conditions:
300+22 (1) The intervention includes a multitiered system of support
301+23 that progresses from less to more intensive support based on
302+24 the student's individual needs.
303+25 (2) The intervention is aligned to daily Tier I instruction and
304+26 standard level learning progressions.
305+27 (3) The intervention is:
306+28 (A) targeted;
307+29 (B) differentiated; and
308+30 (C) supplemental to Tier I instruction.
309+31 (4) The intervention:
310+32 (A) is aligned with evidence based instructional strategies
311+33 to promote conceptual understanding, procedural fluency,
312+34 and real world problem solving; and
313+35 (B) allows a student opportunities to interact, show
314+36 progress, and demonstrate understanding through
315+37 rigorous grade level content.
316+38 (5) The intervention includes continual assessment and in
317+39 depth analysis of each student's data to inform the flexible
318+40 movement in and out of Tiers II and III.
319+41 (c) The department shall provide guidance on the multitiered
320+42 system that a school is required to provide under subsection (b).

232-Chapter 6.5. Mathematics Screening, Evaluations, and
233-Interventions
234-Sec. 1. As used in this chapter, "school" means any of the
235-following:
236-(1) A public school, including a charter school.
237-(2) A state accredited nonpublic school.
238-(3) An eligible school (as defined in IC 20-51-1-4.7).
239-Sec. 2. (a) Beginning with the 2026-2027 school year, each school
240-shall administer to all students of the school in kindergarten, grade
241-1, and grade 2 screeners approved by the department to identify
242-students at risk of not meeting grade level proficiency.
243-(b) The screeners must:
244-(1) align to Indiana academic standards for mathematics;
245-(2) measure foundational numeracy and computation skills;
246-(3) receive a convincing or partially convincing rating for
247-accuracy, reliability, and validity by:
248-(A) the National Center on Intensive Intervention; or
249-(B) another third party approved by the department;
250-(4) provide parents and schools with data analysis guides for

252-interpreting results and comprehensive support for schools to
253-guide classroom instruction and the implementation of
254-mathematics interventions; and
255-(5) provide the department with an annual analysis of
