1212 distribution service; in the preceding year; and (2) the statistical change
1313 in each of these average amounts since the first year for which the
1414 commission reported the average amount.

3131 A BILL FOR AN ACT to amend the Indiana Code concerning
3232 utilities.
3333 Be it enacted by the General Assembly of the State of Indiana:
3434 1 SECTION 1. IC 8-1-1-14, AS AMENDED BY P.L.71-2022,
3535 2 SECTION 1, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
3636 3 JULY 1, 2025]: Sec. 14. (a) As used in this section, "committee" refers
3737 4 to the interim study committee on energy, utilities, and
3838 5 telecommunications established by IC 2-5-1.3-4(8).
3939 6 (b) The chairman of the commission shall prepare an annual report
4040 7 and file it with the governor and the chairman of the legislative council
4141 8 before October 1 of each year. The commission shall present the annual
4242 9 report to the committee before October 1 of each year. A report filed
4343 10 under this subsection with the chairman of the legislative council must
4444 11 be in an electronic format under IC 5-14-6. The chairman shall include
4545 12 in the annual report information for the fiscal year ending June 30 of
4646 13 the year in which the report is due.
4747 14 (c) The annual report required under subsection (b) must include the
4848 15 following:
4949 16 (1) An update on the operations of the commission, including the
5050 17 following:

5252 1 (A) Statistics relevant to the workload and operations of the
5353 2 commission.
5454 3 (B) A statement of the commission's revenues by source and
5555 4 expenditures by purpose.
5656 5 (C) A description of the commission's goals, legal
5757 6 responsibilities, and accomplishments.
5858 7 (D) Comments on the state of the commission and the various
5959 8 kinds of utilities that it regulates.
6060 9 (E) Any other matters that the commission wishes to bring to
6161 10 the attention of the governor and the general assembly.
6262 11 (2) Information concerning changes or emerging trends in the
6363 12 energy utility industry, and the effects of those changes or trends
6464 13 on service and on the pricing of all energy utility services under
6565 14 the jurisdiction of the commission. The information reported
6666 15 under this subdivision must include the following:
6767 16 (A) The:
6868 17 (i) average amount paid by an Indiana resident for
6969 18 energy utility service in the preceding year; and
7070 19 (ii) statistical change in the amount reported under item
7171 20 (i) since the first year for which the commission reported
7272 21 the amount.
7373 22 (A) (B) The effects of competition or changes in the energy
7474 23 utility industry, including the impact on customer rates.
7575 24 (B) (C) The status of modernization of the energy utility
7676 25 facilities in Indiana and the incentives in place to further
7777 26 enhance this infrastructure.
7878 27 (C) (D) The effects on economic development of the
7979 28 modernization described in clause (B). (C).
8080 29 (D) (E) Changes in Indiana's electricity generation mix.
8181 30 (E) (F) Any other energy utility matters the commission
8282 31 considers appropriate.
8383 32 (3) Information concerning changes or emerging trends in the
8484 33 water and wastewater utility industries, and the effects of those
8585 34 changes or trends on service and on the pricing of all water and
8686 35 wastewater utility services under the jurisdiction of the
8787 36 commission. The information reported under this subdivision
8888 37 must include the following:
8989 38 (A) The:
9090 39 (i) average amount paid by an Indiana resident for water
9191 40 and wastewater utility service in the preceding year; and
9292 41 (ii) statistical change in the amount reported under item
9393 42 (i) since the first year for which the commission reported

9595 1 the amount.
9696 2 (A) (B) The effects of changes in the water and wastewater
9797 3 utility industries, including the impact on customer rates.
9898 4 (B) (C) The status of water and wastewater utility
9999 5 infrastructure in Indiana and the incentives in place to further
100100 6 enhance this infrastructure.
101101 7 (C) (D) An update on:
102102 8 (i) acquisitions under IC 8-1-30.3;
103103 9 (ii) consolidations;
104104 10 (iii) regionalization; and
105105 11 (iv) service territory disputes;
106106 12 involving water and wastewater utilities.
107107 13 (D) (E) The nature and extent of the jurisdiction of the
108108 14 commission and other state agencies over various types of
109109 15 water and wastewater utilities.
110110 16 (E) (F) Any other water or wastewater utility matters the
111111 17 commission considers appropriate.
112112 18 (4) Information concerning the communications services industry,
113113 19 including the following:
114114 20 (A) The type and availability of communications service
115115 21 provided to Indiana customers, including the provision of
116116 22 video service (as defined in IC 8-1-34-14).
117117 23 (B) Details on the status of the Indiana universal service fund.
118118 24 (C) The status of eligible telecommunications carriers for
119119 25 purposes of receiving:
120120 26 (i) Lifeline reimbursement from the federal universal service
121121 27 fund;
122122 28 (ii) support to serve rural and high cost areas; and
123123 29 (iii) other monetary support from the federal universal
124124 30 service fund;
125125 31 through the administrator designated by the Federal
126126 32 Communications Commission.
127127 33 (D) A summary of the video franchise fee reports submitted
128128 34 under IC 8-1-34-24.5.
129129 35 (E) Any other matters concerning the communications services
130130 36 industry the commission considers appropriate.
131131 37 (5) Information concerning Indiana's pipeline safety program,
132132 38 including the following:
133133 39 (A) An update on the activities of the commission's pipeline
134134 40 safety division established by IC 8-1-22.5-2.
135135 41 (B) An update on activities under IC 8-1-26.
136136 42 (C) An update on the underground plant protection account

138138 1 established by IC 8-1-26-24.
139139 2 (D) Any other matters concerning pipeline safety the
140140 3 commission considers appropriate.
141141 4 (6) The:
142142 5 (A) average amount paid by an Indiana resident for gas
143143 6 distribution service (as defined in IC 8-1-2-87) in the
144144 7 preceding year; and
145145 8 (B) statistical change in the amount reported under clause
146146 9 (A) since the first year for which the commission reported
147147 10 the amount.
148148 11 SECTION 2. IC 8-1-1-14.1 IS ADDED TO THE INDIANA CODE
149149 12 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
150150 13 1, 2025]: Sec. 14.1. The commission shall publish on the
151151 14 commission's website the information described in:
152152 15 (1) section 14(c)(2)(A);
153153 16 (2) section 14(c)(3)(A); and
154154 17 (3) section 14(c)(6);
155155 18 of this chapter.
