8	8	utility regulatory commission (commission) to include in the
9	9	commission's annual report and publish on the commission's website:
10	10	(1) the average amount paid by an Indiana resident for: (A) energy
11	11	utility service; (B) water and wastewater utility service; and (C) gas
12	12	distribution service; in the preceding year; and (2) the statistical change
13	13	in each of these average amounts since the first year for which the
14	14	commission reported the average amount.

31	31	A BILL FOR AN ACT to amend the Indiana Code concerning
32	32	utilities.
33	33	Be it enacted by the General Assembly of the State of Indiana:
34	34	1 SECTION 1. IC 8-1-1-14, AS AMENDED BY P.L.71-2022,
35	35	2 SECTION 1, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
36	36	3 JULY 1, 2025]: Sec. 14. (a) As used in this section, "committee" refers
37	37	4 to the interim study committee on energy, utilities, and
38	38	5 telecommunications established by IC 2-5-1.3-4(8).
39	39	6 (b) The chairman of the commission shall prepare an annual report
40	40	7 and file it with the governor and the chairman of the legislative council
41	41	8 before October 1 of each year. The commission shall present the annual
42	42	9 report to the committee before October 1 of each year. A report filed
43	43	10 under this subsection with the chairman of the legislative council must
44	44	11 be in an electronic format under IC 5-14-6. The chairman shall include
45	45	12 in the annual report information for the fiscal year ending June 30 of
46	46	13 the year in which the report is due.
47	47	14 (c) The annual report required under subsection (b) must include the
48	48	15 following:
49	49	16 (1) An update on the operations of the commission, including the
50	50	17 following:

52	52	1 (A) Statistics relevant to the workload and operations of the
53	53	2 commission.
54	54	3 (B) A statement of the commission's revenues by source and
55	55	4 expenditures by purpose.
56	56	5 (C) A description of the commission's goals, legal
57	57	6 responsibilities, and accomplishments.
58	58	7 (D) Comments on the state of the commission and the various
59	59	8 kinds of utilities that it regulates.
60	60	9 (E) Any other matters that the commission wishes to bring to
61	61	10 the attention of the governor and the general assembly.
62	62	11 (2) Information concerning changes or emerging trends in the
63	63	12 energy utility industry, and the effects of those changes or trends
64	64	13 on service and on the pricing of all energy utility services under
65	65	14 the jurisdiction of the commission. The information reported
66	66	15 under this subdivision must include the following:
67	67	16 (A) The:
68	68	17 (i) average amount paid by an Indiana resident for
69	69	18 energy utility service in the preceding year; and
70	70	19 (ii) statistical change in the amount reported under item
71	71	20 (i) since the first year for which the commission reported
72	72	21 the amount.
73	73	22 (A) (B) The effects of competition or changes in the energy
74	74	23 utility industry, including the impact on customer rates.
75	75	24 (B) (C) The status of modernization of the energy utility
76	76	25 facilities in Indiana and the incentives in place to further
77	77	26 enhance this infrastructure.
78	78	27 (C) (D) The effects on economic development of the
79	79	28 modernization described in clause (B). (C).
80	80	29 (D) (E) Changes in Indiana's electricity generation mix.
81	81	30 (E) (F) Any other energy utility matters the commission
82	82	31 considers appropriate.
83	83	32 (3) Information concerning changes or emerging trends in the
84	84	33 water and wastewater utility industries, and the effects of those
85	85	34 changes or trends on service and on the pricing of all water and
86	86	35 wastewater utility services under the jurisdiction of the
87	87	36 commission. The information reported under this subdivision
88	88	37 must include the following:
89	89	38 (A) The:
90	90	39 (i) average amount paid by an Indiana resident for water
91	91	40 and wastewater utility service in the preceding year; and
92	92	41 (ii) statistical change in the amount reported under item
93	93	42 (i) since the first year for which the commission reported

95	95	1 the amount.
96	96	2 (A) (B) The effects of changes in the water and wastewater
97	97	3 utility industries, including the impact on customer rates.
98	98	4 (B) (C) The status of water and wastewater utility
99	99	5 infrastructure in Indiana and the incentives in place to further
100	100	6 enhance this infrastructure.
101	101	7 (C) (D) An update on:
102	102	8 (i) acquisitions under IC 8-1-30.3;
103	103	9 (ii) consolidations;
104	104	10 (iii) regionalization; and
105	105	11 (iv) service territory disputes;
106	106	12 involving water and wastewater utilities.
107	107	13 (D) (E) The nature and extent of the jurisdiction of the
108	108	14 commission and other state agencies over various types of
109	109	15 water and wastewater utilities.
110	110	16 (E) (F) Any other water or wastewater utility matters the
111	111	17 commission considers appropriate.
112	112	18 (4) Information concerning the communications services industry,
113	113	19 including the following:
114	114	20 (A) The type and availability of communications service
115	115	21 provided to Indiana customers, including the provision of
116	116	22 video service (as defined in IC 8-1-34-14).
117	117	23 (B) Details on the status of the Indiana universal service fund.
118	118	24 (C) The status of eligible telecommunications carriers for
119	119	25 purposes of receiving:
120	120	26 (i) Lifeline reimbursement from the federal universal service
121	121	27 fund;
122	122	28 (ii) support to serve rural and high cost areas; and
123	123	29 (iii) other monetary support from the federal universal
124	124	30 service fund;
125	125	31 through the administrator designated by the Federal
126	126	32 Communications Commission.
127	127	33 (D) A summary of the video franchise fee reports submitted
128	128	34 under IC 8-1-34-24.5.
129	129	35 (E) Any other matters concerning the communications services
130	130	36 industry the commission considers appropriate.
131	131	37 (5) Information concerning Indiana's pipeline safety program,
132	132	38 including the following:
133	133	39 (A) An update on the activities of the commission's pipeline
134	134	40 safety division established by IC 8-1-22.5-2.
135	135	41 (B) An update on activities under IC 8-1-26.
136	136	42 (C) An update on the underground plant protection account

138	138	1 established by IC 8-1-26-24.
139	139	2 (D) Any other matters concerning pipeline safety the
140	140	3 commission considers appropriate.
141	141	4 (6) The:
142	142	5 (A) average amount paid by an Indiana resident for gas
143	143	6 distribution service (as defined in IC 8-1-2-87) in the
144	144	7 preceding year; and
145	145	8 (B) statistical change in the amount reported under clause
146	146	9 (A) since the first year for which the commission reported
147	147	10 the amount.
148	148	11 SECTION 2. IC 8-1-1-14.1 IS ADDED TO THE INDIANA CODE
149	149	12 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
150	150	13 1, 2025]: Sec. 14.1. The commission shall publish on the
151	151	14 commission's website the information described in:
152	152	15 (1) section 14(c)(2)(A);
153	153	16 (2) section 14(c)(3)(A); and
154	154	17 (3) section 14(c)(6);
