Synopsis:  Department of health contract prohibition. Prohibits the
Indiana department of health from requiring a contracted person to
meet additional requirements other than federal requirements specified
in the federal Charitable Choice Act in order to receive certain funding. 
Effective:  Upon passage.

SENATE BILL No. 21
A BILL FOR AN ACT to amend the Indiana Code concerning
health.
Be it enacted by the General Assembly of the State of Indiana:
1 SECTION 1. IC 16-19-3-34 IS ADDED TO THE INDIANA CODE
2 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE
3 UPON PASSAGE]: Sec. 34. (a) This section applies to a contract
4 between the state department and a person to provide pregnancy
5 and parenting related services through funding under a community
6 services block grant program.
7 (b) The state department or a contractor of the state department
8 may not require a person to meet additional requirements other
9 than those required by the federal Charitable Choice Act under 45
10 CFR 1050 for a religious organization in order to receive funding
11 under a program described in subsection (a). This subsection
12 includes that the state department or the contractor may not
13 require services to be provided under the contract by more than
14 one (1) individual.
15 SECTION 2. An emergency is declared for this act.
