SENATE BILL No. 106 A BILL FOR AN ACT to amend the Indiana Code concerning local government. Be it enacted by the General Assembly of the State of Indiana: 1 SECTION 1. IC 36-8-2.1-12 IS ADDED TO THE INDIANA CODE 2 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY 3 1, 2025]: Sec. 12. (a) Notwithstanding defenses available and 4 immunity provided in IC 34-13-3, if a department violates the 5 rights of a public safety officer provided by this chapter, the public 6 safety officer may bring a claim against the department. 7 (b) A public safety officer who prevails in an action brought 8 under this section is entitled to: 9 (1) compensatory relief; 10 (2) declaratory and injunctive relief; and 11 (3) court costs, reasonable attorney's fees, and other 12 reasonable expenses of litigation, including expert witness 13 fees. 2025 IN 106—LS 6411/DI 149
