32 | 32 | | 3 [EFFECTIVE JULY 1, 2025]: Sec. 8.1. (a) A person who |
---|
33 | 33 | | 4 manufactures, finances the manufacture of, or designs an instrument, |
---|
34 | 34 | | 5 a device, or other object that is intended to be used primarily for: |

35 | 35 | | 6 (1) introducing into the human body a controlled substance; or |
---|
36 | 36 | | 7 (2) testing the strength, effectiveness, or purity of a controlled |
---|
37 | 37 | | 8 substance; or |
---|
38 | 38 | | 9 (3) (2) enhancing the effect of a controlled substance; |

72 | 72 | | 25 (4) (3) manufacturing, compounding, converting, producing, |

73 | 73 | | 26 processing, or preparing marijuana, hash oil, hashish, salvia, a |
---|
74 | 74 | | 27 synthetic drug, or a controlled substance; |
---|
75 | 75 | | 28 (5) (4) diluting or adulterating marijuana, hash oil, hashish, salvia, |
---|
76 | 76 | | 29 a synthetic drug, or a controlled substance by individuals; or |

77 | 77 | | 30 (6) (5) any purpose announced or described by the seller that is in |

78 | 78 | | 31 violation of this chapter; |

79 | 79 | | 32 commits a Class A infraction for dealing in paraphernalia. |

80 | 80 | | 33 (b) A person who knowingly or intentionally violates subsection (a) |
---|
81 | 81 | | 34 commits a Class A misdemeanor. However, the offense is a Level 6 |

82 | 82 | | 35 felony if the person has a prior unrelated judgment or conviction under |

83 | 83 | | 36 this section. |

85 | 85 | | 38 (1) Items marketed for use in the preparation, compounding, |

86 | 86 | | 39 packaging, labeling, or other use of marijuana, hash oil, hashish, |

87 | 87 | | 40 salvia, a synthetic drug, or a controlled substance as an incident |

88 | 88 | | 41 to lawful research, teaching, or chemical analysis and not for sale. |

89 | 89 | | 42 (2) Items marketed for or historically and customarily used in |
