7	7	Synopsis: Lane reductions on local roads and streets. Prohibits, in a
8	8	city with a population of at least 50,000, a governmental entity or
9	9	private contractor from engaging in a project that would result in the
10	10	permanent restriction or reduction of one or more travel lanes within
11	11	the city as the result of the project. Provides that if a governmental
12	12	entity or private contractor violates the prohibition, the state
13	13	comptroller shall withhold 10% of the total amount of the distribution
14	14	from the local road and street account that would have otherwise been
15	15	distributed to the city during the calendar year following the calendar
16	16	year in which the travel lanes became restricted or reduced. Provides
17	17	that any distribution amount withheld by the state comptroller reverts
18	18	to the state general fund. Exempts existing rapid transit lines from, and
19	19	lists other exceptions to, the prohibition.

36	36	A BILL FOR AN ACT to amend the Indiana Code concerning
37	37	transportation.
38	38	Be it enacted by the General Assembly of the State of Indiana:
39	39	1 SECTION 1. IC 8-14-1-5.5 IS ADDED TO THE INDIANA CODE
40	40	2 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE
41	41	3 UPON PASSAGE]: Sec. 5.5. (a) As used in this chapter, "qualified
42	42	4 city" means a city with a population of at least fifty thousand
43	43	5 (50,000).
44	44	6 (b) A governmental entity or private contractor is prohibited
45	45	7 from engaging in a project in a qualified city that would result in
46	46	8 the permanent restriction or reduction of one (1) or more travel
47	47	9 lanes within the qualified city as the result of the project.
48	48	10 (c) If a governmental entity or private contractor violates the
49	49	11 prohibition described in subsection (b), the state comptroller shall
50	50	12 withhold ten percent (10%) of the total amount of the distribution
51	51	13 from the local road and street account that would have otherwise
52	52	14 been distributed to the qualified city during the calendar year
53	53	15 following the calendar year in which the travel lanes became
54	54	16 restricted or were reduced.
55	55	17 (d) Any distribution amount withheld by the state comptroller

57	57	1 under subsection (c) shall revert to the state general fund.
58	58	2 (e) The prohibition under subsection (b) does not apply to the
59	59	3 following that are in use or under design:
60	60	4 (1) The Indianapolis Public Transportation Corporation's
61	61	5 "red line" rapid transit line running primarily north-south
62	62	6 between Broad Ripple and the University of Indianapolis.
63	63	7 (2) The Indianapolis Public Transportation Corporation's
64	64	8 "blue line" rapid transit line running primarily east-west
65	65	9 between Indianapolis International Airport and Cumberland.
66	66	10 (3) The Indianapolis Public Transportation Corporation's
67	67	11 "purple line" rapid transit line running primarily north-south
68	68	12 between downtown Indianapolis and the city of Lawrence.
69	69	13 (f) The prohibition under subsection (b) also does not apply to
70	70	14 a public works project that includes the construction or
71	71	15 improvement of:
72	72	16 (1) a stadium;
73	73	17 (2) a sports arena;
74	74	18 (3) a hotel;
75	75	19 (4) a convention center;
76	76	20 (5) an exhibition hall;
77	77	21 (6) an auditorium;
78	78	22 (7) a theater; or
79	79	23 (8) any other project, not solely undertaken for the purpose of
80	80	24 transportation, that would provide a significant and unique
81	81	25 benefit to the qualified city.
