77 Synopsis: Lane reductions on local roads and streets. Prohibits, in a
88 city with a population of at least 50,000, a governmental entity or

1111 the city as the result of the project. Provides that if a governmental
1212 entity or private contractor violates the prohibition, the state
1313 comptroller shall withhold 10% of the total amount of the distribution

1515 distributed to the city during the calendar year following the calendar
1616 year in which the travel lanes became restricted or reduced. Provides
1717 that any distribution amount withheld by the state comptroller reverts
1818 to the state general fund. Exempts existing rapid transit lines from, and
1919 lists other exceptions to, the prohibition.

3636 A BILL FOR AN ACT to amend the Indiana Code concerning
3737 transportation.
3838 Be it enacted by the General Assembly of the State of Indiana:
3939 1 SECTION 1. IC 8-14-1-5.5 IS ADDED TO THE INDIANA CODE
4040 2 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE
4141 3 UPON PASSAGE]: Sec. 5.5. (a) As used in this chapter, "qualified
4242 4 city" means a city with a population of at least fifty thousand
4343 5 (50,000).
4444 6 (b) A governmental entity or private contractor is prohibited
4545 7 from engaging in a project in a qualified city that would result in
4646 8 the permanent restriction or reduction of one (1) or more travel
4747 9 lanes within the qualified city as the result of the project.
4848 10 (c) If a governmental entity or private contractor violates the
4949 11 prohibition described in subsection (b), the state comptroller shall
5050 12 withhold ten percent (10%) of the total amount of the distribution
5151 13 from the local road and street account that would have otherwise
5252 14 been distributed to the qualified city during the calendar year
5353 15 following the calendar year in which the travel lanes became
5454 16 restricted or were reduced.
5555 17 (d) Any distribution amount withheld by the state comptroller

5757 1 under subsection (c) shall revert to the state general fund.
5858 2 (e) The prohibition under subsection (b) does not apply to the
5959 3 following that are in use or under design:
6060 4 (1) The Indianapolis Public Transportation Corporation's
6161 5 "red line" rapid transit line running primarily north-south
6262 6 between Broad Ripple and the University of Indianapolis.
6363 7 (2) The Indianapolis Public Transportation Corporation's
6464 8 "blue line" rapid transit line running primarily east-west
6565 9 between Indianapolis International Airport and Cumberland.
6666 10 (3) The Indianapolis Public Transportation Corporation's
6767 11 "purple line" rapid transit line running primarily north-south
6868 12 between downtown Indianapolis and the city of Lawrence.
6969 13 (f) The prohibition under subsection (b) also does not apply to
7070 14 a public works project that includes the construction or
7171 15 improvement of:
7272 16 (1) a stadium;
7373 17 (2) a sports arena;
7474 18 (3) a hotel;
7575 19 (4) a convention center;
7676 20 (5) an exhibition hall;
7777 21 (6) an auditorium;
7878 22 (7) a theater; or
7979 23 (8) any other project, not solely undertaken for the purpose of
8080 24 transportation, that would provide a significant and unique
8181 25 benefit to the qualified city.
8282 26 SECTION 2. An emergency is declared for this act.
