2626 A BILL FOR AN ACT to amend the Indiana Code concerning local
2727 government.
2828 Be it enacted by the General Assembly of the State of Indiana:
2929 1 SECTION 1. IC 36-7-4-1103, AS AMENDED BY P.L.154-2020,
3030 2 SECTION 46 AND P.L.164-2020, SECTION 65, IS AMENDED TO
3131 3 READ AS FOLLOWS [EFFECTIVE JULY 1, 2025]: Sec. 1103. (a)
3232 4 ADVISORY—AREA. For purposes of this section, urban areas
3333 5 include:
3434 6 (1) all lands and lots within the corporate boundaries of a
3535 7 municipality;
3636 8 (2) any other lands or lots used for residential purposes where
3737 9 there are at least eight (8) five (5) residences within any quarter
3838 10 mile square area; and
3939 11 (3) other lands or lots that have been or are planned for residential
4040 12 areas contiguous to the municipality.
4141 13 (b) ADVISORY—AREA. This chapter does not authorize an
4242 14 ordinance or action of a plan commission that would prevent, outside
4343 15 of urban areas, the complete use and alienation of any mineral
4444 16 resources or forests by the owner or alienee of them.
