34 | 32 | | 3 1, 2025]: Sec. 27. (a) This section applies to a state employee health |

38 | 36 | | 7 individual entitled to coverage under a state employee health plan. |

39 | 37 | | 8 (c) As used in this section, "dementia treatment or medication" |

40 | 38 | | 9 means treatment or medication approved by the federal Food and |
---|
41 | 39 | | 10 Drug Administration prior to July 1, 2025, that is prescribed by a |
---|
42 | 40 | | 11 physician to slow the progression of Alzheimer's disease or any |
---|
43 | 41 | | 12 other form of dementia. |

44 | 42 | | 13 (d) As used in this section, "physician" means an individual |
---|
45 | 43 | | 14 licensed to practice medicine under IC 25-22.5. |

46 | 44 | | 15 (e) As used in this section, "state employee health plan" means |
---|
47 | 45 | | 16 the following: |

48 | 46 | | 17 (1) A self-insurance program established under section 7(b) of |
---|
50 | 48 | | 1 this chapter. |

51 | 49 | | 2 (2) A contract for prepaid health care services entered into |

52 | 50 | | 3 under section 7(c) of this chapter. |

53 | 51 | | 4 (f) As used in this section, "step therapy protocol" has the |

54 | 52 | | 5 meaning set forth in section 17(e) of this chapter. |

55 | 53 | | 6 (g) A state employee health plan shall provide coverage for |
---|
56 | 54 | | 7 dementia treatments or medications that are determined to be |
---|
57 | 55 | | 8 medically necessary by the physician treating the covered |
---|
58 | 56 | | 9 individual. |

59 | 57 | | 10 (h) The coverage provided under subsection (g) shall not be |
---|
60 | 58 | | 11 subject to a step therapy protocol. |
