2927 A BILL FOR AN ACT to amend the Indiana Code concerning
3028 insurance.
3129 Be it enacted by the General Assembly of the State of Indiana:
3230 1 SECTION 1. IC 5-10-8-27 IS ADDED TO THE INDIANA CODE
3331 2 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
3432 3 1, 2025]: Sec. 27. (a) This section applies to a state employee health
3533 4 plan that is established, entered into, amended, or renewed after
3634 5 June 30, 2025.
3735 6 (b) As used in this section, "covered individual" means an
3836 7 individual entitled to coverage under a state employee health plan.
3937 8 (c) As used in this section, "dementia treatment or medication"
4038 9 means treatment or medication approved by the federal Food and
4139 10 Drug Administration prior to July 1, 2025, that is prescribed by a
4240 11 physician to slow the progression of Alzheimer's disease or any
4341 12 other form of dementia.
4442 13 (d) As used in this section, "physician" means an individual
4543 14 licensed to practice medicine under IC 25-22.5.
4644 15 (e) As used in this section, "state employee health plan" means
4745 16 the following:
4846 17 (1) A self-insurance program established under section 7(b) of

5149 2 (2) A contract for prepaid health care services entered into
5250 3 under section 7(c) of this chapter.
5351 4 (f) As used in this section, "step therapy protocol" has the
5452 5 meaning set forth in section 17(e) of this chapter.
5553 6 (g) A state employee health plan shall provide coverage for
5654 7 dementia treatments or medications that are determined to be
5755 8 medically necessary by the physician treating the covered
5856 9 individual.
5957 10 (h) The coverage provided under subsection (g) shall not be
6058 11 subject to a step therapy protocol.
