4034 A BILL FOR AN ACT to amend the Indiana Code concerning
4135 education.
4236 Be it enacted by the General Assembly of the State of Indiana:
4337 1 SECTION 1. IC 16-46-10-3, AS AMENDED BY P.L.164-2023,
4438 2 SECTION 47, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
4539 3 JULY 1, 2025]: Sec. 3. (a) Funding provided a local board of health
4640 4 under section 2.2 or 2.3 of this chapter may be used by the local board
4741 5 to provide any of the following services:
4842 6 (1) Core public health services.
4943 7 (2) Any statutorily required actions for a local health department.
5044 8 (3) Evidence based programs to prevent or reduce the prevalence
5145 9 of health issues or improve the health and behavioral health of
5246 10 Indiana residents as outlined in the plan described in
5347 11 IC 16-30-3-2.
54-12 (4) The provision of automated external defibrillators (AEDs)
55-13 to school corporations, charter schools, and state accredited
48+12 (4) Providing automated external defibrillators (AEDs) to
49+13 school corporations, charter schools, and state accredited
5650 14 nonpublic schools pursuant to each school corporation's,
5751 15 charter school's, and state accredited nonpublic school's

62-2 department under IC 20-34-8-4.5.
63-3 (b) Money granted a local board of health from the local public
64-4 health fund may not be used for any purpose other than for the services
65-5 listed in this section.
66-6 (c) A county may not use more than ten percent (10%) of the funds
67-7 received under section 2.2 or 2.3 of this chapter during a fiscal year for
68-8 capital expenditures, including:
69-9 (1) the purchase, construction, or renovation of buildings or other
70-10 structures;
71-11 (2) land acquisition; and
72-12 (3) the purchase of vehicles and other transportation equipment.
73-13 (d) Funds used for capital expenditures under subsection (c) must
74-14 be included on the annual financial report required under section 2.2(f)
75-15 or 2.3(c) of this chapter and posted on the local health department's
76-16 website.
77-17 (e) Before funds may be used to hire or contract for the provision or
78-18 administration of core public health services, the local health
79-19 department shall post the position or contract to the public for at least
80-20 thirty (30) days.
81-21 SECTION 2. IC 20-34-8-3.5, AS ADDED BY P.L.187-2023,
82-22 SECTION 1, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
83-23 JULY 1, 2025]: Sec. 3.5. As used in this chapter, "venue specific
84-24 emergency action plan for sudden cardiac arrest" means a plan
85-25 developed used by a school corporation, charter school, or state
86-26 accredited nonpublic school that
87-27 (1) includes detailed written instructions regarding how to
88-28 respond to sudden cardiac arrest; and
89-29 (2) indicates the location of the nearest automated external
90-30 defibrillator (AED) at the venue.
91-31 establishing steps to reduce death from cardiac arrest in any
92-32 setting.
93-33 SECTION 3. IC 20-34-8-4.5 IS ADDED TO THE INDIANA CODE
94-34 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
95-35 1, 2025]: Sec. 4.5. (a) For the 2025-2026 school year, the
96-36 department, in collaboration with a local health department
97-37 (established under IC 16-20) located within a district in which a
98-38 school corporation, charter school, or state accredited nonpublic
99-39 school is located, shall do the following:
100-40 (1) Develop a venue specific emergency action plan for sudden
101-41 cardiac arrest in collaboration with the school corporation,
102-42 charter school, or state accredited nonpublic school.

104-1 (2) Provide ongoing support to the school corporation, charter
105-2 school, or state accredited nonpublic school for the venue
106-3 specific emergency action plan for sudden cardiac arrest
107-4 described in subdivision (1), if support is requested by the
108-5 school.
109-6 (b) A venue specific emergency action plan for sudden cardiac
110-7 arrest developed under this section must include the following:
111-8 (1) A cardiac emergency response plan (CERP) that includes
112-9 the core elements set forth by either the American Heart
113-10 Association or other nationally recognized recommendations,
114-11 including recommendations set by the National Athletic
115-12 Trainers Association.
116-13 (2) A requirement that the CERP be widely distributed and
117-14 posted throughout the school, rehearsed frequently, and
118-15 updated annually.
119-16 (3) A requirement that automated external defibrillators
120-17 (AEDs) must be clearly marked and easily accessible at each
121-18 venue where an athletic activity may occur, or within one (1)
122-19 to three (3) minutes of where each athletic activity is held.
123-20 AEDs must be placed in accordance with guidelines set by the
124-21 American Heart Association, or other nationally recognized
125-22 guidelines focused on emergency cardiovascular care.
126-23 (4) A requirement that the governing authority of a school
127-24 corporation or the equivalent authority of a charter school or
128-25 state accredited nonpublic school work directly with local
129-26 providers of emergency medical services (as defined in
130-27 IC 16-18-2-110) to integrate the CERP into the community's
131-28 local provider protocols.
132-29 (5) A requirement that AEDs must be made available for use
133-30 by all individuals, regardless of an individual's training.
134-31 (6) A requirement that appropriate school staff and
135-32 volunteers are trained in first aid, cardiopulmonary
136-33 resuscitation, and AED use in a manner that follows evidence
137-34 based guidelines set forth by the American Heart Association,
138-35 or other nationally recognized guidelines focused on
139-36 emergency cardiovascular care.
140-37 (c) The principal of a school maintained by a school
141-38 corporation, charter school, or state accredited nonpublic school
142-39 shall manage the venue specific emergency action plan for sudden
143-40 cardiac arrest.
144-41 SECTION 4. [EFFECTIVE JULY 1, 2025] (a) The department of
145-42 education shall conduct a statewide survey of school corporations,

147-1 charter schools, and state accredited nonpublic schools to
148-2 determine:
149-3 (1) the number of automated external defibrillators (AEDs)
150-4 owned before July 1, 2025, by the schools;
151-5 (2) the location of each AED in the schools;
152-6 (3) whether, as of July 1, 2025, the schools have a venue
153-7 specific emergency action plan for sudden cardiac arrest (as
154-8 defined in IC 20-34-8-3.5, before its amendment by this act);
155-9 and
156-10 (4) the specific school events at which AEDs are present as of
157-11 July 1, 2025.
158-12 (b) Each school corporation, charter school, and state
159-13 accredited nonpublic school shall respond to the statewide survey
160-14 described in subsection (a) not later than July 31, 2025.
161-15 (c) The department of education shall compile the results of the
162-16 survey described in subsection (a) in a report. The department of
163-17 education shall:
164-18 (1) publish the report on the department's website; and
165-19 (2) submit the report to the legislative council in an electronic
166-20 format under IC 5-14-6;
167-21 not later than October 31, 2025.
168-22 (d) This SECTION expires January 1, 2027.

82+28 (2) indicates the location of the nearest automated external
83+29 defibrillator (AED) at the venue.

86+32 SECTION 3. IC 20-34-8-4.5 IS ADDED TO THE INDIANA CODE
87+33 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
88+34 1, 2025]: Sec. 4.5. (a) For the 2025-2026 school year, a local health
89+35 department (established under IC 16-20) located within a district
90+36 in which a school corporation, charter school, or state accredited
91+37 nonpublic school is located shall do the following:
92+38 (1) Develop a venue specific emergency action plan for sudden
93+39 cardiac arrest in collaboration with the school corporation,
94+40 charter school, or state accredited nonpublic school.
95+41 (2) Provide ongoing support to the school corporation, charter
96+42 school, or state accredited nonpublic school for the venue

99+2 described in subdivision (1), if support is requested by the
100+3 school.
101+4 (b) A venue specific emergency action plan for sudden cardiac
102+5 arrest developed under this section must include the following:
