SENATE BILL No. 479 A BILL FOR AN ACT to amend the Indiana Code concerning criminal law and procedure. Be it enacted by the General Assembly of the State of Indiana: 1 SECTION 1. IC 35-46-1-23 IS ADDED TO THE INDIANA CODE 2 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY 3 1, 2025]: Sec. 23. (a) This section does not apply to the following: 4 (1) The parent or guardian of an unemancipated child, if the 5 parent or guardian is authorized to make health care 6 decisions for the unemancipated child. 7 (2) A person who has the written consent of a person 8 described in subdivision (1). 9 (3) A person who assists an unemancipated child for the 10 purpose of obtaining a medical diagnosis. 11 (4) A common carrier (as defined in IC 8-2.1-17-4) that is 12 transporting passengers for hire in the course and scope of its 13 business. 14 (b) As used in this section, "assists" means to provide: 15 (1) lodging; 16 (2) shelter; 17 (3) transportation; or 2025 IN 479—LS 6575/DI 106 2 1 (4) money. 2 (c) As used in this section, "gender transition procedure" has 3 the meaning set forth in IC 25-1-22-5. 4 (d) A person at least eighteen (18) years of age who: 5 (1) with the intent to aid an unemancipated child in procuring 6 a gender transition procedure; and 7 (2) with the intent to conceal the gender transition procedure 8 from the child's parent or guardian; 9 assists the unemancipated child in connection with the procuring 10 of a gender transition procedure, commits unlawfully aiding a 11 child in procuring a gender transition procedure, a Level 6 felony. 12 (e) It is not a defense to a prosecution under this section that the 13 child consented to the gender transition procedure. 2025 IN 479—LS 6575/DI 106
