2626 A BILL FOR AN ACT to amend the Indiana Code concerning
2727 criminal law and procedure.
2828 Be it enacted by the General Assembly of the State of Indiana:
2929 1 SECTION 1. IC 35-46-1-23 IS ADDED TO THE INDIANA CODE
3030 2 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
3131 3 1, 2025]: Sec. 23. (a) This section does not apply to the following:
3232 4 (1) The parent or guardian of an unemancipated child, if the
3333 5 parent or guardian is authorized to make health care
3434 6 decisions for the unemancipated child.
3535 7 (2) A person who has the written consent of a person
3636 8 described in subdivision (1).
3737 9 (3) A person who assists an unemancipated child for the
3838 10 purpose of obtaining a medical diagnosis.
3939 11 (4) A common carrier (as defined in IC 8-2.1-17-4) that is
4040 12 transporting passengers for hire in the course and scope of its
4141 13 business.
4242 14 (b) As used in this section, "assists" means to provide:
4343 15 (1) lodging;
4444 16 (2) shelter;
4545 17 (3) transportation; or

4747 1 (4) money.
4848 2 (c) As used in this section, "gender transition procedure" has
4949 3 the meaning set forth in IC 25-1-22-5.
5050 4 (d) A person at least eighteen (18) years of age who:
5151 5 (1) with the intent to aid an unemancipated child in procuring
5252 6 a gender transition procedure; and
5353 7 (2) with the intent to conceal the gender transition procedure
5454 8 from the child's parent or guardian;
5555 9 assists the unemancipated child in connection with the procuring
5656 10 of a gender transition procedure, commits unlawfully aiding a
5757 11 child in procuring a gender transition procedure, a Level 6 felony.
5858 12 (e) It is not a defense to a prosecution under this section that the
5959 13 child consented to the gender transition procedure.
