29 | 29 | | 1 SECTION 1. IC 35-46-1-23 IS ADDED TO THE INDIANA CODE |

31 | 31 | | 3 1, 2025]: Sec. 23. (a) This section does not apply to the following: |
---|
32 | 32 | | 4 (1) The parent or guardian of an unemancipated child, if the |
---|
33 | 33 | | 5 parent or guardian is authorized to make health care |
---|
34 | 34 | | 6 decisions for the unemancipated child. |
---|
35 | 35 | | 7 (2) A person who has the written consent of a person |
---|
36 | 36 | | 8 described in subdivision (1). |
---|
37 | 37 | | 9 (3) A person who assists an unemancipated child for the |
---|
38 | 38 | | 10 purpose of obtaining a medical diagnosis. |
---|
39 | 39 | | 11 (4) A common carrier (as defined in IC 8-2.1-17-4) that is |

40 | 40 | | 12 transporting passengers for hire in the course and scope of its |

41 | 41 | | 13 business. |

42 | 42 | | 14 (b) As used in this section, "assists" means to provide: |

49 | 49 | | 3 the meaning set forth in IC 25-1-22-5. |

51 | 51 | | 5 (1) with the intent to aid an unemancipated child in procuring |

52 | 52 | | 6 a gender transition procedure; and |
---|
53 | 53 | | 7 (2) with the intent to conceal the gender transition procedure |
---|
54 | 54 | | 8 from the child's parent or guardian; |
---|
55 | 55 | | 9 assists the unemancipated child in connection with the procuring |
---|
56 | 56 | | 10 of a gender transition procedure, commits unlawfully aiding a |
---|
57 | 57 | | 11 child in procuring a gender transition procedure, a Level 6 felony. |
---|
58 | 58 | | 12 (e) It is not a defense to a prosecution under this section that the |
---|
59 | 59 | | 13 child consented to the gender transition procedure. |
