4636 A BILL FOR AN ACT to amend the Indiana Code concerning labor

4838 Be it enacted by the General Assembly of the State of Indiana:
4939 1 SECTION 1. IC 22-4-44 IS ADDED TO THE INDIANA CODE AS
5040 2 A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE JULY

5242 4 Chapter 44. Reemployment Skills Training Pilot Program
5343 5 Sec. 1. As used in this chapter, "eligible provider" has the
5444 6 meaning set forth in IC 22-4.1-20-1. The term includes, for
5545 7 purposes of this chapter, a training provider listed on the
5646 8 department's eligible training provider list on the department's
5747 9 website.
5848 10 Sec. 2. As used in this chapter, "pilot program" means the
5949 11 reemployment skills training pilot program established by the
6050 12 department under section 3 of this chapter.
6151 13 Sec. 3. The department may establish a reemployment skills
6252 14 training pilot program to supplement an individual's receipt of
6353 15 weekly unemployment benefits for each week of unemployment
6454 16 that the individual is:
6555 17 (1) eligible for unemployment benefits; and

6757 1 (2) making satisfactory weekly progress toward a training
6858 2 program approved under this chapter.
6959 3 Sec. 4. An individual is eligible to participate in the pilot
7060 4 program if the department determines that the individual is:
7161 5 (1) unlikely to find sustainable employment without further
7262 6 training;
7363 7 (2) eligible for unemployment compensation under this
7464 8 article; and
7565 9 (3) more likely to complete training with a weekly incentive.
7666 10 Sec. 5. The department may approve a training program under
7767 11 the pilot program that meets the following requirements:
7868 12 (1) The department determines that the training program is
7969 13 for a high wage and high demand occupation.
8070 14 (2) Completion of the training program results in an industry
8171 15 recognized credential or certification.
8272 16 (3) Completion of the training program substantially
8373 17 increases the likelihood of an individual being employed.
8474 18 (4) The training program is offered by an eligible provider.
8575 19 Sec. 6. (a) This section applies only if the department establishes
8676 20 the pilot program.
8777 21 (b) The pilot program may not be funded from the
8878 22 unemployment trust fund.
8979 23 (c) The reemployment skills training pilot program fund is
9080 24 established for the purpose of funding the pilot program.
9181 25 (d) The fund shall be administered by the department.
9282 26 (e) The expenses of administering the fund shall be paid from
9383 27 money in the fund.
9484 28 (f) The fund consists of the following:
9585 29 (1) Appropriations to the fund.
9686 30 (2) Federal grant funds.
9787 31 (3) Gifts or donations to the fund.
9888 32 (g) The treasurer of state shall invest the money in the fund not
9989 33 currently needed to meet the obligations of the fund in the same
10090 34 manner as other public money may be invested.
10191 35 (h) Money in the fund at the end of a state fiscal year does not
10292 36 revert to the state general fund.
