5	5	AN ACT concerning elections; relating to voter registration; requiring that
6	6	discharged inmates be offered the opportunity to register to vote; the
7	7	secretary of state to develop a voter registration program that offers
8	8	voter registration services through certain state agencies and at each
9	9	accredited high school; amending K.S.A. 25-2416 and K.S.A. 2022
10	10	Supp. 22-3722 and repealing the existing sections.
11	11	Be it enacted by the Legislature of the State of Kansas:
12	12	New Section 1. (a) The secretary of state shall develop a voter
13	13	registration program to offer voter registration services through the
14	14	following state agencies:
15	15	(1) The Kansas department for children and families;
16	16	(2) the Kansas department for aging and disability services; and
17	17	(3) the department of labor.
18	18	(b) At the time of making an application for assistance or benefits
19	19	with the Kansas department for children and families, the Kansas
20	20	department for aging and disability services or the department of labor, the
21	21	applicant shall be offered the opportunity to register to vote.
22	22	(c) If proof of citizenship was not required for the assistance or
23	23	benefits applied for, the applicant shall be informed that proof of
24	24	citizenship will be necessary to complete the process of registration to
25	25	vote.
26	26	(d) Voter registration applications shall be submitted to the secretary
27	27	of state and the county election officers as provided by rules and
28	28	regulations adopted by the secretary of state.
29	29	New Sec. 2. (a) The secretary of state, in cooperation with the state
30	30	board of education, shall develop a voter registration program to offer
31	31	voter registration services at each accredited high school. Students who are
32	32	17 years of age or older shall be offered the opportunity to register to vote.
33	33	(b) Voter registration applications shall be submitted to the secretary
34	34	of state and the county election officers as provided by rules and
35	35	regulations adopted by the secretary of state.
36	36	Sec. 3. K.S.A. 2022 Supp. 22-3722 is hereby amended to read as
37	37	follows: 22-3722. (a) (1) The period served on parole or conditional
38	38	release shall be deemed service of the term of confinement, and, subject to
39	39	the provisions contained in K.S.A. 75-5217, and amendments thereto,

76	76	relating to an inmate who is a fugitive from or has fled from justice, the
77	77	total time served may not exceed the maximum term or sentence.
78	78	(2) The period served on postrelease supervision shall vest in and be
79	79	subject to the provisions contained in K.S.A. 75-5217, and amendments
80	80	thereto, relating to an inmate who is a fugitive from or has fled from
81	81	justice.
82	82	(3) The total time served shall not exceed the postrelease supervision
83	83	period established at sentencing.
84	84	(b) When an inmate on parole or conditional release has performed
85	85	the obligations of the release for such time as shall satisfy the prisoner
86	86	review board that final release is not incompatible with the best interest of
87	87	society and the welfare of the individual, the board may make a final order
88	88	of discharge and issue a certificate of discharge to the inmate but no such
89	89	order of discharge shall be made in any case within a period of less than
90	90	one year after the date of release except where the sentence expires earlier
91	91	thereto.
92	92	(c) (1) When an inmate has reached the end of the postrelease
93	93	supervision period, the board shall issue a certificate of discharge to the
94	94	releasee.
95	95	(2) Such discharge, and the discharge of an inmate who has served
96	96	the inmate's term of imprisonment, shall have the effect of restoring all
97	97	civil rights lost by operation of law upon commitment, and the
98	98	certification of discharge shall so state.
99	99	(3) Nothing herein contained in this section shall be held to impair the
100	100	power of the governor to grant a pardon or commutation of sentence in any
101	101	case.
102	102	(d) At the time of discharge, the inmate shall be offered the
103	103	opportunity to register to vote. If proof of citizenship of the inmate is not
104	104	available, the inmate shall be informed that proof of citizenship shall be
105	105	required to complete the voter registration application.
106	106	Sec. 4. K.S.A. 25-2416 is hereby amended to read as follows: 25-
107	107	2416. (a) Voting without being qualified is knowingly voting or attempting
108	108	to vote without being qualified:
109	109	(1) In any election district when not a lawfully registered voter in
110	110	such election district; or
111	111	(2) at any election by a person who is not a citizen of the United
112	112	States or who does not otherwise meet the qualifications of an elector.
113	113	(b) Voting without being qualified or attempting to vote without being
114	114	qualified is a severity level 7, nonperson felony.
115	115	(c) This section shall not apply to any person who is ineligible to
116	116	vote, but who registers to vote under section 1, and amendments thereto,
117	117	without willfully making any misrepresentations as to such person's
118	118	eligibility to vote.

162	162	(d) The provisions of K.S.A. 2022 Supp. 21-5301(c), and
163	163	amendments thereto, shall not apply to a violation of attempting to vote
164	164	without being qualified pursuant to this section.
165	165	Sec. 5. K.S.A. 25-2416 and K.S.A. 2022 Supp. 22-3722 are hereby
166	166	repealed.
167	167	Sec. 6. This act shall take effect and be in force from and after its
168	168	publication in the statute book.
