55 AN ACT concerning elections; relating to voter registration; requiring that
66 discharged inmates be offered the opportunity to register to vote; the
77 secretary of state to develop a voter registration program that offers
88 voter registration services through certain state agencies and at each
99 accredited high school; amending K.S.A. 25-2416 and K.S.A. 2022
1010 Supp. 22-3722 and repealing the existing sections.
1111 Be it enacted by the Legislature of the State of Kansas:
1212 New Section 1. (a) The secretary of state shall develop a voter
1313 registration program to offer voter registration services through the
1414 following state agencies:
1515 (1) The Kansas department for children and families;
1616 (2) the Kansas department for aging and disability services; and
1717 (3) the department of labor.
1818 (b) At the time of making an application for assistance or benefits
1919 with the Kansas department for children and families, the Kansas
2020 department for aging and disability services or the department of labor, the
2121 applicant shall be offered the opportunity to register to vote.
2222 (c) If proof of citizenship was not required for the assistance or
2323 benefits applied for, the applicant shall be informed that proof of
2424 citizenship will be necessary to complete the process of registration to
2525 vote.
2626 (d) Voter registration applications shall be submitted to the secretary
2727 of state and the county election officers as provided by rules and
2828 regulations adopted by the secretary of state.
2929 New Sec. 2. (a) The secretary of state, in cooperation with the state
3030 board of education, shall develop a voter registration program to offer
3131 voter registration services at each accredited high school. Students who are
3232 17 years of age or older shall be offered the opportunity to register to vote.
3333 (b) Voter registration applications shall be submitted to the secretary
3434 of state and the county election officers as provided by rules and
3535 regulations adopted by the secretary of state.
3636 Sec. 3. K.S.A. 2022 Supp. 22-3722 is hereby amended to read as
3737 follows: 22-3722. (a) (1) The period served on parole or conditional
3838 release shall be deemed service of the term of confinement, and, subject to
3939 the provisions contained in K.S.A. 75-5217, and amendments thereto,

7676 relating to an inmate who is a fugitive from or has fled from justice, the
7777 total time served may not exceed the maximum term or sentence.
7878 (2) The period served on postrelease supervision shall vest in and be
7979 subject to the provisions contained in K.S.A. 75-5217, and amendments
8080 thereto, relating to an inmate who is a fugitive from or has fled from
8181 justice.
8282 (3) The total time served shall not exceed the postrelease supervision
8383 period established at sentencing.
8484 (b) When an inmate on parole or conditional release has performed
8585 the obligations of the release for such time as shall satisfy the prisoner
8686 review board that final release is not incompatible with the best interest of
8787 society and the welfare of the individual, the board may make a final order
8888 of discharge and issue a certificate of discharge to the inmate but no such
8989 order of discharge shall be made in any case within a period of less than
9090 one year after the date of release except where the sentence expires earlier
9191 thereto.
9292 (c) (1) When an inmate has reached the end of the postrelease
9393 supervision period, the board shall issue a certificate of discharge to the
9494 releasee.
9595 (2) Such discharge, and the discharge of an inmate who has served
9696 the inmate's term of imprisonment, shall have the effect of restoring all
9797 civil rights lost by operation of law upon commitment, and the
9898 certification of discharge shall so state.
9999 (3) Nothing herein contained in this section shall be held to impair the
100100 power of the governor to grant a pardon or commutation of sentence in any
101101 case.
102102 (d) At the time of discharge, the inmate shall be offered the
103103 opportunity to register to vote. If proof of citizenship of the inmate is not
104104 available, the inmate shall be informed that proof of citizenship shall be
105105 required to complete the voter registration application.
106106 Sec. 4. K.S.A. 25-2416 is hereby amended to read as follows: 25-
107107 2416. (a) Voting without being qualified is knowingly voting or attempting
108108 to vote without being qualified:
109109 (1) In any election district when not a lawfully registered voter in
110110 such election district; or
111111 (2) at any election by a person who is not a citizen of the United
112112 States or who does not otherwise meet the qualifications of an elector.
113113 (b) Voting without being qualified or attempting to vote without being
114114 qualified is a severity level 7, nonperson felony.
115115 (c) This section shall not apply to any person who is ineligible to
116116 vote, but who registers to vote under section 1, and amendments thereto,
117117 without willfully making any misrepresentations as to such person's
118118 eligibility to vote.

162162 (d) The provisions of K.S.A. 2022 Supp. 21-5301(c), and
163163 amendments thereto, shall not apply to a violation of attempting to vote
164164 without being qualified pursuant to this section.
165165 Sec. 5. K.S.A. 25-2416 and K.S.A. 2022 Supp. 22-3722 are hereby
166166 repealed.
167167 Sec. 6. This act shall take effect and be in force from and after its
168168 publication in the statute book.
