55 AN ACT concerning retirement and pensions; relating to the Kansas
66 deferred retirement option program act; expanding such program
77 membership to all members of the Kansas police and firemen's
88 retirement system; amending K.S.A. 2022 Supp. 74-4986l and 74-
99 4986p and repealing the existing sections.
1010 Be it enacted by the Legislature of the State of Kansas:
1111 Section 1. K.S.A. 2022 Supp. 74-4986l is hereby amended to read as
1212 follows: 74-4986l. (a) As used in this act, unless otherwise provided or the
1313 context otherwise requires:
1414 (1) "Act" means the Kansas deferred retirement option program act;
1515 (2) "board" means the board of trustees of the Kansas public
1616 employees retirement system;
1717 (3) "DROP" means the deferred retirement option program
1818 established by K.S.A. 74-4986m, and amendments thereto;
1919 (4) "DROP account" means the notional account to which is credited
2020 the monthly DROP accrual;
2121 (5) "DROP period" means the period of time that a member elects to
2222 participate in the DROP pursuant to K.S.A. 74-4986n, and amendments
2323 thereto;
2424 (6) "member" means a trooper, examiner or officer of the Kansas
2525 highway patrol or an agent of the Kansas bureau of investigation any
2626 member of the Kansas police and firemen's retirement system who is
2727 eligible to participate in the DROP and who elects to participate in the
2828 DROP as provided in this act;
2929 (7) "monthly DROP accrual" means the amount equal to the monthly
3030 retirement benefit that would have been payable to the member had the
3131 member terminated service and retired on the day the member elected; and
3232 (8) "system" means the Kansas police and firemen's retirement
3333 system.
3434 (b) Unless specifically provided in this section or in this act, words
3535 and phrases used in this act mean the same as provided under the
3636 provisions of K.S.A. 74-4901 et seq. and 74-4951 et seq., and amendments
3737 thereto.
3838 Sec. 2. K.S.A. 2022 Supp. 74-4986p is hereby amended to read as
3939 follows: 74-4986p. (a) A member's participation in the DROP ceases on

7676 the occurrence of the earliest of the following:
7777 (1) Termination of the member's active service with the Kansas
7878 highway patrol or Kansas bureau of investigation a participating employer
7979 of the system;
8080 (2) the last day of the member's elected DROP period that begins on
8181 the effective date of the member's election to participate in the DROP;
8282 (3) retirement due to disability as defined in K.S.A. 74-4952, and
8383 amendments thereto; or
8484 (4) the member's death.
8585 (b) If a member dies before taking a distribution from such member's
8686 DROP account, the member's designated beneficiary shall receive a lump-
8787 sum payment equal to the member's DROP account balance, including any
8888 lump sum credited as provided in K.S.A. 74-4986o(d), and amendments
8989 thereto. If the DROP member has not named a beneficiary for such
9090 member's DROP account, the amount in the DROP account shall be paid
9191 to the beneficiary of the member's retirement benefit.
9292 Sec. 3. K.S.A. 2022 Supp. 74-4986l and 74-4986p are hereby
9393 repealed.
9494 Sec. 4. This act shall take effect and be in force from and after its
9595 publication in the statute book.
