| 5 | 5 | | AN ACT concerning retirement and pensions; relating to the Kansas public |
|---|
| 6 | 6 | | employees retirement system and systems thereunder; providing a cost- |
|---|
| 7 | 7 | | of-living adjustment for certain retirants. |
|---|
| 8 | 8 | | Be it enacted by the Legislature of the State of Kansas: |
|---|
| 9 | 9 | | Section 1. (a) The retirement benefit, pension or annuity payments |
|---|
| 10 | 10 | | accruing after June 30, 2023, to each retirant shall be increased by a cost- |
|---|
| 11 | 11 | | of-living adjustment in an amount as provided in subsection (b). Such |
|---|
| 12 | 12 | | payments shall be paid by the retirement system to the retirant. |
|---|
| 13 | 13 | | (b) (1) Except as provided in paragraph (2), each retirant who is |
|---|
| 14 | 14 | | entitled to receive a retirement benefit, pension or annuity payment from |
|---|
| 15 | 15 | | the retirement system on July 1, 2023, shall have such retirement benefit, |
|---|
| 16 | 16 | | pension or annuity increased in accordance with the following schedule. |
|---|
| 17 | 17 | | For those retirants whose date of retirement is: |
|---|
| 18 | 18 | | (A) On or before July 1, 2018, such benefit, pension or annuity |
|---|
| 19 | 19 | | payment shall be increased 1% of the retirement benefit, pension or |
|---|
| 20 | 20 | | annuity payment in effect on July 1, 2023; |
|---|
| 21 | 21 | | (B) on or before July 1, 2015, such benefit, pension or annuity |
|---|
| 22 | 22 | | payment shall be increased 2% of the retirement benefit, pension or |
|---|
| 23 | 23 | | annuity payment in effect on July 1, 2023; |
|---|
| 24 | 24 | | (C) on or before July 1, 2012, such benefit, pension or annuity |
|---|
| 25 | 25 | | payment shall be increased 3% of the retirement benefit, pension or |
|---|
| 26 | 26 | | annuity payment in effect on July 1, 2023; |
|---|
| 27 | 27 | | (D) on or before July 1, 2009, such benefit, pension or annuity |
|---|
| 28 | 28 | | payment shall be increased 4% of the retirement benefit, pension or |
|---|
| 29 | 29 | | annuity payment in effect on July 1, 2023; and |
|---|
| 30 | 30 | | (E) on or before July 1, 2006, such benefit, pension or annuity |
|---|
| 31 | 31 | | payment shall be increased 5% of the retirement benefit, pension or |
|---|
| 32 | 32 | | annuity payment in effect on July 1, 2023. |
|---|
| 33 | 33 | | (2) In no event shall the increase in the monthly benefit amount |
|---|
| 34 | 34 | | provided by this section exceed $200. |
|---|
| 35 | 35 | | (c) As used in this section: |
|---|
| 36 | 36 | | (1) "Insured disability benefit recipient" means any person receiving |
|---|
| 37 | 37 | | an insured disability benefit under K.S.A. 74-4927, and amendments |
|---|
| 38 | 38 | | thereto; |
|---|
| 39 | 39 | | (2) "retirement system" means the Kansas public employees |
|---|

| 76 | 76 | | retirement system, the Kansas police and firemen's retirement system, the |
|---|
| 77 | 77 | | state school retirement system and the retirement system for judges; and |
|---|
| 78 | 78 | | (3) "retirant" means any: |
|---|
| 79 | 79 | | (A) Person who is a member or special member of the retirement |
|---|
| 80 | 80 | | system pursuant to the provisions of K.S.A. 74-4901 et seq., and |
|---|
| 81 | 81 | | amendments thereto, and who retired on or before July 1, 2018; |
|---|
| 82 | 82 | | (B) person who is a joint annuitant or beneficiary of any member |
|---|
| 83 | 83 | | described in subparagraph (A); and |
|---|
| 84 | 84 | | (C) insured disability benefit recipient. |
|---|
| 85 | 85 | | Sec. 2. This act shall take effect and be in force from and after its |
|---|
| 86 | 86 | | publication in the statute book. |
