55 AN ACT concerning elections; relating to precinct committeemen and
66 committeewomen; requiring such elected officials to report certain
77 contact information to the county election officer; requiring the county
88 election officer to report such contact information to the secretary of
99 state; amending K.S.A. 25-3801 and repealing the existing section.
1010 Be it enacted by the Legislature of the State of Kansas:
1111 Section 1. K.S.A. 25-3801 is hereby amended to read as follows: 25-
1212 3801. (a) At each primary election, the members of the party residing in
1313 each precinct in each county of the state shall elect a man of their number
1414 as precinct committeeman and a woman of their number as precinct
1515 committeewoman. No person shall be eligible to be a candidate for or hold
1616 the office of precinct committeeman or precinct committeewoman of a
1717 party in any precinct unless such the person actually lives, resides and
1818 occupies a place of abode in such the precinct, and is in all other respects a
1919 qualified elector and is shown as a member of such the party on the party
2020 affiliation list, in the office of the county election officer.
2121 (b) Except as provided in subsection (b) (c), any vacancy occurring in
2222 the office of precinct committeeman or committeewoman shall be
2323 promptly filled by appointment by the county chairperson, except that.
2424 Any vacancy which that occurs because the party had no candidate at such
2525 the primary election shall not be filled until the county central committee
2626 has elected or reelected its chairperson. Not later than three days after
2727 appointment of precinct committeemen and committeewomen, the county
2828 chairperson making the appointments shall notify the county election
2929 officer of such the appointments and include the name, address, email
3030 address, if available, and a phone number or phone numbers, including a
3131 mobile phone number, if available, of each appointee in such notification.
3232 The county election officer shall make such the appointments public
3333 immediately upon receipt thereof. As used in this act, "primary election"
3434 means the statewide election held in August of even-numbered years.
3535 (b)(c) (1) When a convention is to be held under article 39 of chapter
3636 25 of Kansas Statutes Annotated, and amendments thereto, to fill a
3737 vacancy, no appointments shall be made under subsection (a):
3838 (1)(A) After the county chairperson has received notice from the
3939 county election officer of a vacancy or a pending vacancy in a county

7676 elected office; or
7777 (2)(B) after the county chairperson in each county, all or a part of
7878 which, is located within a legislative district, has received notice from the
7979 secretary of state of a vacancy or a pending vacancy in a legislative office.
8080 (2) After the vacancy has been filled by a person elected at a
8181 convention held under article 39 of chapter 25 of the Kansas Statutes
8282 Annotated, and amendments thereto, any vacancy in the office of precinct
8383 committeeman or committeewoman shall be filled as provided by
8484 subsection (a).
8585 (d) If a precinct committeeman or committeewoman is elected as a
8686 write-in candidate, the county clerk shall request from the appropriate
8787 county chairperson the name, address, email address, if available, and a
8888 phone number or phone numbers, including a mobile phone number, if
8989 available, of such elected precinct committeeman or committeewoman.
9090 (e) Each precinct committeeman and committeewoman shall report
9191 any changes in such person's name, address, email address and phone
9292 numbers to the county election officer not later than 10 days after such
9393 change.
9494 (f) The county election officer shall send to the secretary of state
9595 within seven days of each primary election in even-numbered years a list
9696 of each person that holds the office of precinct committeeman or
9797 committeewoman along with the name, address, phone number and email
9898 address, if available, of each such person. The county officer shall report
9999 all updates of such information at the time such updates are received to
100100 the secretary of state. The secretary of state shall keep an updated list of
101101 all precinct committeepersons, including their names, addresses, phone
102102 numbers and their email addresses, if available.
103103 (g) As used in this section, "primary election" means the election held
104104 on the first Tuesday in August of even-numbered years.
105105 Sec. 2. K.S.A. 25-3801 is hereby repealed.
106106 Sec. 3. This act shall take effect and be in force from and after its
107107 publication in the statute book.
