5	5	AN ACT concerning elections; relating to precinct committeemen and
6	6	committeewomen; requiring such elected officials to report certain
7	7	contact information to the county election officer; requiring the county
8	8	election officer to report such contact information to the secretary of
9	9	state; amending K.S.A. 25-3801 and repealing the existing section.
10	10	Be it enacted by the Legislature of the State of Kansas:
11	11	Section 1. K.S.A. 25-3801 is hereby amended to read as follows: 25-
12	12	3801. (a) At each primary election, the members of the party residing in
13	13	each precinct in each county of the state shall elect a man of their number
14	14	as precinct committeeman and a woman of their number as precinct
15	15	committeewoman. No person shall be eligible to be a candidate for or hold
16	16	the office of precinct committeeman or precinct committeewoman of a
17	17	party in any precinct unless such the person actually lives, resides and
18	18	occupies a place of abode in such the precinct, and is in all other respects a
19	19	qualified elector and is shown as a member of such the party on the party
20	20	affiliation list, in the office of the county election officer.
21	21	(b) Except as provided in subsection (b) (c), any vacancy occurring in
22	22	the office of precinct committeeman or committeewoman shall be
23	23	promptly filled by appointment by the county chairperson, except that.
24	24	Any vacancy which that occurs because the party had no candidate at such
25	25	the primary election shall not be filled until the county central committee
26	26	has elected or reelected its chairperson. Not later than three days after
27	27	appointment of precinct committeemen and committeewomen, the county
28	28	chairperson making the appointments shall notify the county election
29	29	officer of such the appointments and include the name, address, email
30	30	address, if available, and a phone number or phone numbers, including a
31	31	mobile phone number, if available, of each appointee in such notification.
32	32	The county election officer shall make such the appointments public
33	33	immediately upon receipt thereof. As used in this act, "primary election"
34	34	means the statewide election held in August of even-numbered years.
35	35	(b)(c) (1) When a convention is to be held under article 39 of chapter
36	36	25 of Kansas Statutes Annotated, and amendments thereto, to fill a
37	37	vacancy, no appointments shall be made under subsection (a):
38	38	(1)(A) After the county chairperson has received notice from the
39	39	county election officer of a vacancy or a pending vacancy in a county

77	77	(2)(B) after the county chairperson in each county, all or a part of
78	78	which, is located within a legislative district, has received notice from the
79	79	secretary of state of a vacancy or a pending vacancy in a legislative office.
80	80	(2) After the vacancy has been filled by a person elected at a
81	81	convention held under article 39 of chapter 25 of the Kansas Statutes
82	82	Annotated, and amendments thereto, any vacancy in the office of precinct
83	83	committeeman or committeewoman shall be filled as provided by
84	84	subsection (a).
85	85	(d) If a precinct committeeman or committeewoman is elected as a
86	86	write-in candidate, the county clerk shall request from the appropriate
87	87	county chairperson the name, address, email address, if available, and a
88	88	phone number or phone numbers, including a mobile phone number, if
89	89	available, of such elected precinct committeeman or committeewoman.
90	90	(e) Each precinct committeeman and committeewoman shall report
91	91	any changes in such person's name, address, email address and phone
92	92	numbers to the county election officer not later than 10 days after such
93	93	change.
94	94	(f) The county election officer shall send to the secretary of state
95	95	within seven days of each primary election in even-numbered years a list
96	96	of each person that holds the office of precinct committeeman or
97	97	committeewoman along with the name, address, phone number and email
98	98	address, if available, of each such person. The county officer shall report
99	99	all updates of such information at the time such updates are received to
100	100	the secretary of state. The secretary of state shall keep an updated list of
101	101	all precinct committeepersons, including their names, addresses, phone
102	102	numbers and their email addresses, if available.
103	103	(g) As used in this section, "primary election" means the election held
104	104	on the first Tuesday in August of even-numbered years.
105	105	Sec. 2. K.S.A. 25-3801 is hereby repealed.
106	106	Sec. 3. This act shall take effect and be in force from and after its
107	107	publication in the statute book.
