66 AN ACT concerning campaign finance; prohibiting the use of
77 cryptocurrency; deleting the prohibition against the use of campaign
88 funds for a candidate for federal office; amending K.S.A. 25-4153 and
99 repealing the existing section.
1010 Be it enacted by the Legislature of the State of Kansas:
1111 Section 1. K.S.A. 25-4153 is hereby amended to read as follows: 25-
1212 4153. (a) The aggregate amount contributed to a candidate and such
1313 candidate's candidate committee and to all party committees and political
1414 committees and dedicated to such candidate's campaign, by any political
1515 committee or any person except a party committee, the candidate or the
1616 candidate's spouse, shall not exceed the following:
1717 (1) For the pair of offices of governor and lieutenant governor or for
1818 other state officers elected from the state as a whole, $2,000 for each
1919 primary election (or in lieu thereof a caucus or convention of a political
2020 party) and an equal amount for each general election.
2121 (2) For the office of member of the house of representatives, district
2222 judge, district magistrate judge, district attorney or a candidate for local
2323 office, $500 for each primary election (or in lieu thereof a caucus or
2424 convention of a political party) and an equal amount for each general
2525 election.
2626 (3) For the office of state senator or member of the state board of
2727 education, $1,000 for each primary election (or in lieu thereof a caucus or
2828 convention of a political party) and an equal amount for each general
2929 election.
3030 (b) For the purposes of this section, the face value of a loan at the end
3131 of the period of time allocable to the primary or general election is the
3232 amount subject to the limitations of this section. A loan in excess of the
3333 limits herein provided may be made during the allocable period if such
3434 loan is reduced to the permissible level, when combined with all other
3535 contributions from the person making such loan, at the end of such
3636 allocable period.
3737 (c) For the purposes of this section, all contributions made by
3838 unemancipated children under 18 years of age shall be considered to be
3939 contributions made by the parent or parents of such children. The total

7575 amount of such contribution shall be attributed to a single custodial parent
7676 and 50% of such contribution to each of two parents.
7777 (d) The aggregate amount contributed to a state party committee by a
7878 person other than a national party committee or a political committee shall
7979 not exceed $15,000 in each calendar year; and the aggregate amount
8080 contributed to any other party committee by a person other than a national
8181 party committee or a political committee shall not exceed $5,000 in each
8282 calendar year.
8383 The aggregate amount contributed by a national party committee to a
8484 state party committee shall not exceed $25,000 in any calendar year, and
8585 the aggregate amount contributed to any other party committee by a
8686 national party committee shall not exceed $10,000 in any calendar year.
8787 The aggregate amount contributed to a party committee by a political
8888 committee shall not exceed $5,000 in any calendar year.
8989 (e) Any political funds which have been collected and were not
9090 subject to the reporting requirements of this act shall be deemed a person
9191 subject to these contribution limitations.
9292 (f) Any political funds which have been collected and were subject to
9393 the reporting requirements of the campaign finance act shall not be used in
9494 or for the campaign of a candidate for a federal elective office.
9595 (g) The amount contributed by each individual party committee of the
9696 same political party other than a national party committee to any candidate
9797 for office, for any primary election at which two or more candidates are
9898 seeking the nomination of such party shall not exceed the following:
9999 (1) For the pair of offices of governor and lieutenant governor and for
100100 each of the other state officers elected from the state as a whole, $2,000 for
101101 each primary election (or in lieu thereof a caucus or convention of a
102102 political party).
103103 (2) For the office of member of the house of representatives, district
104104 judge, district magistrate judge, district attorney or a candidate for local
105105 office, $500 for each primary election (or in lieu thereof a caucus or
106106 convention of a political party).
107107 (3) For the office of state senator or member of the state board of
108108 education, $1,000 for each primary election (or in lieu thereof a caucus or
109109 convention of a political party).
110110 (h)(g) When a candidate for a specific cycle does not run for office,
111111 the contribution limitations of this section shall apply as though the
112112 individual had sought office.
113113 (i)(h) No person shall make any contribution or contributions to any
114114 candidate or the candidate committee of any candidate in the form of
115115 money or currency of the United States which in the aggregate exceeds
116116 $100 for any one primary or general election, and no candidate or
117117 candidate committee of any candidate shall accept any contribution or

161161 contributions in the form of money or currency of the United States which
162162 in the aggregate exceeds $100 from any one person for any one primary or
163163 general election.
164164 (i) (1) No person shall make or accept any cryptocurrency
165165 contribution for any candidate or candidate committee.
166166 (2) No person shall make or accept any cryptocurrency contribution
167167 for any political committee or party committee.
168168 Sec. 2. K.S.A. 25-4153 is hereby repealed.
169169 Sec. 3. This act shall take effect and be in force from and after its
170170 publication in the statute book.
