12 HOUSE BILL No. 2547
2-AN ACT concerning health and healthcare; relating to the regulation of certain drugs;
3-authorizing a school to maintain a stock supply of emergency medication kits for
4-certain life-threatening conditions; requiring a prescription for distribution of
5-emergency medication to schools; providing requirements for the administration of
6-emergency medication by school personnel, training; exempting certain persons from
7-the practice of healing arts and civil liability if acting in good faith; adding and
8-removing certain substances in schedules I, II, IV and V of the uniform controlled
9-substances act; making conforming changes to the criminal code definition of
10-fentanyl-related controlled substances; amending K.S.A. 21-5701, 65-1680, 65-
11-2872b and 72-6283 and K.S.A. 2023 Supp. 65-4105, 65-4107, 65-4111 and 65-4113
12-and repealing the existing sections.

7+AN ACT concerning schools; relating to student health; authorizing the

10+medication to schools; providing requirements for the administration of
11+emergency medication by school personnel, training; exempting certain
12+persons from the practice of healing arts and civil liability if acting in
13+good faith; amending K.S.A. 65-1680, 65-2872b and 72-6283 and
14+repealing the existing sections.
1315 Be it enacted by the Legislature of the State of Kansas:
14-Section 1. K.S.A. 21-5701 is hereby amended to read as follows:
15-21-5701. As used in K.S.A. 21-5701 through 21-5717, and amendments
16-thereto:
17-(a) "Controlled substance" means any drug, substance or
18-immediate precursor included in any of the schedules designated in
19-K.S.A. 65-4105, 65-4107, 65-4109, 65-4111 and 65-4113, and
20-amendments thereto.
21-(b) (1) "Controlled substance analog" means a substance that is
22-intended for human consumption, and at least one of the following:
23-(A) The chemical structure of the substance is substantially similar
24-to the chemical structure of a controlled substance listed in or added to
25-the schedules designated in K.S.A. 65-4105 or 65-4107, and
26-amendments thereto;
27-(B) the substance has a stimulant, depressant or hallucinogenic
28-effect on the central nervous system substantially similar to the
29-stimulant, depressant or hallucinogenic effect on the central nervous
30-system of a controlled substance included in the schedules designated
31-in K.S.A. 65-4105 or 65-4107, and amendments thereto; or
32-(C) with respect to a particular individual, such individual
33-represents or intends the substance to have a stimulant, depressant or
34-hallucinogenic effect on the central nervous system substantially
35-similar to the stimulant, depressant or hallucinogenic effect on the
36-central nervous system of a controlled substance included in the
37-schedules designated in K.S.A. 65-4105 or 65-4107, and amendments
38-thereto.
39-(2) "Controlled substance analog" does not include:
40-(A) A controlled substance;
41-(B) a substance for which there is an approved new drug
42-application; or
43-(C) a substance with respect to which an exemption is in effect for
44-investigational use by a particular person under section 505 of the
45-federal food, drug, and cosmetic act, 21 U.S.C. § 355, to the extent
46-conduct with respect to the substance is permitted by the exemption.
47-(c) "Cultivate" means the planting or promotion of growth of five
48-or more plants that contain or can produce controlled substances.
49-(d) "Distribute" means the actual, constructive or attempted
50-transfer from one person to another of some item whether or not there
51-is an agency relationship. "Distribute" includes, but is not limited to,
52-sale, offer for sale or any act that causes some item to be transferred
53-from one person to another. "Distribute" does not include acts of
54-administering, dispensing or prescribing a controlled substance as
55-authorized by the pharmacy act of the state of Kansas, the uniform
56-controlled substances act or otherwise authorized by law.
57-(e) (1) "Drug" means:
58-(A) Substances recognized as drugs in the official United States
59-pharmacopeia, official homeopathic pharmacopoeia of the United
60-States or official national formulary or any supplement to any of them;
61-(B) substances intended for use in the diagnosis, cure, mitigation,
62-treatment or prevention of disease in humans or animals;
63-(C) substances, other than food, intended to affect the structure or
64-any function of the body of humans or animals; and
65-(D) substances intended for use as a component of any article
66-specified in subparagraph (A), (B) or (C). HOUSE BILL No. 2547—page 2
67-(2) "Drug" does not include devices or their components, parts or
68-accessories.
69-(f) (1) "Drug paraphernalia" means all equipment and materials of
70-any kind that are used, or primarily intended or designed for use in
71-planting, propagating, cultivating, growing, harvesting, manufacturing,
72-compounding, converting, producing, processing, preparing, testing,
73-analyzing, packaging, repackaging, storing, containing, concealing,
74-injecting, ingesting, inhaling or otherwise introducing into the human
75-body a controlled substance and in violation of this act.
76-(2) "Drug paraphernalia" includes, but is not limited to:
77-(A) Kits used or intended for use in planting, propagating,
78-cultivating, growing or harvesting any species of plant that is a
79-controlled substance or from which a controlled substance can be
80-derived;
81-(B) kits used or intended for use in manufacturing, compounding,
82-converting, producing, processing or preparing controlled substances;
83-(C) isomerization devices used or intended for use in increasing
84-the potency of any species of plant that is a controlled substance;
85-(D) testing equipment used or intended for use in identifying or in
86-analyzing the strength, effectiveness or purity of controlled substances;
87-(E) scales and balances used or intended for use in weighing or
88-measuring controlled substances;
89-(F) diluents and adulterants, including, but not limited to, quinine
90-hydrochloride, mannitol, mannite, dextrose and lactose that are used or
91-intended for use in cutting controlled substances;
92-(G) separation gins and sifters used or intended for use in
93-removing twigs and seeds from or otherwise cleaning or refining
94-marijuana;
95-(H) blenders, bowls, containers, spoons and mixing devices used
96-or intended for use in compounding controlled substances;
97-(I) capsules, balloons, envelopes, bags and other containers used
98-or intended for use in packaging small quantities of controlled
99-substances;
100-(J) containers and other objects used or intended for use in storing
101-or concealing controlled substances;
102-(K) hypodermic syringes, needles and other objects used or
103-intended for use in parenterally injecting controlled substances into the
104-human body;
105-(L) objects used or primarily intended or designed for use in
106-ingesting, inhaling or otherwise introducing marijuana, cocaine,
107-hashish, hashish oil, phencyclidine (PCP), methamphetamine or
108-amphetamine into the human body, such as:
109-(i) Metal, wooden, acrylic, glass, stone, plastic or ceramic pipes
110-with or without screens, permanent screens, hashish heads or punctured
111-metal bowls;
112-(ii) water pipes, bongs or smoking pipes designed to draw smoke
113-through water or another cooling device;
114-(iii) carburetion pipes, glass or other heat-resistant tubes or any
115-other device used, intended to be used or designed to be used to cause
116-vaporization of a controlled substance for inhalation;
117-(iv) smoking and carburetion masks;
118-(v) roach clips, objects used to hold burning material, such as a
119-marijuana cigarette, that has become too small or too short to be held in
120-the hand;
121-(vi) miniature cocaine spoons and cocaine vials;
122-(vii) chamber smoking pipes;
123-(viii) carburetor smoking pipes;
124-(ix) electric smoking pipes;
125-(x) air-driven smoking pipes; HOUSE BILL No. 2547—page 3
126-(xi) chillums;
127-(xii) bongs;
128-(xiii) ice pipes or chillers;
129-(xiv) any smoking pipe manufactured to disguise its intended
130-purpose;
131-(xv) wired cigarette papers; or
132-(xvi) cocaine freebase kits.
133-(3) "Drug paraphernalia" does not include:
134-(A) Any products, chemicals or materials described in K.S.A. 21-
135-5709(a), and amendments thereto; or
136-(B) any materials used or intended for use to test a substance for
137-the presence of fentanyl, a fentanyl analog, ketamine or gamma
138-hydroxybutyric acid.
139-(g) "Fentanyl-related controlled substance" means any substance
140-designated in K.S.A. 65-4105(b)(1), (b)(2), (b)(4), (b)(10), (b)(11), (b)
141-(12), (b)(14), (b)(15), (b)(16), (b)(17), (b)(20), (b)(21), (b)(22), (b)(23),
142-(b)(24), (b)(26), (b)(27), (b)(28), (b)(35), (b)(37), (b)(41), (b)(42), (b)
143-(43), (b)(44), (b)(45), (b)(46), (b)(47), (b)(49) (b)(48), (b)(50), (b)(54),
144-(b)(55), (b)(56), (b)(57), (b)(58), (b)(59), (b)(60), (b)(61), (b)(62) (b)
145-(68), (b)(70), (b)(71), (b)(72), (b)(73), (b)(74), (b)(75), (b)(76), (b)(77),
146-(b)(78), (b)(79), (b)(80), (b)(81), (b)(82), (b)(83), (b)(84), (b)(85), (b)
147-(91), (b)(97), (b)(98), (b)(99), (b)(103), (b)(104), (g)(1) or (g)(2) or 65-
148-4107(c)(1), (c)(6), (c)(9), (c)(26), (c)(28), (c)(30), (f)(3)(A) or (f)(3)
149-(B), and amendments thereto, or any analog thereof.
150-(h) "Immediate precursor" means a substance that the state board
151-of pharmacy has found to be and by rules and regulations designates as
152-being the principal compound commonly used or produced primarily
153-for use and that is an immediate chemical intermediary used or likely to
154-be used in the manufacture of a controlled substance, the control of
155-which is necessary to prevent, curtail or limit manufacture.
156-(i) "Isomer" means all enantiomers and diastereomers.
157-(j) "Manufacture" means the production, preparation, propagation,
158-compounding, conversion or processing of or placing into pill or
159-capsule form a controlled substance either directly or indirectly or by
160-extraction from substances of natural origin or independently by means
161-of chemical synthesis or by a combination of extraction and chemical
162-synthesis. "Manufacture" does not include:
163-(1) The preparation or compounding of a controlled substance by
164-an individual for the individual's own lawful use or the preparation,
165-compounding, packaging or labeling of a controlled substance:
166-(A) By a practitioner or the practitioner's agent pursuant to a
167-lawful order of a practitioner as an incident to the practitioner's
168-administering or dispensing of a controlled substance in the course of
169-the practitioner's professional practice; or
170-(B) by a practitioner or by the practitioner's authorized agent
171-under such practitioner's supervision for the purpose of or as an
172-incident to research, teaching or chemical analysis or by a pharmacist
173-or medical care facility as an incident to dispensing of a controlled
174-substance; or
175-(2) the addition of diluents or adulterants, including, but not
176-limited to, quinine hydrochloride, mannitol, mannite, dextrose or
177-lactose that are intended for use in cutting a controlled substance.
178-(k) "Marijuana" means all parts of all varieties of the plant
179-Cannabis whether growing or not, the seeds thereof, the resin extracted
180-from any part of the plant and every compound, manufacture, salt,
181-derivative, mixture or preparation of the plant, its seeds or resin.
182-"Marijuana" does not include:
183-(1) The mature stalks of the plant, fiber produced from the stalks,
184-oil or cake made from the seeds of the plant, any other compound, HOUSE BILL No. 2547—page 4
185-manufacture, salt, derivative, mixture or preparation of the mature
186-stalks, except the resin extracted therefrom, fiber, oil or cake or the
187-sterilized seed of the plant that is incapable of germination;
188-(2) any substance listed in schedules II through V of the uniform
189-controlled substances act;
190-(3) drug products approved by the United States food and drug
191-administration as of the effective date of this act;
192-(4) cannabidiol (other trade name: 2-[(3-methyl-6-(1-
193-methylethenyl)-2-cyclohexen-1-yl]-5-pentyl-1,3-benzenediol); or
194-(5) industrial hemp as defined in K.S.A. 2-3901, and amendments
195-thereto, when cultivated, produced, possessed or used for activities
196-authorized by the commercial industrial hemp act.
197-(l) "Minor" means a person under 18 years of age.
198-(m) "Narcotic drug" means any of the following whether produced
199-directly or indirectly by extraction from substances of vegetable origin
200-or independently by means of chemical synthesis or by a combination
201-of extraction and chemical synthesis:
202-(1) Opium and opiate and any salt, compound, derivative or
203-preparation of opium or opiate;
204-(2) any salt, compound, isomer, derivative or preparation thereof
205-that is chemically equivalent or identical with any of the substances
206-referred to in paragraph (1) but not including the isoquinoline alkaloids
207-of opium;
208-(3) opium poppy and poppy straw;
209-(4) coca leaves and any salt, compound, derivative or preparation
210-of coca leaves and any salt, compound, isomer, derivative or
211-preparation thereof that is chemically equivalent or identical with any
212-of these substances, but not including decocainized coca leaves or
213-extractions of coca leaves that do not contain cocaine or ecgonine.
214-(n) "Opiate" means any substance having an addiction-forming or
215-addiction-sustaining liability similar to morphine or being capable of
216-conversion into a drug having addiction-forming or addiction-
217-sustaining liability. "Opiate" does not include, unless specifically
218-designated as controlled under K.S.A. 65-4102, and amendments
219-thereto, the dextrorotatory isomer of 3-methoxy-n-methylmorphinan
220-and its salts (dextromethorphan). "Opiate" does include its racemic and
221-levorotatory forms.
222-(o) "Opium poppy" means the plant of the species Papaver
223-somniferum l. except its seeds.
224-(p) "Person" means an individual, corporation, government or
225-governmental subdivision or agency, business trust, estate, trust,
226-partnership, association or any other legal entity.
227-(q) "Poppy straw" means all parts, except the seeds, of the opium
228-poppy, after mowing.
229-(r) "School property" means property upon which is located a
230-structure used by a unified school district or an accredited nonpublic
231-school for student instruction or attendance or extracurricular activities
232-of pupils enrolled in kindergarten or any of the grades one through 12.
233-This definition shall not be construed as requiring that school be in
234-session or that classes are actually being held at the time of the offense
235-or that children must be present within the structure or on the property
236-during the time of any alleged criminal act. If the structure or property
237-meets the above definition, the actual use of that structure or property at
238-the time alleged shall not be a defense to the crime charged or the
239-sentence imposed.
240-(s) "Simulated controlled substance" means any product that
241-identifies itself by a common name or slang term associated with a
242-controlled substance and that indicates on its label or accompanying
243-promotional material that the product simulates the effect of a HOUSE BILL No. 2547—page 5
244-controlled substance.
245-Sec. 2. K.S.A. 65-1680 is hereby amended to read as follows: 65-

24617 1680. The state board of pharmacy may adopt any rules and regulations
24718 which the board deems necessary in relation to the maintenance of
24819 epinephrine kits under K.S.A. 72-6283, and amendments thereto. (a) A
249-pharmacist may distribute a stock supply of standard-dose and
250-pediatric-dose epinephrine auto-injectors to a school pursuant to a
251-prescription made pursuant to K.S.A. 72-6283, and amendments
252-thereto, from a physician or mid-level practitioner in the name of the
253-school. A pharmacist who distributes a stock supply of standard-dose
254-or pediatric-dose epinephrine auto-injectors to a school shall not be
255-liable for civil damages resulting from the administration of such
256-medication pursuant to this section, K.S.A. 65-2872b or 72-6283, and
257-amendments thereto.
258-(b) A pharmacist may distribute a stock supply of albuterol
259-metered-dose inhalers, albuterol solution and spacers to a school
260-pursuant to a prescription made pursuant to K.S.A. 72-6283, and
261-amendments thereto, from a physician or mid-level practitioner in the
262-name of the school. A pharmacist who distributes a stock supply of
263-albuterol metered-dose inhalers, albuterol solution or spacers to a
264-school shall not be liable for civil damages resulting from the
265-administration of such medication pursuant to this section, K.S.A. 65-
266-2872b or 72-6283, and amendments thereto.
267-(c) The terms used in this section mean the same as defined in
268-K.S.A. 72-6283, and amendments thereto.
269-Sec. 3. K.S.A. 65-2872b is hereby amended to read as follows: 65-
270-2872b. (a) The practice of the healing arts shall not be construed to
271-include any person administering epinephrine or albuterol in
272-emergency situations to a student or a member of a school staff an
273-individual if:
274-(1) (A) The person administering the epinephrine reasonably
275-believes that the student or staff member individual is exhibiting the
276-signs and symptoms of an anaphylactic reaction; or
277-(B) the person administering the albuterol reasonably believes
278-that the individual is exhibiting the signs and symptoms of respiratory
279-distress;
280-(2) a physician or mid-level practitioner, after reviewing the
281-school's policies and procedures, has authorized, in writing, the school
282-to maintain a stock supply of epinephrine emergency medication; and
283-(3) the epinephrine emergency medication is administered at
284-school, on school property or at a school-sponsored event.
285-(b) Any person who gratuitously and in good faith renders
286-emergency care or treatment, without compensation, through the
287-administration of epinephrine to a student or a member of a school staff
288-emergency medication to an individual at school, on school property or
289-at a school-sponsored event, and any school that employs or contracts
290-such person shall not be held liable for any civil damages as a result of
291-such care or administration or as a result of any act or failure to act in
292-providing or arranging further medical treatment where when the
293-person acts as an ordinary reasonably prudent person would have acted

29+dose inhalers, albuterol solution and spacers to a school pursuant to a
30+prescription made pursuant to K.S.A. 72-6283, and amendments thereto,
31+from a physician or mid-level practitioner in the name of the school. A
32+pharmacist who distributes a stock supply of albuterol metered-dose
33+inhalers, albuterol solution or spacers to a school shall not be liable for
34+civil damages resulting from the administration of such medication
35+pursuant to this section, K.S.A. 65-2872b or 72-6283, and amendments
36+thereto.
37+(c) The terms used in this section mean the same as defined in K.S.A.
38+72-6283, and amendments thereto.
39+Sec. 2. K.S.A. 65-2872b is hereby amended to read as follows: 65-

74+2872b. (a) The practice of the healing arts shall not be construed to include
75+any person administering epinephrine or albuterol in emergency situations
76+to a student or a member of a school staff an individual if:
77+(1) (A) The person administering the epinephrine reasonably believes
78+that the student or staff member individual is exhibiting the signs and
79+symptoms of an anaphylactic reaction; or
80+(B) the person administering the albuterol reasonably believes that
81+the individual is exhibiting the signs and symptoms of respiratory distress;
82+(2) a physician or mid-level practitioner, after reviewing the school's
83+policies and procedures, has authorized, in writing, the school to maintain
84+a stock supply of epinephrine emergency medication; and
85+(3) the epinephrine emergency medication is administered at school,
86+on school property or at a school-sponsored event.
87+(b) Any person who gratuitously and in good faith renders emergency
88+care or treatment through the administration of epinephrine emergency
89+medication to a student or a member of a school staff an individual at
90+school, on school property or at a school-sponsored event, and any school
91+that employs or contracts such person, shall not be held liable for any civil
92+damages as a result of such care or administration or as a result of any act
93+or failure to act in providing or arranging further medical treatment where
94+the person acts as an ordinary reasonably prudent person would have acted
29495 under the same or similar circumstances.
29596 (c) A physician or mid-level practitioner who writes a prescription
296-for emergency medication or provides training to school personnel on
297-the administration of emergency medication shall not be liable for civil
97+for emergency medication or provides training to school personnel on the

29899 damages resulting from the administration of emergency medication
299100 pursuant to this section, K.S.A. 65-1680 or 72-6283, and amendments

301-(d) The terms used in this section mean the same as defined in

303-Sec. 4. K.S.A. 2023 Supp. 65-4105 is hereby amended to read as
304-follows: 65-4105. (a) The controlled substances listed in this section are
305-included in schedule I and the number set forth opposite each drug or
306-substance is the DEA controlled substances code that has been assigned
307-to it.

1261-school-sponsored event. A school may not maintain an epinephrine kit
1262-unless the school has consulted with a pharmacist licensed by the state
1263-board of pharmacy. The consultant pharmacist shall have supervisory
1264-responsibility for maintaining the epinephrine kit. The consultant
1265-pharmacist shall be responsible for developing procedures, proper
1266-control and accountability for the epinephrine kit. Periodic physical
1267-inventory of the epinephrine kit shall be required. An epinephrine kit
1268-shall be maintained under the control of the consultant pharmacist. (a)

1272-medication, otherwise known as a bronchodilator, that is prescribed by
1273-a physician or mid-level practitioner for the treatment of respiratory
164+medication, otherwise known as a bronchodilator, that is prescribed by a
165+physician or mid-level practitioner for the treatment of respiratory
1274166 distress.
1275-(2) "Albuterol metered-dose inhaler" means a portable drug
1276-delivery system containing a canister of multiple premeasured doses of
1277-albuterol in a device actuator.
1278-(3) "Albuterol solution" means a liquid form of albuterol for use
1279-with a nebulizer.
1280-(4) "Anaphaylaxis" or "anaphylactic reaction" means a sudden,
1281-severe and potentially life-threatening multi-system allergic reaction.
1282-(5) "Designated school personnel" means an employee, officer,
1283-agent or volunteer of a school who has completed training,
1284-documented by the school nurse, a physician or a mid-level
1285-practitioner, to administer emergency medication on a voluntary basis
1286-outside of the scope of employment.
167+(2) "Albuterol metered-dose inhaler" means a portable drug delivery

1287179 (6) "Emergency medication" means epinephrine or albuterol.
1288-(7) "Epinephrine" means a medication prescribed by a physician
1289-or mid-level practitioner for the emergency treatment of anaphylaxis
1290-prior to the arrival of emergency medical system responders.
180+(7) "Epinephrine" means a medication prescribed by a physician or
181+mid-level practitioner for the emergency treatment of anaphylaxis prior to
182+the arrival of emergency medical system responders.
1291183 (8) "Epinephrine auto-injector" means a device that automatically
1292184 injects a premeasured dose of epinephrine.
1293-(9) "Mid-level practitioner" means the same as such term is
1294-defined in K.S.A. 65-1626, and amendments thereto.
185+(9) "Mid-level practitioner" means the same as such term is defined

1295187 (10) "Nebulizer" means a device that is used to change a liquid
1296188 medication to a fine spray of liquid or mist for the administration of the
1297189 medication through inhalation.
1298-(11) "Pharmacist" means the same as such term is defined in
1299-K.S.A. 65-1626, and amendments thereto.
190+(11) "Pharmacist" means the same as such term is defined in K.S.A.

1300192 (12) "Physician" means any person licensed by the state board of
1301193 healing arts to practice medicine and surgery.
1302194 (13) "Respiratory distress" means impaired ventilation of the
1303195 respiratory system or impaired oxygenation of the blood.
1304196 (14) "School" means any school operated by a school district
1305-organized under the laws of this state or any accredited nonpublic HOUSE BILL No. 2547—page 23
1306-school that provides education to elementary or secondary students.
1307-(15) "School nurse" means a registered nurse licensed by the
1308-board of nursing to practice nursing in Kansas or a licensed practical
1309-nurse working under a registered nurse who is employed by a school to
1310-perform nursing services in a school setting.
1311-(16) "Spacer" means a holding chamber that is used to optimize
1312-the delivery of aerolized albuterol from an albuterol metered-dose
1313-inhaler.

1314248 (17) "Stock supply" means an appropriate quantity of emergency

1316250 (b) (1) A school may maintain a stock supply of emergency
1317251 medication upon obtaining a prescription from a physician or mid-level
1318252 practitioner in the name of the school. A physician or mid-level
1319-practitioner shall review the school's policies and procedures
1320-established pursuant to subsection (c) prior to prescribing such
1321-emergency medication.

1332-solution and one or more spacers or nebulizers. A school nurse or
1333-designated school personnel may administer such albuterol in an
1334-emergency situation to any individual who displays the signs and
1335-symptoms of respiratory distress at school, on school property or at a
1336-school-sponsored event if such school nurse or designated school
1337-personnel reasonably believes that an individual is exhibiting the signs
1338-and symptoms of respiratory distress.
1339-(c) A school that maintains a stock supply of emergency
1340-medication shall establish school policies and procedures relating to:
1341-(1) Storage of the emergency medication, which shall require that
1342-the emergency medication is stored:
1343-(A) In a safe location that is readily accessible to the school nurse
1344-or designated school personnel; and
1345-(B) in accordance with manufacturer temperature
1346-recommendations;
264+(3) A stock supply of albuterol may consist of one or more albuterol
265+metered-dose inhalers, one or more doses of albuterol solution and one or
266+more spacers or nebulizers. A school nurse or designated school
267+personnel may administer such albuterol in an emergency situation to any
268+individual who displays the signs and symptoms of respiratory distress at
269+school, on school property or at a school-sponsored event if such school
270+nurse or designated school personnel reasonably believes that an
271+individual is exhibiting the signs and symptoms of respiratory distress.
272+(c) A school that maintains a stock supply of emergency medication
273+shall establish school policies and procedures relating to:
274+(1) Storage of the emergency medication, which shall require that the
275+emergency medication is stored:
276+(A) In a safe location that is readily accessible to the school nurse or
277+designated school personnel; and
278+(B) in accordance with manufacturer temperature recommendations;
1347279 (2) periodic monitoring of the inventory and expiration dates of
1348280 emergency medication;
1349281 (3) administration of emergency medication by designated school
1350282 personnel; and
1351283 (4) training requirements for designated school personnel, which
1352-shall be conducted by a school nurse, physician or mid-level
1353-practitioner on not less than on an annual basis for such designated

1368342 carry out the provisions of this section or may accept epinephrine auto-

1374-Sec. 10. This act shall take effect and be in force from and after its
