66 AN ACT making and concerning appropriations for the fiscal year ending
77 June 30, 2025, for the Kansas state university extension systems and
88 agriculture research programs for a program to increase the supply of
99 child care providers; establishing a program to award funds to child
1010 care service providers who provide services to home-based child care
1111 providers.
1212 Be it enacted by the Legislature of the State of Kansas:
1313 Section 1.

1515 AND AGRICULTURE RESEARCH PROGRAMS
1616 (a) There is appropriated for the above agency from the state general
1717 fund for the fiscal year ending June 30, 2025, the following:
1818 Cooperative extension service (including
1919 official hospitality) (369-00-1000-1020)..............................$15,000,000
2020 Provided, That expenditures shall be made from the cooperative extension
2121 service (including official hospitality) account in an amount not to exceed
2222 $10,000,000 to administer a program intended for the recruitment and
2323 retention of home-based child care providers pursuant to section 2, and
2424 amendments thereto.
2525 Sec. 2. (a) Subject to appropriations, KSU 105 project shall
2626 administer and provide oversight for a program that awards funding to a
2727 child care service provider to increase the supply of child care family
2828 homes, group homes and centers by recruiting and coaching prospective
2929 child care providers through the initial business planning and
3030 implementation process and develop and execute a mentorship program
3131 for new child care family homes, group homes and centers.
3232 (b) To be eligible for funding under such a program, a child care
3333 service provider shall:
3434 (1) Not be a state entity;
3535 (2) provide similar services in three states;
3636 (3) partner with KSU 105 project to plan, staff and execute in-person
3737 and virtual recruitment events for new home-based child care providers in
3838 areas of need and develop informational materials that assist home-based
3939 child care providers with marketing, advertising and parental outreach;

7575 (4) execute a two-year mentorship program for new home-based child
7676 care providers to coach prospective home-based child care providers
7777 through the initial business planning and implementation process;
7878 (5) provide a software platform, including customizable dashboards,
7979 to assist home-based child care providers with marketing, enrollment,
8080 family communication, billing and expense reporting; and
8181 (6) offer home-based child care providers coaching and training,
8282 including in-person group training sessions, on-site coaching visits,
8383 community forums and events.
8484 (c) Prior to recipient's receipt of funds, Kansas state university and
8585 the recipient shall enter into an agreement that includes:
8686 (1) All necessary identifying information of the recipient, including
8787 any tax and financial information for the program to administer funds
8888 under this section; and
8989 (2) a description of the project for which the funds shall be expended,
9090 including tentative timelines and an estimated budget.
9191 (d) The recipients shall report to KSU 105 project the following:
9292 (1) Number of home-based child care providers enrolled in the
9393 recipient's program;
9494 (2) number of child care spots created;
9595 (3) number of home-based child care providers on the waitlist; and
9696 (4) potential long-term economic impact of the awarded funds.
9797 (e) If KSU 105 project reasonably determine funds to any recipient
9898 are misused or the grant's use was misrepresented by the recipient, KSU
9999 105 project shall not award funds to such recipient and may revoke any
100100 agreement executed. Upon such determination, KSU 105 project may
101101 subject the recipient to internal audit protocols.
102102 (f) KSU 105 project shall be subject to procurement and bidding
103103 processes in Kansas law.
104104 (g) Recipients shall respond to requests for information from the
105105 legislature or state agencies.
106106 (h) As used in this section:
107107 (1) "Child care service providers" means an entity that provides
108108 services for child care providers and child care facilities, including, but not
109109 limited to, peer mentoring, compliant and regulatory assistance.
110110 (2) "Home-based child care providers" means an individual who has
111111 control or custody of one or more children under 16 years of age,
112112 unattended by parent or guardian, for the purpose of providing food or
113113 lodging, or both. "Home-based child care providers" shall not include
114114 individuals who provide such care to children in the custody of the
115115 secretary for children and families who are placed with a prospective
116116 adoptive family pursuant to the provisions of an adoptive placement
117117 agreement or who are related to the person by blood, marriage or legal

161161 adoption within such individual's own home.
162162 (3) "KSU 105 project" means an education program at Kansas state
163163 university that provides outreach to 105 counties in Kansas.
164164 Sec. 3. This act shall take effect and be in force from and after its
165165 publication in the statute book.
