Dear Representative Landwehr: 
 
 SUBJECT: Fiscal Note for HB 2749 by House Committee on Health and Human 
Services 
 
 In accordance with KSA 75-3715a, the following fiscal note concerning HB 2749 is 
respectfully submitted to your committee. 
 
 HB 2749 would make several amendments to KSA 65-445 regarding reports on the 
termination of pregnancies submitted to the Secretary of Health and Environment.  The bill would 
change the requirement for submission of the reports from annually to biannually.  The bill would 
also make new requirements for the information to be submitted in the reports.  Providers would 
be required to gather information from any woman seeking an abortion prior to the termination of 
the pregnancy, including the reason or reasons for the decision to terminate the pregnancy.  This 
would not be required in the case of a medical emergency, and a woman could decline to answer 
but that response would be required to be recorded. Other demographic and situational 
information, as well as information on the method of abortion would be required to be gathered. 
The sunset of confidentiality provisions would be extended from July 1, 2028 to July 1, 2029. 
Biannual reports would be required to be issued within 30 days after the end of the reporting period 
for the information contained within the report.  The bill would also add a severability clause so 
that if any phrase or clause was held invalid it would not affect remaining provisions.   
 
 According to the Department of Health and Environment (KDHE), enactment of HB 2749 
would require additional expenditures totaling $10,000, all from the State General Fund in FY 
2024.  This would be to add additional fields to the electronic reporting system for abortion data.  
The agency states it would need to work with the system vendor to determine a timeline of when 
the changes would be completed. KDHE would also need to update paper worksheets and 
additional data fields would need to be analyzed and edited. The agency notes amendments to  The Honorable Brenda Landwehr, Chairperson

KAR 28-56-2 would also be required.  The Office of Judicial Administrations states enactment of 
the bill would not have a fiscal effect on the Judicial Branch.  Any fiscal effect associated with 
HB 2749 is not reflected in The FY 2025 Governor’s Budget Report.
