55 AN ACT concerning education; relating to certain nonpublic schools;
66 requiring participation in state assessments; requiring website

99 repealing the existing section.
1010 WHEREAS, This act shall be known as the consumer research and
1111 transparency act.
1212 Now, therefore:
1313 Be it enacted by the Legislature of the State of Kansas:
1414 New Section 1. (a) Each nonpublic school in this state shall
1515 administer the statewide assessments provided by the state board of
1616 education in K.S.A. 72-5170, and amendments thereto, to students
1717 enrolled in the appropriate grades for each such assessment at such school.
1818 (b) As used in this section, "nonpublic school" means an accredited or
1919 nonaccredited private elementary or secondary school. "Nonpublic school"
2020 does not include a home school or home school organization, community
2121 consortium or group.
2222 Sec. 2. K.S.A. 2022 Supp. 72-5178 is hereby amended to read as
2323 follows: 72-5178. (a) On or before January 15 of each year, the state
2424 department of education shall prepare and digitally update on the website
2525 of the state department of education the performance accountability reports
2626 and longitudinal achievement reports upon all students enrolled in any
2727 public school or accredited nonpublic school in the state, each school
2828 district, each school operated by a school district and each accredited
2929 nonpublic school.
3030 (b) Each performance accountability report shall be prepared in a
3131 single-page format containing the information that is required to be
3232 reported under the federal elementary and secondary education act, as
3333 amended by the federal every student succeeds act, public law 114-95, or
3434 any successor federal acts, and the college and career readiness metrics
3535 developed and implemented by the state board. The report shall use the
3636 categories for achievement identified under the federal every student
3737 succeeds act, public law 114-95, or any successor achievement categories.
3838 All categories and metrics included in the report shall be clearly defined.
3939 (c) Each longitudinal achievement report shall provide the

7676 achievement rates on the state assessments for English language arts, math
7777 and science for all students and each student subgroup and the change in
7878 achievement rate year-over-year starting with the school year in which the
7979 state board first implemented new achievement standards on such state
8080 assessments.
8181 (d) On or before January 15 of each year, the state department of
8282 education shall prepare written academic achievement reports to provide a
8383 summary of student achievement in this state and shall submit such reports
8484 to the governor and the legislature. Such written academic achievement
8585 reports shall:
8686 (1) Provide a statewide summary of the performance accountability
8787 reports and longitudinal achievement reports prepared pursuant to this
8888 section. Such summary report shall provide:
8989 (A) Achievement data from the English language arts assessments
9090 and math assessments over the preceding five years for all students and
9191 student subgroups to show whether there are statewide trends in academic
9292 improvement or learning loss among all students and student subgroups;
9393 (B) a comparison to any other evaluation metric used by the state
9494 board of education to evaluate student achievement such as college and
9595 career readiness measurements or graduation rates;
9696 (C) a comparison to other educational assessments that measure
9797 academic performance such as the national assessment of educational
9898 progress;
9999 (D) an analysis of the trends in student achievement outcomes and a
100100 review of conditions that are impacting recent student achievement
101101 outcomes;
102102 (E) a review of the academic interventions that school districts are
103103 using to improve student performance, whether the state board of
104104 education has any specific recommendations regarding academic
105105 interventions to improve academic achievement and an estimation of the
106106 academic achievement gains that can be expected from such interventions;
107107 and
108108 (F) a summary of the performance levels and the scale and cut scores
109109 for the statewide assessments and how such information should be used to
110110 draw conclusions about student achievement; and
111111 (2) provide a student-focused longitudinal achievement report that
112112 provides information on the academic achievement of certain student
113113 cohort groups to show the achievement gains or learning losses that are
114114 occurring for such students. Such report shall begin with the students who
115115 are entering grade three and grade eight in school year 2022-2023. The
116116 report shall summarize the longitudinal achievement of such students over
117117 a three-year period and shall be repeated every three years for the students
118118 entering such grade levels. The longitudinal report shall provide:

162162 (A) A summary of the improvement or learning loss that is occurring
163163 within such student cohort groups over such three-year period for all such
164164 students and the student subgroups;
165165 (B) an analysis of the evaluations and metrics that are used to
166166 measure the year-over-year achievement of such student cohort groups;
167167 (C) a review of the academic interventions that school districts are
168168 using to improve student performance within such student cohort groups,
169169 whether the state board of education has any specific recommendations
170170 regarding academic interventions to improve academic achievement and
171171 an estimate of the academic achievement gains that can be expected from
172172 such interventions; and
173173 (D) the achievement results from the English language arts
174174 assessments and math assessments for such student cohort groups and any
175175 other assessment data pertaining to such student cohort groups, including,
176176 but not limited to, the national assessment for educational progress, the
177177 ACT college entrance exam and the pre-ACT assessment.
178178 (d) All reports prepared pursuant to this section shall be published in
179179 accordance with K.S.A. 2022 Supp. 72-1181, and amendments thereto.
180180 (e) As used in this section, "nonpublic school" means an accredited
181181 or nonaccredited private school that regularly offers education at the
182182 elementary or secondary level. "Nonpublic school" does not include a
183183 home school or home school organization, community, consortium or
184184 group.
185185 Sec. 3. K.S.A. 2022 Supp. 72-5178 is hereby repealed.
186186 Sec. 4. This act shall take effect and be in force from and after its
187187 publication in the statute book.
