| 6 | 6 | | prohibiting the expenditure of any state moneys for drag shows |

| 7 | 7 | | targeting minors; providing criminal penalties for violations of the act. |

| 8 | 8 | | Be it enacted by the Legislature of the State of Kansas: |
|---|
| 9 | 9 | | Section 1. (a) No moneys appropriated from the state general fund or |
|---|
| 10 | 10 | | from any special revenue fund shall be expended for the production or |
|---|
| 11 | 11 | | performance of any drag show that has a primary audience consisting of |
|---|
| 12 | 12 | | individuals under 18 years of age. |
|---|
| 13 | 13 | | (b) It is a violation of this section to knowingly expend moneys in |
|---|
| 14 | 14 | | violation of subsection (a). Violation of this section by an individual is a |
|---|
| 15 | 15 | | class B nonperson misdemeanor. |
|---|
| 16 | 16 | | (c) No moneys appropriated from the state general fund or from any |
|---|
| 17 | 17 | | special revenue fund shall be distributed to or otherwise expended by any |
|---|
| 18 | 18 | | state agency or any political subdivision of this state for a period of three |
|---|
| 19 | 19 | | years if any officer, employee or agent of such state agency or political |
|---|
| 20 | 20 | | subdivision has been convicted of a violation of this section. Such three- |
|---|
| 21 | 21 | | year period shall commence on the date of such conviction. |
|---|
| 22 | 22 | | (d) As used in this section, the term "drag show" means a |
|---|
| 23 | 23 | | performance in which one or more performers: |
|---|
| 24 | 24 | | (1) Exhibits a gender identity that is different from the performer's |
|---|
| 25 | 25 | | gender assigned at birth using clothing, makeup or other accessories that |
|---|
| 26 | 26 | | are traditionally worn by members of and are meant to exaggerate the |
|---|
| 27 | 27 | | gender identity of the performer's opposite sex; and |
|---|
| 28 | 28 | | (2) sings, lip-synchs, dances or otherwise performs for entertainment |
|---|
| 29 | 29 | | before an audience that consists primarily of individuals under 18 years of |
|---|
| 30 | 30 | | age, whether performed for payment or not. |
|---|
| 31 | 31 | | Sec. 2. This act shall take effect and be in force from and after its |
|---|
| 32 | 32 | | publication in the statute book. |
