55 AN ACT establishing requirements for school safety and security plans
66 and cardiac emergency response plans; creating the school safety and
77 security grant fund and the school cardiac emergency response grant
88 fund.
99 Be it enacted by the Legislature of the State of Kansas:
1010 Section 1. (a) The state board of education shall develop and adopt
1111 statewide standards for school safety and security plans and cardiac
1212 emergency response plans. In developing such standards, the state board of
1313 education shall consult with the office of the adjutant general, the Kansas
1414 bureau of investigation, the department of health and environment, the
1515 state fire marshal and with any other state agencies, municipal agencies
1616 and school boards as the state board deems necessary.
1717 (b) The standards developed by the state board of education shall
1818 include, but shall not be limited to:
1919 (1) Evaluation of the infrastructure of school buildings and
2020 attendance centers for compliance with standards adopted under
2121 subsections (e) and (f);
2222 (2) training of school district employees on school safety and security
2323 policies and procedures and cardiac emergency response policies and
2424 procedures;
2525 (3) conducting student drills on emergency situations;
2626 (4) procedures for making notifications to individuals located outside
2727 of the school building during emergency situations and maintaining
2828 communication with law enforcement agencies, emergency management
2929 agencies, emergency medical services and other necessary individuals;
3030 (5) procedures for securing school buildings during an emergency
3131 situation;
3232 (6) procedures for emergency evacuation of school buildings,
3333 including evacuation routes and sites;
3434 (7) procedures for recovery after an emergency situation ceases;
3535 (8) coordination and incorporation of school safety and security plans
3636 and cardiac emergency response plans within existing school district
3737 emergency response plans;
3838 (9) distribution of school safety and security plans and cardiac
3939 emergency response plans to local law enforcement agencies and

7676 emergency management agencies;
7777 (10) procedures for ensuring accountability in adopting and
7878 implementing school safety and security plans and cardiac emergency
7979 response plans in accordance with the statewide standards adopted by the
8080 state board; and
8181 (11) any other policies and procedures the state board deems
8282 necessary for school safety and security plans or cardiac emergency
8383 response plans.
8484 (c) As part of such standards, the state board shall identify roles and
8585 responsibilities for implementing school safety and security plans and
8686 cardiac emergency response plans at the school district and school building
8787 levels, including, but not limited to, the role of local law enforcement
8888 agencies and local emergency management agencies when partnering with
8989 school districts in the development and implementation of such plans.
9090 (d) The state board may consider and utilize any materials,
9191 documentation or videos that are available through the United States
9292 department of homeland security in developing standards for school safety
9393 and security plans, and any such resources that are available through the
9494 United States department of health and human services, the American
9595 heart association or any other nationally recognized, guidelines-based
9696 organization focused on emergency cardiovascular care in developing
9797 standards for cardiac emergency response plans.
9898 (e) The statewide standards for school safety and security plans shall
9999 address, but shall not be limited to:
100100 (1) The infrastructure of school buildings and attendance centers
101101 operated by school districts, including, but not limited to, secured
102102 entrances, windows and other facets of the structural integrity of such
103103 buildings;
104104 (2) security technology to be utilized in such buildings, including, but
105105 not limited to, intrusion detection systems and security cameras;
106106 (3) communications systems, including, but not limited to, systems
107107 for interoperability between the school district and law enforcement
108108 agencies; and
109109 (4) any other systems or facilities the state board deems necessary for
110110 the safety and security of such buildings.
111111 (f) The statewide standards for cardiac emergency response plans
112112 shall address, but shall not be limited to:
113113 (1) The appropriate use of school personnel to respond to incidents
114114 involving an individual experiencing suspected sudden cardiac arrest while
115115 on school grounds, including incidents involving an individual attending
116116 or participating in an athletic practice or event, whether such practice or
117117 event is conducted on school grounds or at a separate location;
118118 (2) establishing a cardiac emergency response team;

162162 (3) implementing placement of automated external defibrillators and
163163 routine maintenance of such devices within school buildings, including
164164 appropriate placement in accordance with guidelines established by the
165165 American heart association or any nationally recognized, guidelines-based
166166 organization focused on emergency cardiovascular care;
167167 (4) identifying the location of each automated external defibrillator;
168168 (5) training of school personnel in the use of automated external
169169 defibrillators and cardiopulmonary resuscitation during an emergency in
170170 accordance with guidelines established by the American heart association
171171 or any nationally recognized, guidelines-based organization focused on
172172 emergency cardiovascular care;
173173 (6) communications systems with local emergency medical services;
174174 and
175175 (7) developing an event-specific emergency action plan for each
176176 school-sanctioned event held at a location separate from school grounds
177177 that includes:
178178 (A) The roles of school and emergency medical services personnel,
179179 communications systems and available emergency equipment, including a
180180 portable automated external defibrillator; and
181181 (B) access to and plan for emergency transport.
182182 (g) The state board shall regularly review and update the standards
183183 for school safety and security plans and cardiac emergency response plans.
184184 Any changes to such standards shall be provided to each school district by
185185 written notification upon adoption by the state board.
186186 (h) The state board shall provide notice of the adopted standards to
187187 those state agencies with whom the state board consulted in developing
188188 such standards. To the extent such standards contain emergency or security
189189 information or procedures, the state board shall maintain the
190190 confidentiality of such standards when sending notices pursuant to this
191191 subsection.
192192 Sec. 2. (a) The board of education of each school district shall adopt a
193193 comprehensive school safety and security plan based on the statewide
194194 standards adopted by the state board of education under section 1, and
195195 amendments thereto. Prior to the adoption of a school safety and security
196196 plan, each school district shall consult with one or more local law
197197 enforcement agencies and local emergency management agencies to
198198 review and evaluate:
199199 (1) Existing infrastructure of school buildings and attendance centers
200200 operated by such school district; and
201201 (2) current school district safety and security policies and procedures.
202202 The local law enforcement agencies and emergency management
203203 agencies may provide guidance on improving a school district's building
204204 infrastructure or safety and security polices and procedures. The review

248248 and evaluation, and any guidance provided, shall be done in accordance
249249 with the standards adopted by the state board under section 1, and
250250 amendments thereto. Upon adoption of a school safety and security plan,
251251 the superintendent of the school district shall send a copy of such plan to
252252 each local law enforcement agency and emergency management agency
253253 with whom the school district consulted, and to the state board of
254254 education.
255255 (b) (1) The board of education of each school district shall adopt a
256256 comprehensive cardiac emergency response plan based on the statewide
257257 standards adopted by the state board of education under section 1, and
258258 amendments thereto.
259259 (2) Upon adoption, the cardiac emergency response plan shall be:
260260 (A) Provided to appropriate local law enforcement and emergency
261261 medical services and all school personnel;
262262 (B) reviewed by a school administrator with all school personnel
263263 prior to the first instructional day of each school year. The time and date of
264264 such review shall be documented as part of the plan; and
265265 (C) reviewed at the end of each school year by the school building
266266 administrators, school nurses and appropriate local law enforcement and
267267 emergency medical services.
268268 (3) The cardiac emergency response plan shall be rehearsed by
269269 simulation within 30 days prior to the beginning of each athletic season by
270270 all athletic directors, school nurses and all coaches, assistant coaches and
271271 athletic trainers who are coaching or otherwise participating in such
272272 athletic season.
273273 (4) Each athletic coach shall obtain a cardiopulmonary resuscitation
274274 certification or training recognized by a national accrediting body on heart
275275 health. At least one individual with such certification or training shall be in
276276 attendance at every interscholastic athletic practice and competition.
277277 Courses for such certification or training shall:
278278 (A) Be reviewed at least once every 30 months and revised if needed;
279279 (B) be completed through hands-on or online teaching methods in 10
280280 hours or less; and
281281 (C) include an end-of-course examination with a minimum qualifying
282282 score for successful course completion established by the board of
283283 education or the entity conducting such training.
284284 Sec. 3. (a) There is hereby established the school safety and security
285285 grant program to be administered by the state board of education. Each
286286 school district may submit an application to the state board of education in
287287 such form and manner as prescribed by the state board for an amount of
288288 grant moneys needed by such school district to implement such district's
289289 school safety and security plan adopted pursuant to section 2, and
290290 amendments thereto. Each grant application shall include a copy of the

334334 current school district safety and security plan, including all policies and
335335 procedures adopted for the implementation of such plan, and a description
336336 of the school safety and security improvements the district determines
337337 necessary for such implementation. The state board shall review all
338338 submitted applications and approve or deny such applications based on
339339 whether the applicant school district has demonstrated the necessity for the
340340 school safety and security improvements described in the application. As
341341 part of its review, the state board may conduct a hearing and provide the
342342 applicant school district an opportunity to present testimony as to the
343343 necessity of such school safety and security improvements. If the state
344344 board approves an application, it shall determine the amount of moneys to
345345 be disbursed to the applicant school district from the school safety and
346346 security grant fund. If the state board denies an application, then, within 15
347347 days of such denial, the state board shall send written notice of such denial
348348 to the superintendent of such school district.
349349 (b) All administrative proceedings pursuant to this section shall be
350350 conducted in accordance with the provisions of the Kansas administrative
351351 procedure act. Any action by the state board of education pursuant to this
352352 section shall be subject to review in accordance with the Kansas judicial
353353 review act.
354354 (c) There is hereby established in the state treasury the school safety
355355 and security grant fund to be administered by the department of education.
356356 All expenditures from the school safety and security grant fund shall be
357357 used for the disbursement of grant moneys for school safety and security
358358 improvements in accordance with this section and shall be made in
359359 accordance with appropriation acts upon warrants of the director of
360360 accounts and reports issued pursuant to vouchers approved by the
361361 commissioner of education or the commissioner's designee. Upon receipt
362362 of such grant moneys, the school district treasurer shall deposit the amount
363363 of such award in the general fund of the school district.
364364 Sec. 4. (a) There is hereby established the school cardiac emergency
365365 response grant program to be administered by the department of health and
366366 environment. Each school district may submit an application to the
367367 secretary of health and environment in such form and manner as
368368 prescribed by the secretary for an amount of grant moneys needed by such
369369 school district to implement such district's cardiac emergency response
370370 plan adopted pursuant to section 2, and amendments thereto. Each grant
371371 application shall include a copy of the current school district cardiac
372372 emergency response plan, including all policies and procedures adopted
373373 for the implementation of such plan, and a description of the school
374374 improvements the district determines necessary for such implementation.
375375 The secretary shall review all submitted applications and approve or deny
376376 such applications based on whether the applicant school district has

420420 demonstrated the necessity of the school improvements described in the
421421 application. As part of such review, the secretary may conduct a hearing
422422 and provide the applicant school district an opportunity to present
423423 testimony as to the necessity of such school improvements. If the secretary
424424 approves an application, the secretary shall determine the amount of
425425 moneys to be disbursed to the applicant school district from the school
426426 cardiac emergency response grant fund. If the secretary denies an
427427 application, then, within 15 days of such denial, the secretary shall send
428428 written notice of such denial to the superintendent of such school district.
429429 (b) All administrative proceedings pursuant to this section shall be
430430 conducted in accordance with the provisions of the Kansas administrative
431431 procedure act. Any action by the secretary of health and environment
432432 pursuant to this section shall be subject to review in accordance with the
433433 Kansas judicial review act.
434434 (c) There is hereby established in the state treasury the school cardiac
435435 emergency response grant fund to be administered by the department of
436436 health and environment. All expenditures from the school cardiac
437437 emergency response grant fund shall be used for the disbursement of grant
438438 moneys for school improvements in accordance with this section and shall
439439 be made in accordance with appropriation acts upon warrants of the
440440 director of accounts and reports issued pursuant to vouchers approved by
441441 the secretary of health and environment or the secretary's designee. Upon
442442 receipt of such grant moneys, the school district treasurer shall deposit the
443443 amount of such award in the general fund of the school district.
444444 Sec. 5. This act shall take effect and be in force from and after its
445445 publication in the statute book.
