5	5	AN ACT concerning education; relating to postsecondary educational
6	6	institutions; including high school equivalency credentials in
7	7	performance-based payments for such institutions; amending K.S.A.
8	8	74-32,434 and repealing the existing section.
9	9	Be it enacted by the Legislature of the State of Kansas:
10	10	Section 1. K.S.A. 74-32,434 is hereby amended to read as follows:
11	11	74-32,434. (a) (1) Any eligible postsecondary educational institution may
12	12	certify to the board of regents:
13	13	(A) The number of individuals who received a general educational
14	14	development (GED) or high school equivalency (HSE) credential from
15	15	such institution while enrolled in an eligible career technical education
16	16	program;
17	17	(B) the number of individuals who received a career technical
18	18	education credential from such institution; and
19	19	(C) the number of individuals who were enrolled in an eligible career
20	20	technical education program at such institution and who are pursuing a
21	21	general educational development (GED) or high school equivalency (HSE)
22	22	credential.
23	23	(2) Certifications submitted pursuant to this subsection shall be
24	24	submitted in such form and manner as prescribed by the board of regents,
25	25	and shall include such other information as required by the board of
26	26	regents.
27	27	(b) Each fiscal year, upon receipt of a certification submitted under
28	28	subsection (a), the board of regents shall authorize payment to such
29	29	eligible postsecondary educational institution from the postsecondary
30	30	education performance-based incentives fund. The amount of any such
31	31	payment shall be calculated based on the following:
32	32	(1) For each individual who has received a general educational
33	33	development (GED) or high school equivalency (HSE) credential, $500;
34	34	(2) for each individual who has received a career technical education
35	35	credential, $1,000; and
36	36	(3) for each individual enrolled in an eligible career technical
37	37	education program who is pursuing a general educational development
38	38	(GED) or high school equivalency (HSE) credential, $170.
39	39	(c) That portion of any payment from the postsecondary education

76	76	performance-based incentives fund that is made based on subsection (b)(2)
77	77	shall be expended for scholarships for individuals enrolled in an eligible
78	78	career technical education program and operating costs of eligible career
79	79	technical education programs. Each eligible postsecondary educational
80	80	institution shall prepare and submit a report to the board of regents which
81	81	shall include that includes the number of individuals who received
82	82	scholarships, the aggregate amount of moneys expended for such
83	83	scholarships and the number of those individuals who received a
84	84	scholarship that also received a career technical education credential.
85	85	(d) (1) Of that portion of any payment from the postsecondary
86	86	education performance-based incentives fund that is made based on
87	87	subsection (b)(3), an amount equal to $150 for each individual shall be
88	88	expended by the eligible postsecondary educational institution for the
89	89	general educational development (GED) test.
90	90	(2) If any individual enrolled in an eligible career technical education
91	91	program for which an eligible postsecondary educational institution has
92	92	received a payment under this section fails to take the general educational
93	93	development (GED) test, then such institution shall notify the board of
94	94	regents in writing that no such test was administered to the individual. For
95	95	each such notification received, the board of regents shall deduct an
96	96	amount equal to $150 from such institution's subsequent incentive
97	97	payment.
98	98	(e) All payments authorized by the board of regents pursuant to this
99	99	section shall be subject to the limits of appropriations made for such
100	100	purposes. If there are insufficient appropriations for the board of regents to
101	101	authorize payments in accordance with the amounts set forth in subsection
102	102	(b), the board of regents shall prorate such amounts in accordance with
103	103	appropriations made therefor.
104	104	(f) There is hereby created the postsecondary education performance-
105	105	based incentives fund. Expenditures from the postsecondary education
106	106	performance-based incentives fund shall be for the sole purpose of paying
107	107	payments to eligible postsecondary educational institutions as authorized
108	108	by the board of regents. All expenditures from the postsecondary education
109	109	performance-based incentives fund shall be made in accordance with
110	110	appropriation acts upon warrants of the director of accounts and reports
111	111	issued pursuant to vouchers approved by the president of the board of
112	112	regents, or the president's designee.
113	113	(g) As used in this section:
114	114	(1) "Board of regents" means the state board of regents provided for
115	115	in the constitution of this state and established by K.S.A. 74-3202a, and
116	116	amendments thereto.
117	117	(2) "Career technical education credential" means any industry-
118	118	recognized technical certification or credential, other than a general

163	163	credential, or any technical certification or credential authorized by a state
164	164	agency.
165	165	(3) "Eligible career technical education program" means a program
166	166	operated by one or more eligible postsecondary educational institutions
167	167	that is identified by the board of regents as a program that allows an
168	168	enrollee to obtain a general educational development (GED) or high
169	169	school equivalency (HSE) credential while pursuing a career technical
170	170	education credential.
171	171	(4) "Eligible postsecondary educational institution" means any
172	172	community college, technical college or the institute of technology at
173	173	Washburn university.
174	174	(5) "State agency" means any state office, department, board,
175	175	commission, institution, bureau or any other state authority.
176	176	Sec. 2. K.S.A. 74-32,434 is hereby repealed.
177	177	Sec. 3. This act shall take effect and be in force from and after its
178	178	publication in the statute book.
