55 AN ACT concerning education; relating to postsecondary educational
66 institutions; including high school equivalency credentials in
77 performance-based payments for such institutions; amending K.S.A.
88 74-32,434 and repealing the existing section.
99 Be it enacted by the Legislature of the State of Kansas:
1010 Section 1. K.S.A. 74-32,434 is hereby amended to read as follows:
1111 74-32,434. (a) (1) Any eligible postsecondary educational institution may
1212 certify to the board of regents:
1313 (A) The number of individuals who received a general educational
1414 development (GED) or high school equivalency (HSE) credential from
1515 such institution while enrolled in an eligible career technical education
1616 program;
1717 (B) the number of individuals who received a career technical
1818 education credential from such institution; and
1919 (C) the number of individuals who were enrolled in an eligible career
2020 technical education program at such institution and who are pursuing a
2121 general educational development (GED) or high school equivalency (HSE)
2222 credential.
2323 (2) Certifications submitted pursuant to this subsection shall be
2424 submitted in such form and manner as prescribed by the board of regents,
2525 and shall include such other information as required by the board of
2626 regents.
2727 (b) Each fiscal year, upon receipt of a certification submitted under
2828 subsection (a), the board of regents shall authorize payment to such
2929 eligible postsecondary educational institution from the postsecondary
3030 education performance-based incentives fund. The amount of any such
3131 payment shall be calculated based on the following:
3232 (1) For each individual who has received a general educational
3333 development (GED) or high school equivalency (HSE) credential, $500;
3434 (2) for each individual who has received a career technical education
3535 credential, $1,000; and
3636 (3) for each individual enrolled in an eligible career technical
3737 education program who is pursuing a general educational development
3838 (GED) or high school equivalency (HSE) credential, $170.
3939 (c) That portion of any payment from the postsecondary education

7676 performance-based incentives fund that is made based on subsection (b)(2)
7777 shall be expended for scholarships for individuals enrolled in an eligible
7878 career technical education program and operating costs of eligible career
7979 technical education programs. Each eligible postsecondary educational
8080 institution shall prepare and submit a report to the board of regents which
8181 shall include that includes the number of individuals who received
8282 scholarships, the aggregate amount of moneys expended for such
8383 scholarships and the number of those individuals who received a
8484 scholarship that also received a career technical education credential.
8585 (d) (1) Of that portion of any payment from the postsecondary
8686 education performance-based incentives fund that is made based on
8787 subsection (b)(3), an amount equal to $150 for each individual shall be
8888 expended by the eligible postsecondary educational institution for the
8989 general educational development (GED) test.
9090 (2) If any individual enrolled in an eligible career technical education
9191 program for which an eligible postsecondary educational institution has
9292 received a payment under this section fails to take the general educational
9393 development (GED) test, then such institution shall notify the board of
9494 regents in writing that no such test was administered to the individual. For
9595 each such notification received, the board of regents shall deduct an
9696 amount equal to $150 from such institution's subsequent incentive
9797 payment.
9898 (e) All payments authorized by the board of regents pursuant to this
9999 section shall be subject to the limits of appropriations made for such
100100 purposes. If there are insufficient appropriations for the board of regents to
101101 authorize payments in accordance with the amounts set forth in subsection
102102 (b), the board of regents shall prorate such amounts in accordance with
103103 appropriations made therefor.
104104 (f) There is hereby created the postsecondary education performance-
105105 based incentives fund. Expenditures from the postsecondary education
106106 performance-based incentives fund shall be for the sole purpose of paying
107107 payments to eligible postsecondary educational institutions as authorized
108108 by the board of regents. All expenditures from the postsecondary education
109109 performance-based incentives fund shall be made in accordance with
110110 appropriation acts upon warrants of the director of accounts and reports
111111 issued pursuant to vouchers approved by the president of the board of
112112 regents, or the president's designee.
113113 (g) As used in this section:
114114 (1) "Board of regents" means the state board of regents provided for
115115 in the constitution of this state and established by K.S.A. 74-3202a, and
116116 amendments thereto.
117117 (2) "Career technical education credential" means any industry-
118118 recognized technical certification or credential, other than a general

163163 credential, or any technical certification or credential authorized by a state
164164 agency.
165165 (3) "Eligible career technical education program" means a program
166166 operated by one or more eligible postsecondary educational institutions
167167 that is identified by the board of regents as a program that allows an
168168 enrollee to obtain a general educational development (GED) or high
169169 school equivalency (HSE) credential while pursuing a career technical
170170 education credential.
171171 (4) "Eligible postsecondary educational institution" means any
172172 community college, technical college or the institute of technology at
173173 Washburn university.
174174 (5) "State agency" means any state office, department, board,
175175 commission, institution, bureau or any other state authority.
176176 Sec. 2. K.S.A. 74-32,434 is hereby repealed.
177177 Sec. 3. This act shall take effect and be in force from and after its
178178 publication in the statute book.
