5	5	A PROPOSITION to amend section 2 of the bill of rights of the
6	6	constitution of the state of Kansas to insert the right to vote as a
7	7	political right.

9	9	Be it resolved by the Legislature of the State of Kansas, two-thirds of the
10	10	members elected (or appointed) and qualified to the Senate and two-
11	11	thirds of the members elected (or appointed) and qualified to the
12	12	House of Representatives concurring therein:
13	13	Section 1. The following proposition to amend the constitution of
14	14	the state of Kansas shall be submitted to the qualified electors of the state
15	15	for their approval or rejection: Section 2 of the bill of rights of the
16	16	constitution of the state of Kansas is hereby amended to read as follows:
17	17	"§ 2. Political power; privileges. All political power is
18	18	inherent in the people, including the right to vote, and all free
19	19	governments are founded on their authority, and are instituted for
20	20	their equal protection and benefit. No special privileges or
21	21	immunities shall ever be granted by the legislature, which may not
22	22	be altered, revoked or repealed by the same body; and this power
23	23	shall be exercised by no other tribunal or agency."
24	24	Sec. 2. The following statement shall be printed on the ballot with
25	25	the amendment as a whole:
26	26	"Explanatory statement. The purpose of this amendment is to
27	27	ensure that the bill of rights of the constitution of the state of
28	28	Kansas clearly contains a right to vote as a political right to
29	29	ensure that any law enacted regulating the right to vote does
30	30	not violate this basic right.
31	31	"A vote for this proposition would add the right to vote as a
32	32	specific power to all political power inherent in the people as
33	33	set forth in the bill of rights of the constitution of the state of
34	34	Kansas.
35	35	"A vote against this proposition would continue the status quo
36	36	that the bill of rights will not contain a right to vote as a
37	37	specific political power inherent in the people. The
38	38	constitution of the state of Kansas will continue to contain
39	39	sections concerning voting, voter qualifications, filling
40	40	vacancies in elected offices, recall and mode of voting."

77	77	Sec. 3. This resolution, if approved by two-thirds of the members
78	78	elected (or appointed) and qualified to the Senate and two-thirds of the
79	79	members elected (or appointed) and qualified to the House of
80	80	Representatives, shall be entered on the journals, together with the yeas
81	81	and nays. The secretary of state shall cause this resolution to be published
82	82	as provided by law and shall cause the proposed amendment to be
83	83	submitted to the electors of the state at the general election in November
84	84	in the year 2024, unless a special election is called at a sooner date by
85	85	concurrent resolution of the legislature, in which case the proposed
86	86	amendment shall be submitted to the electors of the state at the special
87	87	election.
