| 8 | 8 | | election; amending K.S.A. 25-1132 and repealing the existing section. |

| 9 | 9 | | Be it enacted by the Legislature of the State of Kansas: |
|---|
| 10 | 10 | | Section 1. K.S.A. 25-1132 is hereby amended to read as follows: 25- |
|---|
| 11 | 11 | | 1132. (a) All advance voting ballots that are received in the office of the |
|---|
| 12 | 12 | | county election officer or any polling place within the county not later than |
|---|
| 13 | 13 | | the hour for closing of the polls on the date of any election specified in |
|---|
| 14 | 14 | | K.S.A. 25-1122(f), and amendments thereto, shall be delivered by the |
|---|
| 15 | 15 | | county election officer to the appropriate special election board provided |
|---|
| 16 | 16 | | for in K.S.A. 25-1133, and amendments thereto. |
|---|
| 17 | 17 | | (b) Subject to the deadline for receipt by the office of the county |
|---|
| 18 | 18 | | election officer as set forth in this subsection, all advance voting ballots |
|---|
| 19 | 19 | | received by mail by the office of the county election officer after the |
|---|
| 20 | 20 | | closing of the polls on the date of any election specified in K.S.A. 25- |
|---|
| 21 | 21 | | 1122(f), and amendments thereto, and which are postmarked or are |
|---|
| 22 | 22 | | otherwise indicated by the United States postal service to have been |
|---|
| 23 | 23 | | mailed on or before the close of the polls on the date of the election, shall |
|---|
| 24 | 24 | | be delivered by the county election officer to a special election board or |
|---|
| 25 | 25 | | the county board of canvassers, as determined by the secretary of state, for |
|---|
| 26 | 26 | | canvassing in a manner consistent, as nearly as may be, with other advance |
|---|
| 27 | 27 | | voting ballots. The deadline for the receipt by mail of the advance voting |
|---|
| 28 | 28 | | ballots by the office of the county election officer shall be the last delivery |
|---|
| 29 | 29 | | of mail by the United States postal service 7:00 p.m. on the third day |
|---|
| 30 | 30 | | following the date of the election. |
|---|
| 31 | 31 | | (c) The secretary of state shall adopt rules and regulations to |
|---|
| 32 | 32 | | implement this subsection section. |
|---|
| 33 | 33 | | Sec. 2. K.S.A. 25-1132 is hereby repealed. |

| 34 | 34 | | Sec. 3. This act shall take effect and be in force from and after its |
