6+AN ACT concerning drivers' training; relating to motorcycle instructors;
7+providing that driving school instructors may possess a motorcycle
8+driver's license from any state; amending K.S.A. 8-276 and repealing
9+the existing section.
610 Be it enacted by the Legislature of the State of Kansas:
7-Section 1. K.S.A. 8-276 is hereby amended to read as follows: 8-
8-276. (a) In order for a person to qualify as an instructor for a driving
9-school, such person shall meet the following requirements:

12+(a) In order for a person to qualify as an instructor for a driving school,
13+such person shall meet the following requirements:
1014 (a)(1) Present to the department evidence of:
1115 (1)(A) Credit in driver education and safety from an accredited
1216 college or university equivalent to credits in those subjects required of
1317 instructors in the schools accredited by the state board;
1418 (2)(B) having a valid credential issued by the state board to teach
1519 driver education; or
16-(3)(C) having completed at least 30 hours of classroom and 24
17-hours of behind the wheel training under the direct supervision of an
18-individual who is presently licensed as an instructor by the state board
19-under paragraph (1) subparagraph (A) or (2) (B) and who has been
20-continuously licensed and who has actively instructed students for a
21-period of at least three years;
20+(3)(C) having completed at least 30 hours of classroom and 24 hours
21+of behind the wheel training under the direct supervision of an individual
22+who is presently licensed as an instructor by the state board under
23+paragraph (1) subparagraph (A) or (2) (B) and who has been continuously
24+licensed and who has actively instructed students for a period of at least
25+three years;
2226 (b)(2) have knowledge of the Kansas operation lifesaver
2327 highway/railroad grade crossing safety program;
24-(c)(3) be physically able to operate safely a motor vehicle and to
25-train others in the operation of motor vehicles;
28+(c)(3) be physically able to operate safely a motor vehicle and to train
29+others in the operation of motor vehicles;
2630 (d)(4) provide a certificate of health from a medical doctor stating
27-that such person is physically and mentally able to safely operate a
28-motor vehicle;
29-(e)(5) hold a valid Kansas drivers' driver's license or driver's
30-license issued by any other state; and
31+that such person is physically and mentally able to safely operate a motor
32+vehicle;
33+(e)(5) except as otherwise provided in subsection (b), hold a valid
34+Kansas drivers' license; and
3135 (f)(6) pay to the department an application fee of $5.
3236 (b) For a motorcycle instructor subject to the provisions of this
3337 section, such motorcycle instructor shall be required to:
34-(1) Have successfully completed all requirements of this section;

3775 allowing such individual to operate a motorcycle for another state.
38-Sec. 2. K.S.A. 8-276 is hereby repealed. HOUSE BILL No. 2031—page 2

3977 Sec. 3. This act shall take effect and be in force from and after its
