2-AN ACT concerning economic development; relating to tourism; increasing the
3-membership of the council on travel and tourism appointed by the governor and
4-updating the house committee assignment required for the house members of the
5-council from the committee on agriculture and natural resources to the committee on
6-commerce, labor and economic development; removing the restriction on the
7-percentage of such funds granted to any single entity or type of entity; amending
8-K.S.A. 2024 Supp. 32-1410 and 32-1420 and repealing the existing sections.

7+increasing the membership of the council on travel and tourism
8+appointed by the governor and updating the house committee
9+assignment required for the house members of the council from the
10+committee on agriculture and natural resources to the committee on
11+commerce, labor and economic development; equalizing the allocation
12+of funds from the department of commerce's matching grant program
13+for the promotion of tourism for private, public and nonprofit entities
14+and removing the restriction on the percentage of such funds granted to
15+a single entity; amending K.S.A. 2024 Supp. 32-1410 and 32-1420 and
16+repealing the existing sections.
917 Be it enacted by the Legislature of the State of Kansas:
10-Section 1. K.S.A. 2024 Supp. 32-1410 is hereby amended to read
11-as follows: 32-1410. (a) (1) There is hereby established the council on
12-travel and tourism. The council shall consist of 17 20 voting members
13-as follows:
14-(A) The chairperson of the standing senate committee on
15-commerce of the senate, or a member of the senate appointed by the
16-president of the senate;
18+Section 1. K.S.A. 2024 Supp. 32-1410 is hereby amended to read as
19+follows: 32-1410. (a) (1) There is hereby established the council on travel
20+and tourism. The council shall consist of 17 20 voting members as follows:
21+(A) The chairperson of the standing senate committee on commerce
22+of the senate, or a member of the senate appointed by the president of the
23+senate;
1724 (B) the vice chairperson of the standing senate committee on
1825 commerce of the senate, or a member of the senate appointed by the
1926 president of the senate;
20-(C) the ranking minority member of the standing senate
21-committee on commerce of the senate, or a member of the senate
22-appointed by the minority leader of the senate;
27+(C) the ranking minority member of the standing senate committee
28+on commerce of the senate, or a member of the senate appointed by the
29+minority leader of the senate;
2330 (D) the chairperson of the standing house of representatives
2431 committee on agriculture and natural resources of the house of
2532 representatives commerce, labor and economic development, or its
2633 successor committee, or a member of the house of representatives
2734 appointed by the speaker of the house of representatives;
2835 (E) the vice chairperson of the standing house of representatives
2936 committee on agriculture and natural resources of the house of
3037 representatives commerce, labor and economic development, or its
3138 successor committee, or a member of the house of representatives
3239 appointed by the speaker of the house of representatives;

3375 (F) the ranking minority member of the standing house of
3476 representatives committee on agriculture and natural resources of the
35-house of representatives commerce, labor and economic development,
36-or its successor committee, or a member of the house of representatives
77+house of representatives commerce, labor and economic development, or
78+its successor committee, or a member of the house of representatives
3779 appointed by the minority leader of the house of representatives; and
38-(G) elevenfourteen members appointed by the governor. Of the 11
39-14 members appointed by the governor, one six shall be appointed to
40-represent the general public and eight shall be appointed to represent
41-the organizations specified in this subparagraph, respectively. The
42-appointment of a representative of an organization shall be made from
43-a list of three nominations made submitted by the organization as
44-follows:
80+(G) elevenfourteen members appointed by the governor. Of the 11 14
81+members appointed by the governor, one six shall be appointed to
82+represent the general public and eight shall be appointed to represent the
83+organizations specified in this subparagraph, respectively. The
84+appointment of a representative of an organization shall be made from a

4586 (i) The travel industry association of Kansas, one shall be an
4687 individual engaged in the lodging industry and appointed from a list of
4788 three nominations made by;
48-(ii) the Kansas restaurant and hospitality association, one shall be
49-an individual engaged in the restaurant industry and appointed from a
50-list of three nominations made by the Kansas restaurant and hospitality
51-association, one shall be appointed from a list of three nominations
52-made by for two representatives, one whose nominees shall be
53-individuals engaged in the lodging industry and the second whose
54-nominees shall be individuals engaged in the restaurant industry;
89+(ii) the Kansas restaurant and hospitality association, one shall be an
90+individual engaged in the restaurant industry and appointed from a list of
91+three nominations made by the Kansas restaurant and hospitality
92+association, one shall be appointed from a list of three nominations made
93+by for two representatives, one whose nominees shall be individuals
94+engaged in the lodging industry and the second whose nominees shall be
95+individuals engaged in the restaurant industry;
5596 (iii) the petroleum marketers and convenience store association of
5697 Kansas, one shall be appointed from a list of three nominations by;
57-(iv) the Kansas sport hunting association and six shall be
58-appointed to represent the general public;
59-(v) the national independent venue association, whose nominees
60-shall be Kansas residents;
98+(iv) the Kansas sport hunting association and six shall be appointed to
99+represent the general public;
100+(v) the national independent venue association, whose nominees shall
101+be Kansas residents;
61102 (vi) the Kansas museums association; and
62103 (vii) the Kansas sampler foundation.
63-(2) In addition to the voting members of the council, four
64-members of the council shall serve ex officio: The secretary of
65-commerce, the secretary of transportation, the secretary of wildlife and HOUSE BILL No. 2037—page 2
66-parks and the executive director of the state historical society. Each ex
67-officio member of the council may designate an officer or employee of
68-the state agency of the ex officio member to serve on the council in
69-place of the ex officio member. The ex officio members of the council,
70-or their designees, shall be nonvoting members of the council and shall
71-provide information and advice to the council.
72-(b) Legislator members shall be appointed for terms coinciding
73-with the terms for which such members are elected. Of the 11 members
74-first appointed by the governor, six shall be appointed for terms of three
75-years and five shall be appointed for terms of two years as determined
76-by the governor. Thereafter, All members appointed by the governor
77-shall be appointed for terms of three years. All members appointed to
78-fill vacancies in the membership of the council and all members
79-appointed to succeed members appointed to membership on the council
80-shall be appointed in like manner as that provided for the original
81-appointment of the member succeeded.
82-(c) On July 1 of each year, the council shall elect a chairperson
83-and vice-chairperson vice chairperson from among its members. The
84-council shall meet at least four times each year at the call of the
85-chairperson of the council. Nine Eleven voting members of the council
86-shall constitute a quorum.
104+(2) In addition to the voting members of the council, four members of
105+the council shall serve ex officio: The secretary of commerce, the secretary
106+of transportation, the secretary of wildlife and parks and the executive
107+director of the state historical society. Each ex officio member of the

161+appointed for terms of three years. All members appointed to fill vacancies
162+in the membership of the council and all members appointed to succeed
163+members appointed to membership on the council shall be appointed in
164+like manner as that provided for the original appointment of the member
165+succeeded.
166+(c) On July 1 of each year, the council shall elect a chairperson and

90-and amendments thereto, or a lesser amount as determined by the
91-secretary of commerce. Amounts paid under this subsection to ex
92-officio members of the council, or their designees, shall be from
93-appropriations to the state agencies, of which such members are
94-officers or employees, upon warrants of the director of accounts and
95-reports issued pursuant to vouchers approved by the chief
96-administrative officers of such agencies. Amounts paid under this
97-subsection to voting members of the council shall be from moneys
98-available for the payment of such amounts upon warrants of the
99-director of accounts and reports issued pursuant to vouchers approved
100-by the chairperson of the council.

180+paid under this subsection to voting members of the council shall be from
181+moneys available for the payment of such amounts upon warrants of the
182+director of accounts and reports issued pursuant to vouchers approved by
183+the chairperson of the council.
101184 Sec. 2. K.S.A. 2024 Supp. 32-1420 is hereby amended to read as
102185 follows: 32-1420. (a) There is hereby established a state matching grant
103186 program to provide assistance in the promotion of tourism and
104187 development of quality tourist attractions within the state of Kansas.
105-Grants awarded under this program shall be limited to not more than
106-40% of the cost of any proposed project. Applicants shall not utilize
107-any state moneys to meet the matching requirements under the
108-provisions of this program. Both public and private entities shall be
109-eligible to apply for a grant under the provisions of this act. Not less
110-than 75% of all moneys granted under this program shall be allocated
111-to public entities or entities exempt from taxation under the provisions
112-of 501(c)(3) of the federal internal revenue code of 1986, and
113-amendments thereto. No more than 20% of moneys granted to public or
114-nonprofit entities shall be granted to any single such entity.
115-Furthermore, no more than 20% of moneys granted to private entities
116-shall be granted to any single such entity. The secretary of commerce
117-shall administer the provisions of this act and the secretary may adopt
118-rules and regulations establishing criteria for qualification for a
119-matching grant and such other matters deemed necessary by the
120-secretary for the administration of this act.

193+moneys granted under this program shall be allocated to public entities or
194+entities exempt from taxation under the provisions of 501(c)(3) of the
195+federal internal revenue code of 1986, and amendments thereto. No more
196+than 20% of moneys granted to public or nonprofit entities shall be granted
197+to any single such entity. Furthermore, no more than 20% of moneys
198+granted to private entities shall be granted to any single such entity. The
199+secretary of commerce shall administer the provisions of this act and the
200+secretary may adopt rules and regulations establishing criteria for
201+qualification for a matching grant and such other matters deemed
202+necessary by the secretary for the administration of this act.
121203 (b) For the purpose of K.S.A. 32-1420 through 32-1422, and
122-amendments thereto, "tourist attraction" means a site that is of
123-significant interest to tourists as a historic, cultural, scientific,
124-educational, recreational or architecturally unique site, or as a site of HOUSE BILL No. 2037—page 3
125-natural scenic beauty or an area naturally suited for outdoor recreation,
126-however, except that under no circumstances shall "tourist attraction"
127-mean a race track facility, as defined in K.S.A. 74-8802, and
128-amendments thereto, or any casino or other establishment that operates
129-class three games, as defined in 25 U.S.C. § 2703, as in effect on July
130-1, 1991.
131-Sec. 3. K.S.A. 2024 Supp. 32-1410 and 32-1420 are hereby
132-repealed.

247+amendments thereto, "tourist attraction" means a site that is of significant
248+interest to tourists as a historic, cultural, scientific, educational,
249+recreational or architecturally unique site, or as a site of natural scenic
250+beauty or an area naturally suited for outdoor recreation, however, except
251+that under no circumstances shall "tourist attraction" mean a race track
252+facility, as defined in K.S.A. 74-8802, and amendments thereto, or any
253+casino or other establishment that operates class three games, as defined in
254+25 U.S.C. § 2703, as in effect on July 1, 1991.
255+Sec. 3. K.S.A. 2024 Supp. 32-1410 and 32-1420 are hereby repealed.
133256 Sec. 4. This act shall take effect and be in force from and after its
134257 publication in the statute book.
