7+AN ACT concerning the state corporation commission; relating to electric
8+transmission line siting permits; extending the time in which the
9+commission shall make a final order on an electric transmission line
10+siting application; amending K.S.A. 66-1,178 and repealing the existing
11+section.
612 Be it enacted by the Legislature of the State of Kansas:
7-Section 1. K.S.A. 66-1,178 is hereby amended to read as follows:
8-66-1,178. (a) No electric utility may begin site preparation for or
9-construction of an electric transmission line, or exercise the right of
10-eminent domain to acquire any interest in land in connection with the
11-site preparation for a construction of any such line without first
12-acquiring a siting permit from the commission. Whenever any electric
13-utility desires to obtain such a permit, the utility shall file an application
14-with the commission setting forth therein that the utility proposes to
15-construct an electric transmission line and specifying:
13+Section 1. K.S.A. 66-1,178 is hereby amended to read as follows: 66-
14+1,178. (a) No electric utility may begin site preparation for or construction
15+of an electric transmission line, or exercise the right of eminent domain to
16+acquire any interest in land in connection with the site preparation for a
17+construction of any such line without first acquiring a siting permit from
18+the commission. Whenever any electric utility desires to obtain such a
19+permit, the utility shall file an application with the commission setting
20+forth therein that the utility proposes to construct an electric transmission
21+line and specifying:
1622 (1) The proposed location thereof;
17-(2) the names and addresses of the landowners of record whose
18-land or interest therein is proposed to be acquired in connection with
19-the construction of or is located within 660 feet of the center line of the
23+(2) the names and addresses of the landowners of record whose land
24+or interest therein is proposed to be acquired in connection with the
25+construction of or is located within 660 feet of the center line of the
2026 easement where the line is proposed to be located; and
2127 (3) such other information as may be required by the commission.
22-(b) Upon the filing of an application pursuant to subsection (a),
23-the commission shall fix a time for a public hearing on such
24-application, which shall be not more than 90 days after the date the
25-application was filed, to determine the necessity for and the
26-reasonableness of the location of the proposed electric transmission
27-line. The commission shall fix the place for hearing, which shall be in
28-one of the counties through which the electric transmission line is
29-proposed to traverse.
28+(b) Upon the filing of an application pursuant to subsection (a), the
29+commission shall fix a time for a public hearing on such application,
30+which shall be not more than 90 days after the date the application was
31+filed, to determine the necessity for and the reasonableness of the location
32+of the proposed electric transmission line. The commission shall fix the
33+place for hearing, which shall be in one of the counties through which the
34+electric transmission line is proposed to traverse.
3035 (c) The commission may conduct an evidentiary hearing on an
3136 application filed pursuant to this section at such time and place as the
3237 commission deems appropriate.
33-(d) The commission shall issue a final order on the application
34-within 120 180 days after the date the application was filed.

3574 Sec. 2. K.S.A. 66-1,178 is hereby repealed.
3675 Sec. 3. This act shall take effect and be in force from and after its
37-publication in the Kansas register.
