| 6 | 6 | | AN ACT concerning insurance; relating to travel insurance; authorizing |

| 7 | 7 | | insurers to file certain travel insurance policies under the accident and |
|---|
| 8 | 8 | | health line of insurance; amending K.S.A. 2024 Supp. 40-2,239 and |

| 9 | 9 | | repealing the existing section. |

| 10 | 10 | | Be it enacted by the Legislature of the State of Kansas: |
|---|
| 11 | 11 | | Section 1. K.S.A. 2024 Supp. 40-2,239 is hereby amended to read as |
|---|
| 12 | 12 | | follows: 40-2,239. (a) Notwithstanding any other provision of chapter 40 |
|---|
| 13 | 13 | | of the Kansas Statutes Annotated, and amendments thereto, travel |
|---|
| 14 | 14 | | insurance shall be classified and filed for purposes of rates and forms |
|---|
| 15 | 15 | | under an inland marine line of insurance. Travel insurance that provides |
|---|
| 16 | 16 | | coverage for sickness, accident, disability or death occurring during |
|---|
| 17 | 17 | | travel either exclusively, or in conjunction with related coverages of |
|---|
| 18 | 18 | | emergency evacuation or repatriation of remains, may be classified and |
|---|
| 19 | 19 | | filed under either an accident and health or an inland marine line of |
|---|
| 20 | 20 | | insurance. |
|---|
| 21 | 21 | | (b) Travel insurance may be in the form of an individual, group or |
|---|
| 22 | 22 | | blanket policy. |
|---|
| 23 | 23 | | (c) Eligibility and underwriting standards for travel insurance may be |
|---|
| 24 | 24 | | developed and provided based on travel protection plans designed for |
|---|
| 25 | 25 | | individual or identified marketing or distribution channels, provided if |
|---|
| 26 | 26 | | those standards also meet underwriting standards of the state for inland |
|---|
| 27 | 27 | | marine insurance. |
|---|
| 28 | 28 | | Sec. 2. K.S.A. 2024 Supp. 40-2,239 is hereby repealed. |

| 29 | 29 | | Sec. 3. This act shall take effect and be in force from and after its |
|---|
| 30 | 30 | | publication in the statute book. |
