6	6	AN ACT concerning national land designations; requiring legislative
7	7	approval of any designation of a national heritage area or national
8	8	historic trail in the state of Kansas or the inclusion of certain property
9	9	within any such designation; prohibiting state funding of any national
10	10	heritage area or national historic trail unless such funding is first
11	11	approved by the legislature of the state of Kansas.
12	12	WHEREAS, National heritage areas and national historic trails are
13	13	designated by the United States congress as places where natural, cultural
14	14	and historic resources form a nationally important landscape; and
15	15	WHEREAS, The proposed boundaries for areas and trail designations
16	16	can include federal, state and private property; and
17	17	WHEREAS, The State of Kansas and private property owners have no
18	18	ability to remove their property from this designation; and
19	19	WHEREAS, A national heritage area or national historic trail
20	20	designation is a federal legislative process with no application or
21	21	nomination process; and
22	22	WHEREAS, National heritage area and national historic trail
23	23	designations are managed or controlled by a private, unelected,
24	24	unaccountable entity and interferes with state and private property rights;
25	25	and
26	26	WHEREAS, There is significant opposition to including private
27	27	property in a national heritage area or national historic trail upon discovery
28	28	by members of a community; and
29	29	WHEREAS, National heritage areas are administered by the national
30	30	park service, and national historic trails are administered by the national
31	31	park service, the United States department of agriculture forest service and
32	32	the bureau of land management, depending on the trail; and
33	33	WHEREAS, National designations can accept and administer money
34	34	paid by the United States secretary of the interior; and
35	35	WHEREAS, Financial assistance components, legal agreements,
36	36	accountability measures and performance requirements for national
37	37	heritage areas and national historic trails can create undue burdens for state
38	38	and private property under federal oversight.

75	75	Be it enacted by the Legislature of the State of Kansas:
76	76	Section 1. (a) Designation by the United States national park service
77	77	of any national heritage area or national historic trail, pursuant to 54
78	78	U.S.C. 300101 et seq., that extends beyond federal land within the state of
79	79	Kansas shall require the approval of the legislature of the state of Kansas
80	80	through the adoption of a concurrent resolution.
81	81	(b) State funds shall not be expended or transferred from state
82	82	agencies to match federal moneys for national heritage areas, national
83	83	historic trails or any similar or successor designated areas without the
84	84	approval of the legislature of the state of Kansas through the adoption of a
85	85	concurrent resolution.
86	86	(c) State lands, water, property or facilities shall not be included in
87	87	any designated national heritage area, national historic trail or any similar
88	88	or successor designated areas without the approval of the legislature of the
89	89	state of Kansas through the adoption of a concurrent resolution.
90	90	Sec. 2. This act shall take effect and be in force from and after its
91	91	publication in the statute book.
