6+AN ACT concerning elections; relating to campaign contribution limits;
7+increasing the limits on certain campaign contributions; eliminating
8+such limits on contributions to party committees; amending K.S.A. 25-
9+4153 and repealing the existing section.
510 Be it enacted by the Legislature of the State of Kansas:
6-Section 1. K.S.A. 25-4153 is hereby amended to read as follows:
7-25-4153. (a) The aggregate amount contributed to a candidate and such
8-candidate's candidate committee and to all party committees and
9-political committees and dedicated to such candidate's campaign, by
10-any political committee or any person except a party committee, the
11-candidate or the candidate's spouse, shall not exceed the following:
12-(1) For the pair of offices of governor and lieutenant governor or
13-for other state officers elected from the state as a whole, $2,000 $4,000
14-for each primary election (, or in lieu thereof, a caucus or convention of
15-a political party), and an equal amount for each general election.
16-(2) For the office of member of the house of representatives,
17-district judge, district magistrate judge, district attorney or a candidate
18-for local office whose jurisdiction has a population that is fewer than
19-50,000, $500 $1,000 for each primary election (, or in lieu thereof, a

2028 caucus or convention of a political party), and an equal amount for each

22-(3) For the office of state senator or, member of the state board of
23-education or a candidate for local office whose jurisdiction has a
24-population that is 50,000 or more, $1,000 $2,000 for each primary
25-election (, or in lieu thereof, a caucus or convention of a political
26-party), and an equal amount for each general election.
27-(b) For the purposes of this section, the face value of a loan at the
28-end of the period of time allocable to the primary or general election is
29-the amount subject to the limitations of this section. A loan in excess of
30-the limits herein provided may be made during the allocable period if
31-such loan is reduced to the permissible level, when combined with all
32-other contributions from the person making such loan, at the end of
33-such allocable period.
30+(b) For the purposes of this section, the face value of a loan at the end
31+of the period of time allocable to the primary or general election is the
32+amount subject to the limitations of this section. A loan in excess of the
33+limits herein provided may be made during the allocable period if such
34+loan is reduced to the permissible level, when combined with all other
35+contributions from the person making such loan, at the end of such
36+allocable period.
3437 (c) For the purposes of this section, all contributions made by
3538 unemancipated children under 18 years of age shall be considered to be
3639 contributions made by the parent or parents of such children. The total
37-amount of such contribution shall be attributed to a single custodial
38-parent and 50% of such contribution to each of two parents.
39-(d) The aggregate amount contributed to a state party committee
40-by a person other than a national party committee or a political
41-committee shall not exceed $15,000 in each calendar year; and the
42-aggregate amount contributed to any other party committee by a person
43-other than a national party committee or a political committee shall not
44-exceed $5,000 in each calendar year.
45-The aggregate amount contributed by a national party committee to
46-a state party committee shall not exceed $25,000 in any calendar year,
47-and the aggregate amount contributed to any other party committee by
48-a national party committee shall not exceed $10,000 in any calendar
49-year.
50-The aggregate amount contributed to a party committee by a
51-political committee shall not exceed $5,000 in any calendar year.
52-(e) (1) The aggregate amount contributed to a party committee,
53-as defined in K.S.A. 25-4143(j)(1), (4) or (5), and amendments thereto,
54-by a person other than a party committee shall not exceed $35,000 in
55-each calendar year.
56-(2) The aggregate amount contributed by a national party
57-committee to a party committee, as defined in K.S.A. 25-4143(j)(1), (4)
58-or (5), and amendments thereto, shall not exceed $35,000 in any

75+amount of such contribution shall be attributed to a single custodial parent
76+and 50% of such contribution to each of two parents.
77+(d) The aggregate amount contributed to a state party committee by a
78+person other than a national party committee or a political committee shall
79+not exceed $15,000 in each calendar year; and the aggregate amount
80+contributed to any other party committee by a person other than a national
81+party committee or a political committee shall not exceed $5,000 in each

61-defined in K.S.A. 25-4143(j)(2) or (6), and amendments thereto, by a
62-person other than a party committee shall not exceed $10,000 in each
63-calendar year.
64-(4) The aggregate amount contributed by a national party
65-committee to any party committee, as defined in K.S.A. 25-4143(j)(2)
66-or (6), and amendments thereto, shall not exceed $10,000 in any
67-calendar year.
68-(e) The amount contributed by each individual party committee of
69-the same political party, other than a national party committee, to any
70-candidate for office for any primary election at which two or more
71-candidates are seeking the nomination of such party shall not exceed
72-the following:
73-(1) For the pair of offices of governor and lieutenant governor
74-and for each of the other state officers elected from the state as a
75-whole, $4,000 for each primary election, or in lieu thereof, a caucus or
76-convention of a political party.
77-(2) For the office of member of the house of representatives,
78-district judge, district magistrate judge, district attorney or a candidate
79-for local office whose jurisdiction has a population that is fewer than
80-50,000, $1,000 for each primary election, or in lieu thereof, a caucus
81-or convention of a political party.
82-(3) For the office of state senator, member of the state board of
83-education or a candidate for local office whose jurisdiction has a
84-population that is 50,000 or more, $2,000 for each primary election, or
85-in lieu thereof, a caucus or convention of a political party.
86-(f) No expenditures made by a party committee in support of a
87-candidate, with or without such candidate's cooperation or consent,
88-shall constitute a contribution.
89-(g) No person shall make any contribution or contributions to any
90-candidate or the candidate committee of any candidate in the form of
91-money or currency of the United States that in the aggregate exceeds
92-$200 for any one primary or general election. No candidate or
93-candidate committee of any candidate shall accept any contribution or
94-contributions in the form of money or currency of the United States that
95-in the aggregate exceeds $200 from any one person for any one
96-primary or general election.
97-(h) (1) If a candidate or a candidate's candidate committee
98-receives contributions prior to the date of the primary election and
99-such contributions are designated for use in connection with the
100-general election, such candidate or such committee shall use an
101-acceptable accounting method to distinguish between contributions
102-received for the primary election and contributions received for the
103-general election. Acceptable accounting methods include, but are not
104-limited to:
105-(A) The designation of separate accounts for each election; or
106-(B) the establishment of separate books and records for each
107-election.
108-(2) Under any acceptable accounting method, the authorized
109-records of a candidate or candidate committee shall demonstrate that,
110-prior to the primary election, the recorded amount of cash on hand was
111-at all times equal to or in excess of an amount equal to the sum of the
112-contributions received and designated for use in connection with the
113-general election less the sum of disbursements made for the general
114-election.
115-(i) For purposes of this section, "jurisdiction" means:
116-(1) The city, county or school district if the candidate is seeking
117-election to a local office that is elected at large in such city, county or
118-school district; and
119-(2) the electoral district if the candidate is seeking election as a
120-member of a governing body that has member districts.
121-(j) Any political funds which that have been collected and were
122-not subject to the reporting requirements of this act shall be deemed a
123-person subject to these contribution limitations.

125-subject to the reporting requirements of the campaign finance act shall
126-not be used in or for the campaign of a candidate for a federal elective
127-office.
128-(g) The amount contributed by each individual party committee of

161+candidate or candidate committee of any candidate shall accept any

155165 Sec. 2. K.S.A. 25-4153 is hereby repealed.
