55 AN ACT concerning pharmacists and pharmacy; relating to HIV post-
66 exposure prophylaxis; requiring the state board of pharmacy to issue
77 protocol for pharmacists to dispense post-exposure prophylaxis to
88 certain individuals.
99 Be it enacted by the Legislature of the State of Kansas:
1010 Section 1. (a) As used in this section:
1111 (1) "HIV" means the human immunodeficiency virus.
1212 (2) "Patient" means an individual believed to have been exposed to
1313 HIV.
1414 (3) "Post-exposure prophylasis" means a drug or drug combination
1515 that meets the clinical eligibility recommendations of the United States
1616 centers for disease control and prevention guidelines for antiretroviral
1717 treatment following exposure to HIV.
1818 (b) (1) The state board of pharmacy shall issue a statewide post-
1919 exposure prophylaxis protocol for individuals who have been exposed to
2020 HIV that establishes requirements for a licensed pharmacist to initiate
2121 prophylactic therapy to a patient pursuant to this section. The protocol for
2222 post-exposure to HIV shall include procedures to ensure accurate
2323 recordkeeping and the education of the patient to whom post-exposure
2424 prophylaxis is initiated, including, but not limited to, the importance of
2525 receiving post-exposure prophylaxis as soon as possible after exposure,
2626 safe administration of post-exposure prophylaxis and potential
2727 contraindications, side effects or adverse events that may occur as a result
2828 of such medication, advising the patient to whom post-exposure
2929 prophylaxis is initiated to seek follow-up care from a physician and any
3030 other criteria as established by the board.
3131 (2) A pharmacist may initiate prophylactic therapy within the
3232 framework of the statewide protocol for post-exposure to HIV pursuant to
3333 paragraph (1).
3434 (c) A pharmacist initiating post-exposure prophylaxis pursuant to this
3535 section shall not permit the patient to whom post-exposure prophylaxis is
3636 initiated to wave any consultation required by this section or any other
3737 rules and regulations adopted thereunder.
3838 (d) Any pharmacist who, in good faith and with reasonable care,
3939 initiates post-exposure prophylactic therapy to a patient pursuant to this

7676 section shall not, by an act or omission, be subject to civil liability,
7777 criminal prosecution or any disciplinary or other adverse action by a
7878 professional licensing entity arising from the pharmacist initiating the
7979 post-exposure prophylaxis.
8080 (e) The state board of pharmacy shall adopt rules and regulations as
8181 may be necessary to implement the provisions of this section prior to
8282 January 1, 2026.
8383 (f) This section shall be a part of and supplemental to the pharmacy
8484 act of the state of Kansas.
8585 Sec. 2. This act shall take effect and be in force from and after its
8686 publication in the statute book.
