| 6 | 6 | | AN ACT concerning firearms; relating to municipal regulation thereof; |

| 7 | 7 | | authorizing cities and counties to regulate the sale and purchase of |

| 8 | 8 | | firearms and ammunition within a building owned by such city or |
|---|
| 9 | 9 | | county; amending K.S.A. 12-16,124 and repealing the existing section. |

| 10 | 10 | | Be it enacted by the Legislature of the State of Kansas: |
|---|
| 11 | 11 | | Section 1. K.S.A. 12-16,124 is hereby amended to read as follows: |
|---|
| 12 | 12 | | 12-16,124. (a) No city or county shall adopt or enforce any ordinance, |
|---|
| 13 | 13 | | resolution or regulation, and no agent of any city or county shall take any |
|---|
| 14 | 14 | | administrative action, governing the requirement of fees, licenses or |
|---|
| 15 | 15 | | permits for, the commerce in or the sale, purchase, transfer, ownership, |
|---|
| 16 | 16 | | storage, carrying, transporting or taxation of firearms or ammunition, or |
|---|
| 17 | 17 | | any component or combination thereof. |
|---|
| 18 | 18 | | (b) Any ordinance, resolution or regulation prohibited by subsection |
|---|
| 19 | 19 | | (a) that was adopted prior to July 1, 2015, shall be null and void. |
|---|
| 20 | 20 | | (c) Nothing in this section shall: |
|---|
| 21 | 21 | | (1) Prohibit a city or county from adopting and enforcing any |
|---|
| 22 | 22 | | ordinance, resolution or regulation relating to the personnel policies of |
|---|
| 23 | 23 | | such city or county and the carrying of firearms by employees of such city |
|---|
| 24 | 24 | | or county, except that any such ordinance, resolution or regulation shall |
|---|
| 25 | 25 | | comply with the provisions of K.S.A. 75-7c01 et seq., and amendments |
|---|
| 26 | 26 | | thereto; |
|---|
| 27 | 27 | | (2) prohibit a city or county from adopting any ordinance, resolution |
|---|
| 28 | 28 | | or regulation pursuant to K.S.A. 75-7c20, and amendments thereto; |
|---|
| 29 | 29 | | (3) prohibit a law enforcement officer, as defined in K.S.A. 22-2202, |
|---|
| 30 | 30 | | and amendments thereto, from acting within the scope of such officer's |
|---|
| 31 | 31 | | duties; or |
|---|
| 32 | 32 | | (4) prohibit a city or county from levying and collecting any retailers' |
|---|
| 33 | 33 | | sales tax on the sale of firearms, ammunition or any component or |
|---|
| 34 | 34 | | combination thereof as authorized by K.S.A. 12-189, and amendments |
|---|
| 35 | 35 | | thereto; or |
|---|
| 36 | 36 | | (5) prohibit a city or county from adopting and enforcing any |
|---|
| 37 | 37 | | ordinance, resolution or regulation relating to the sale or purchase of |
|---|
| 38 | 38 | | firearms or ammunition, or any component or combination thereof, within |
|---|
| 39 | 39 | | any building owned by such city or county. |
