8+replacement fund to be administered by the secretary of revenue;
9+depositing the fees from the blackout license plate into such fund for
10+purposes of replacing exhausted license plates.
511 Be it enacted by the Legislature of the State of Kansas:
6-Section 1. K.S.A. 2024 Supp. 58-2011 is hereby amended to read
7-as follows: 58-2011. (a) Whenever a survey originates from a United
8-States public land survey corner or any related accessory, the land
9-surveyor shall file a reference report for each corner or accessory with
10-the secretary of the state historical society and with the county surveyor
11-for the county or counties in which the survey corner exists. If there is
12-no county surveyor of such county, such reference report shall be filed
13-with the county engineer. If there is no county engineer, such report
14-shall be filed in the office of the county road department or in a county
15-office designated by the county commission. Reports filed with the
16-secretary of the state historical society may be filed and retrieved using
17-electronic technologies if authorized by the secretary. Such report shall
18-be filed within 30 90 days of the date the references are made. At the
19-time of filing such report with the secretary of the state historical
20-society, the land surveyor shall pay a filing fee in an amount fixed by
21-rules and regulations of the secretary of the state historical society. Fees
22-charged for filing and retrieval of such reports may be billed and paid
23-periodically.
24-(b) Any person engaged in an activity in which a United States
25-public land survey corner or any related accessory is likely to be
26-altered, removed, damaged or destroyed, shall have a person qualified
27-to practice land surveying establish such reference points as necessary
28-for the restoration, reestablishment or replacement of the corner or
29-accessory. The land surveyor shall file a reference report with the
30-secretary of the state historical society and with the county surveyor for
31-the county or counties in which the survey corner exists. Such report
32-shall be filed within 30 90 days of the date the references are made. At
33-the time of filing such report with the secretary of the state historical
34-society, the land surveyor shall pay a filing fee in an amount fixed by
35-rules and regulations of the secretary of the state historical society.
36-(c) Upon completion of the activity likely to alter, remove,
37-damage or destroy the public land survey corner or related accessory,
38-the land surveyor shall review the survey corner and its accessories. If
39-the survey corner or any accessory has been altered, removed, damaged
40-or destroyed, the land surveyor shall replace the corner or accessory
41-with a survey monument and file a restoration report with the secretary
42-of the state historical society and the county surveyor in the county or
43-counties in which it existed. If the survey corner and accessories are not
44-damaged during the activity, a restoration report so stating shall be filed
45-with the secretary of the state historical society and county surveyor's
46-office. Such report shall be filed within 30 90 days after the activity is
47-completed. At the time of filing such report with the office of the
48-secretary of the state historical society the land surveyor shall pay a
49-filing fee in an amount fixed by rules and regulations of the secretary of
50-the state historical society.
51-(d) Failure to comply with the filing requirements of this section
52-shall be grounds for the suspension or revocation of the land surveyor's
53-license.
54-(e) The secretary of the state historical society may produce,
55-reproduce and sell maps, plats, reports, studies and records relating to
56-land surveys. The secretary of the state historical society shall charge a
57-fee in an amount to be fixed by rules and regulations of the secretary
58-for the furnishing of information retrieved from records filed pursuant
59-to this section and for reproductions or copies of maps, plats, reports,
60-studies and records filed in such office.
61-(f) All moneys collected by the secretary of the state historical
62-society under the provisions of this section shall be remitted to the state
63-treasurer in accordance with the provisions of K.S.A. 75-4215, and
64-amendments thereto. Upon receipt of each such remittance, the state HOUSE BILL No. 2168—page 2
65-treasurer shall deposit the entire amount in the state treasury. Ten
66-percent of each such deposit shall be credited to the state general fund
67-and the balance shall be credited to the land survey fee fund, which is
68-hereby created. All expenditures from such fund shall be made in
69-accordance with appropriation acts upon warrants approved by the
70-secretary of the state historical society or a person designated by the
71-secretary of the state historical society and shall be used only for the
72-purpose of paying the costs incurred in administering the provisions of
73-this act. After the effective date of this act, any reference to the
74-secretary of state in regard to appropriations to the land survey fee fund
75-shall be deemed to refer to the secretary of the state historical society.
76-(g) The failure of any person to have a land surveyor establish
77-reference points as required by subsection (b) shall be a class C
78-misdemeanor.
79-Sec. 2. K.S.A. 2024 Supp. 58-2011 is hereby repealed.
80-Sec. 3. This act shall take effect and be in force from and after its
12+Section 1. (a) On and after January 1, 2026, any owner or lessee of
13+one or more passenger vehicles or trucks registered for a gross weight of
14+20,000 pounds or less, who is a resident of Kansas, upon compliance with
15+the provisions of this section, may be issued one blackout license plate for
16+each such passenger vehicle or truck. Such license plate shall be issued for
17+the same period of time as other license plates upon proper registration and
18+payment of the regular license fee as provided in K.S.A. 8-143, and
19+amendments thereto.
20+(b) Any applicant or renewal of registration for a blackout license
21+plate authorized by this section shall pay an annual fee of $50 to the
22+county treasurer for each such license plate to be issued. Any new blackout
23+license plate shall be subject to the fee prescribed in K.S.A 8-1,141(a)(1),
24+and amendments thereto. A blackout license plate may be a personalized
25+license plate and subject to the personalized license plate fee pursuant to
26+K.S.A. 8-1,141(a)(2), and amendments thereto.
27+(c) Any applicant for a license plate authorized by this section may
28+make application for such license plate on a form prescribed and furnished
29+by the director of vehicles. Application for registration of a passenger
30+vehicle or truck and issuance of the license plate under this section shall be
31+made by the owner or lessee in a manner prescribed by the director of
32+vehicles upon forms furnished by the director.
33+(d) No registration or license plate issued under this section shall be
34+transferable to any other person.
35+(e) The director of vehicles may transfer a blackout license plate from
36+a leased vehicle to a purchased vehicle.
37+(f) Renewals of registration under this section shall be made annually,
38+upon payment of the fee prescribed in K.S.A. 8-143, and amendments
39+thereto, and in the manner prescribed in K.S.A. 8-132, and amendments

75+thereto. No renewal of registration shall be made to any applicant until
76+such applicant has paid the fee provided in subsection (b). If such fee is
77+not paid, such applicant shall be required to comply with K.S.A. 8-143,
78+and amendments thereto, and return the license plate to the county
79+treasurer of such applicant's residence.
80+(g) The blackout license plate shall have a background design, an
81+emblem or colors that designate the license plate as a blackout license
82+plate.
83+(h) There is hereby established in the state treasury the license plate
84+replacement fund. The license plate replacement fund shall be
85+administered by the secretary of revenue. All expenditures from such fund
86+shall be for the costs associated with replacing license plates when the
87+lifespan of such license plates has been exhausted as determined by the
88+director of vehicles. All expenditures from such fund shall be made in
89+accordance with appropriation acts upon warrants of the director of
90+accounts and reports issued pursuant to vouchers approved by the
91+secretary of revenue or the secretary's designee.
92+Sec. 2. This act shall take effect and be in force from and after its
8193 publication in the statute book.
