6	6	AN ACT concerning education; relating to school districts; requiring
7	7	boards of education of school districts to adopt policies and procedures
8	8	to prohibit students from using privately owned electronic
9	9	communication devices during school hours; authorizing such uses
10	10	under limited circumstances; requiring school districts to adopt policies
11	11	and procedures to prohibit students from using school district
12	12	computers or devices to access social media platforms.
13	13	Be it enacted by the Legislature of the State of Kansas:
14	14	Section 1. (a) Each board of education of a school district shall adopt
15	15	policies and procedures to govern the use of privately owned electronic
16	16	communication devices. Such policies and procedures shall:
17	17	(1) Prohibit students from using any privately owned electronic
18	18	communication device at school during the normal hours of the school
19	19	day, including during passing periods and in the classroom;
20	20	(2) set forth disciplinary actions and consequences that may occur if a
21	21	student violates such policies and procedures; and
22	22	(3) authorize a student to use a privately owned electronic
23	23	communication device during the normal hours of a school day only if the
24	24	use is:
25	25	(A) Required for the implementation of a student's individualized
26	26	education program or 504 plan;
27	27	(B) authorized by a teacher or administrator for educational purposes,
28	28	except that such use shall not be authorized as part of a classroom reward
29	29	or free time; or
30	30	(C) pre-approved on an individual student basis by a teacher or
31	31	administrator due to health concerns, emergency concerns or other special
32	32	circumstances.
33	33	(b) Each school district board of education shall adopt policies and
34	34	procedures to prohibit students from using school computers and devices
35	35	to access any social media platform.
36	36	(c) As used in this section:
37	37	(1) "Privately owned electronic communication device" means any
38	38	wireless electronic communication device that:
39	39	(A) Provides for voice, text or video communication between two or

75	75	more parties, including, but not limited to, a mobile or cellular phone,
76	76	tablet, computer, watch, text messaging device or personal digital
77	77	assistant; and
78	78	(B) is not owned or issued to students by the school district or school.
79	79	(2) "Social media platform" means a website, application or other
80	80	internet medium that:
81	81	(A) Permits a person to become a registered user, establish an
82	82	account, or create a profile for the purpose of allowing the person to
83	83	create, share and view user-generated content through such account or
84	84	profile; and
85	85	(B) primarily serves as a medium for users to interact with content
86	86	generated by other users of the medium.
87	87	Sec. 2. This act shall take effect and be in force from and after its
88	88	publication in the statute book.
