10+projects; amending K.S.A. 2024 Supp. 75-52,167 and repealing the
11+existing section.
712 Be it enacted by the Legislature of the State of Kansas:
8-Section 1. K.S.A. 2024 Supp. 75-52,167 is hereby amended to
9-read as follows: 75-52,167. As used in K.S.A. 75-3739, and
10-amendments thereto, and K.S.A. 2024 Supp. 75-52,167 through 75-
11-52,171, and amendments thereto:

1217 (a) "Private entity" means any partnership, firm, association,
1318 corporation, sole proprietorship or other business organization, whether
1419 organized for profit or not-for-profit and includes any faith-based
1520 organization.
1621 (b) "Secretary" means the secretary of corrections.
1722 (c) "Public-private partnership" means the relationship established
18-between the department of corrections and a private entity by
19-contracting for the performance of any combination of specified
20-functions or responsibilities to develop, finance, construct or renovate a
21-building at a correctional institution where the department of
22-corrections cost for development, finance, construction or renovation of
23-such building does not exceed 25% 50% of the total cost of the
24-developing, financing, constructing or renovating such building.

2530 (d) "Correctional institution" means the same as defined in K.S.A.
2631 75-5202, and amendments thereto.
2732 (e) "Public-private project" means the project to develop, finance,
28-construct or renovate a building at a correctional institution pursuant to
29-a public-private partnership.
30-(f) "Faith-based organization" means any religious, charitable or
31-other organization described in article 17 of chapter 17 of the Kansas
32-Statutes Annotated, and amendments thereto, or any other organization
33-whose values are based on faith and beliefs, or both, that has a mission
34-based on social values of the particular faith and whose members are
35-from a particular faith group.
36-(g) "Spiritual needs" means any program or service that addresses
37-any issue related to sincerely held religious beliefs.

3878 Sec. 2. K.S.A. 2024 Supp. 75-52,167 is hereby repealed.
3979 Sec. 3. This act shall take effect and be in force from and after its
4080 publication in the statute book.
