| 8 | 8 | | school meals; prohibiting local school boards from collecting money |

| 9 | 9 | | for such meals; amending K.S.A. 72-17,137 and repealing the existing |

|---|
| 11 | 11 | | Be it enacted by the Legislature of the State of Kansas: |
|---|
| 12 | 12 | | Section 1. K.S.A. 72-17,137 is hereby amended to read as follows: |
|---|
| 13 | 13 | | 72-17,137. (a) Each board shall be entitled to receive, from appropriations |
|---|
| 14 | 14 | | from the state general fund, six cents (6¢) $.06 for each type-A meal |
|---|
| 15 | 15 | | served under an approved school lunch program during each school year |
|---|
| 16 | 16 | | commencing with the 1978-79 school year. |
|---|
| 17 | 17 | | (b) Commencing in the 2025-2026 school year: |
|---|
| 18 | 18 | | (1) Each board shall be entitled to receive, from appropriations from |
|---|
| 19 | 19 | | the state general fund, $.40 for each meal served under an approved |
|---|
| 20 | 20 | | reduced price school meals program being provided in accordance with |
|---|
| 21 | 21 | | 42 U.S.C. 1759(a); and |
|---|
| 22 | 22 | | (2) no board shall collect $.40 for such reduced price school meals |
|---|
| 23 | 23 | | from students participating in the reduced price school meals program. |
|---|
| 24 | 24 | | (c) For the purpose of this section every type-A lunch served shall be |
|---|
| 25 | 25 | | counted equally. If the total amount of entitlements of all boards in any |
|---|
| 26 | 26 | | school year is more than the amount appropriated for payment thereof, |
|---|
| 27 | 27 | | then the entire amount appropriated therefor shall be prorated among all |
|---|
| 28 | 28 | | boards in proportion to the amount each board is entitled to receive under |
|---|
| 29 | 29 | | this act. |
|---|
| 30 | 30 | | (b)(d) Moneys received by a board from appropriations from the state |
|---|
| 31 | 31 | | general fund under the provisions of this section shall not be used for the |
|---|
| 32 | 32 | | purchase of identifiable imported meats. As used in this subsection, |
|---|
| 33 | 33 | | "identifiable imported meats" shall mean means meats which are labeled |
|---|
| 34 | 34 | | as being imported. |
|---|
| 35 | 35 | | Sec. 2. K.S.A. 72-17,137 is hereby repealed. |
|---|
| 36 | 36 | | Sec. 3. This act shall take effect and be in force from and after its |
|---|
| 37 | 37 | | publication in the statute book. |
