66 AN ACT concerning the legislature; establishing the longitudinal data act;
77 creating the division of longitudinal data in the legislative research

1818 Be it enacted by the Legislature of the State of Kansas:
1919 New Section 1. Sections 1 through 8, and amendments thereto, shall
2020 be known and may be cited as the longitudinal data act.
2121 New Sec. 2. As used in this act:
2222 (a) "Act" means the longitudinal data act.
2323 (b) "De-identified" or "de-identify" means the process used to remove
2424 all direct personal identifiers from individual-level data.
2525 (c) "Data" means any information about a person stored in a physical
2626 or electronic record.
2727 (d) "Director" means the director of the division of longitudinal data.
2828 (e) "Division" means the division of longitudinal data established in
2929 the legislative research department pursuant to section 4, and amendments
3030 thereto.
3131 (f) "Education data" means data relating to student performance from
3232 early childhood learning programs through postsecondary education,
3333 including, but not limited to, the following:
3434 (1) State and national assessments;
3535 (2) course taking and completion;
3636 (3) grade point average;
3737 (4) remediation;
3838 (5) retention;
3939 (6) special population status as defined by the division;

7575 (7) degree, diploma or credential attainment;
7676 (8) enrollment and absenteeism data;
7777 (9) demographic data;
7878 (10) suspension and expulsion records;
7979 (11) student financial aid data;
8080 (12) college and career readiness;
8181 (13) high school equivalency diploma;
8282 (14) transcripts; and
8383 (15) any other data impacting education deemed necessary by the
8484 division.
8585 (g) "In-demand industry sector or occupation" means the same as
8686 defined in 29 USC § 3102(23)(A).
8787 (h) "Kansas longitudinal data system" or "system" means a statewide
8888 data system that contains education, workforce, health and other data
8989 identified by the division.
9090 (i) "Memorandum of understanding" means an agreement between
9191 the divsion and a participating agency or outside entity that sets forth the
9292 details of how data is shared within the Kansas longitudinal data system
9393 and the respective legal rights and responsibilities of each party within the
9494 data sharing process.
9595 (j) "Outside entity" means any public or private entity that may enter
9696 into a memorandum of understanding to participate in the Kansas
9797 longitudinal data system and is not a participating agency.
9898 (k) "Participating agency" means the:
9999 (1) State department of education;
100100 (2) state board of regents;
101101 (3) department of labor;
102102 (4) department of revenue;
103103 (5) department of health and environment;
104104 (6) department of commerce; and
105105 (7) any outside entity that has entered into a memorandum of
106106 understanding for participation in the Kansas longitudinal data system.
107107 (l) "Research designee" means an individual, organization or entity
108108 designated and approved pursuant to section 6, and amendments thereto, to
109109 assist in conducting research and analysis using data from the Kansas
110110 longitudinal data system. A "research designee" shall possess demonstrated
111111 expertise in data analysis, education, workforce or related fields and shall
112112 adhere to all privacy, security and confidentiality requirements required by
113113 this act and any other applicable state and federal laws.
114114 (m) "Workforce data" means data relating to workforce and
115115 employment, including, but not limited to, the following:
116116 (1) Employment status;
117117 (2) wage information;

161161 (3) geographic location of employment;
162162 (4) industry or occupation;
163163 (5) certification and licensure;
164164 (6) job service and training information to support enhanced
165165 employment opportunities; and
166166 (7) any other data impacting the workforce deemed necessary by the
167167 division.
168168 New Sec. 3. (a) The division of longitudinal data shall establish the
169169 Kansas longitudinal data system as a secure means to:
170170 (1) Exchange, de-identify and match individual-level education and
171171 workforce data from participating agencies and outside entities while
172172 upholding legal protections to ensure privacy and security;
173173 (2) connect individuals and organizations to trusted information,
174174 resources, tools and services that support the education-to-employment
175175 pipeline;
176176 (3) provide the legislature and state agencies with access to data
177177 regarding state workforce development, including early learning,
178178 education, workforce training and employment outcomes; and
179179 (4) match data from participating agencies over time to create reports
180180 that may then be aggregated and analyzed to assist the legislature and state
181181 agencies with developing strategies to improve education and workforce
182182 outcomes.
183183 (b) Each participating agency shall enter into a memorandum of
184184 understanding with the division to participate in the system. All
185185 information matched from participating agencies shall be collected,
186186 safeguarded, kept confidential and used only by the division in accordance
187187 with this act and state and federal law. Each participating agency shall
188188 retain ownership of any data the participating agency provides to the
189189 system and shall reserve the right to opt out of any research request if the
190190 request would violate state or federal law. A participating agency shall not
191191 have access to data owned by another participating agency unless a data
192192 request is approved by the division.
193193 (c) The division shall conduct research using the system related to the
194194 research goals and mission adopted by the division.
195195 (d) The division may contract with any person or entity to implement
196196 and administer this act.
197197 (e) Notwithstanding any other provision of law, state agencies are
198198 hereby authorized to enter into memorandums of understanding with the
199199 division to share data as provided by this act.
200200 New Sec. 4. (a) There is hereby established the division of
201201 longitudinal data within the legislative research department. The head of
202202 the division shall be the director of longitudinal data. The director shall be

247247 members of the legislative coordinating council taken at any regular
248248 meeting of such council. The director shall receive such compensation as
249249 is determined by the legislative coordinating council. The director, and any
250250 of the director's assistants specified by the legislative coordinating council,
251251 shall receive expenses and allowances for in-state and out-of-state travel as
252252 is provided by law for members of the legislature. The director shall hire
253253 such assistants and employees of the division as are authorized by the
254254 legislative coordinating council and shall set their compensation subject to
255255 the approval of such council. The director and all assistants and employees
256256 of the division shall be in the unclassified service. The director shall be an
257257 authorized representative for partner entity data.
258258 (b) The division shall perform the following duties:
259259 (1) Establish the Kansas longitudinal data system pursuant to section
260260 3, and amendments thereto;
261261 (2) develop a strategic plan to develop, implement and utilize the
262262 system to accomplish the objectives of the division;
263263 (3) collect data from participating agencies and outside entities;
264264 (4) connect and ensure collected data is de-identified by the division;
265265 (5) store connected data;
266266 (6) conduct research on data using the system in accordance with the
267267 research agenda adopted by the legislative coordinating council;
268268 (7) conduct research on data in the system to answer research
269269 requests;
270270 (8) oversee compliance regarding the security and protection of data
271271 shared to and stored in the system;
272272 (9) develop a data governance and security plan for the system
273273 regarding the use, privacy and security of data and publish the plan on a
274274 website developed and administered, or caused to be developed and
275275 administered, by the division;
276276 (10) establish policies for sharing aggregated data or reports with the
277277 public and external entities;
278278 (11) develop strategies to promote the transparent operation of the
279279 system; and
280280 (12) prepare and provide an annual report to the legislative
281281 coordinating council and the governor.
282282 (c) The director shall create a prioritized list of data research requests.
283283 On or before January 31, 2026, the director shall accept data research
284284 requests from:
285285 (1) A legislative committee or a legislative staff office;
286286 (2) the governor or an executive branch agency;
287287 (3) the state board of education; and
288288 (4) the state board of regents.
289289 (d) The division shall report the list described in subsection (c) to the

333333 Legislative coordinating council on or before December 1 of each year.
334334 (e) (1) In addition to conducting data research in accordance with the
335335 prioritized list described in subsection (c), upon the approval of the
336336 legislative coordinating council, the division may prepare data research at
337337 the request of:
338338 (A) A state governmental entity;
339339 (B) a political subdivision of the state;
340340 (C) a private entity; or
341341 (D) a member of the public.
342342 (2) For any such data research request, the division shall determine:
343343 (A) Whether the division can complete the data research request; and
344344 (B) the order in which the division shall complete the data research
345345 request, if at all.
346346 (3) The division may require the person or entity that submitted the
347347 data research request to pay, once the data research is complete, the full
348348 cost of completing the data research request as determined by the division.
349349 Upon receipt of any payment made pursuant to this section, the division
350350 shall remit such moneys to the state treasurer in accordance with the
351351 provisions of K.S.A. 75-4215, and amendments thereto. Upon receipt of
352352 each such remittance, the state treasurer shall deposit the entire amount in
353353 the state treasury.
354354 (f) In the event of a data breach, the division shall comply with any
355355 applicable law, including, but not limited to, K.S.A. 2024 Supp. 75-7244,
356356 and amendments thereto, and any other laws pertaining to data breaches
357357 and notification thereof.
358358 New Sec. 5. Direct access to data in the system shall be restricted to
359359 authorized staff of the division of longitudinal data, the research designee
360360 or other persons approved by the legislative coordinating council if such
361361 persons have a need to access such data to further the objectives of this act.
362362 The division may limit access to data to certain categories or types of data
363363 or on any other basis determined by the division.
364364 New Sec. 6. (a) The division of longitudinal data may designate a
365365 research designee to assist in conducting data research and fulfilling the
366366 objectives outlined in this act. The research designee shall be an individual
367367 or entity with demonstrated expertise in data analysis, education,
368368 workforce or related fields.
369369 (b) The process for designating a research designee shall be as
370370 follows:
371371 (1) The division may submit a written request to the legislative
372372 coordinating council identifying the proposed research designee,
373373 including:
374374 (A) The qualifications and expertise of the designee;
375375 (B) the scope of work the designee will perform; and

419419 (C) a statement explaining how the designee's work aligns with the
420420 goals of the Kansas longitudinal data system;
421421 (2) the legislative coordinating council shall review the request and
422422 may request additional information or documentation from the proposed
423423 designee; and
424424 (3) the legislative coordinating council shall approve or deny the
425425 request within 60 days of submission of the written request.
426426 (c) Upon approval, the research designee shall be:
427427 (1) Authorized to access data and perform research as specified in the
428428 approved scope of work; and
429429 (2) subject to all privacy, security and confidentiality requirements
430430 established pursuant to this act and applicable state and federal laws.
431431 (d) The designation of a research designee shall be valid for a term
432432 not to exceed three years, after which the division may submit a request
433433 for renewal to the legislative coordinating council. Any request to renew
434434 the designation of a research designee shall follow the same process
435435 described in subsection (b).
436436 (e) The legislative coordinating council may revoke the designation
437437 of a research designee at any time for cause, including, but not limited to,
438438 failure to comply with privacy and security requirements or a breach of
439439 contract.
440440 (f) The division shall publish the names and roles of all approved
441441 research designees on the division's publicly accessible website.
442442 New Sec. 7. (a) The division of longitudinal data shall establish, or
443443 cause to be established, the Kansas credential and skills registry. The
444444 Kansas credential and skills registry shall be a comprehensive and
445445 consistently up-to-date collection of information on all educational and
446446 occupational credentials that are granted, issued, funded or governed by
447447 the state. Educational and occupational credentials, include, but are not
448448 limited to, diplomas, certificates, certifications, digital badges,
449449 apprenticeships, licenses and degrees of all types and levels. Information
450450 to be included in the registry shall include, but shall not be limited to:
451451 (1) The name of the credential;
452452 (2) the type of credential;
453453 (3) the owner of the credential;
454454 (4) the provider of the credential;
455455 (5) the status of the credential;
456456 (6) a short description of the credential;
457457 (7)  the estimated duration for completion;
458458 (8) the process and outcome quality indicators of the provider and the
459459 credential;
460460 (9) the competencies and skills included in the credential;
461461 (10) the costs of completion;

505505 (11) any assessments and costs of such assessments associated with
506506 earning the credential;
507507 (12) transfer value recommendations, as available;
508508 (13) descriptions of known credential pathways;
509509 (14) outcomes associated with the credential, including, but not
510510 limited to, earnings and employment, completion and pass rates and
511511 calculations of return-on-investment, as available;
512512 (15) the industry and occupation related to the credential that may
513513 include its code under the north American industry classification system;
514514 and
515515 (16) other such information as determined by the division.
516516 (b) On or before June 30, 2026, and each June 30 thereafter, the
517517 division shall develop a list of credentials that are aligned to in-demand
518518 occupations for each industry operating in the state, and shall clearly
519519 indicate such list among the overall collection of credentials in the registry.
520520 (c) The registry shall be available to the public as linked, open and
521521 interoperable data, readable by individuals and machine actionable,
522522 aligned with widely recognized standards and allow for open access across
523523 sector platforms, such as through credential transparency description
524524 language families of schema.
525525 (d) The registry shall not include any personally identifiable
526526 information about the holders of such credentials. The division shall seek
527527 to align registry data with student-level information in the Kansas
528528 longitudinal data system.
529529 (e) The division shall ensure that data in the registry are used in tools
530530 and services for students, learners, workers, employers, educators,
531531 policymakers and the general public, including:
532532 (1) Education and training search, guidance, navigation and
533533 counseling;
534534 (2) depiction and navigation of pathways;
535535 (3) awareness and management of dual credit or dual enrollment and
536536 transfers; and
537537 (4) comprehensive learner records or learning and employment
538538 records.
539539 New Sec. 8. Sections 1 through 7, and amendments thereto, shall
540540 expire on January 1, 2033.

542542 LEGISLATIVE COORDINATING COUNCIL
543543 (a) There is hereby appropriated for the above agency from the state
544544 general fund for the fiscal year ending June 30, 2026, the following:

591591 6314. (a) Any student data submitted to and maintained by a statewide
592592 longitudinal student data system shall only be disclosed by an educational
593593 agency in accordance with the provisions of this section. An educational
594594 agency shall provide annual written notice to each student's parent or legal
595595 guardian that student data may be disclosed in accordance with this
596596 section. Such notice shall be signed by the student's parent or legal
597597 guardian and maintained on file with the district.
598598 (b) Student data may be disclosed at any time to the:
599599 (1) The Authorized personnel of an educational agency who require
600600 such disclosures to perform their assigned duties;
601601 (2) the authorized personnel of the state board of regents who require
602602 such disclosures to perform their assigned duties; and
603603 (3) the student and the parent or legal guardian of the student,
604604 provided the student data pertains solely to such student; and
605605 (4) authorized personnel of the division of longitudinal data
606606 established pursuant to the longitudinal data act.
607607 (c) Student data may be disclosed to the authorized personnel of any
608608 state agency not specified in subsection (b), or to a service provider of a
609609 state agency, educational agency or school who is engaged to perform a
610610 function of instruction, assessment or longitudinal reporting, provided
611611 there is a data-sharing agreement between the educational agency and such
612612 other state agency or service provider that provides the following:
613613 (1) The purpose, scope and duration of the data-sharing agreement;
614614 (2) that the recipient of the student data use such information solely
615615 for the purposes specified in the agreement;
616616 (3) that the recipient shall comply with data access, use and security
617617 restrictions that are specifically described in the agreement; and
618618 (4) that the student data shall be destroyed when no longer necessary
619619 for the purposes of the data-sharing agreement or upon expiration of the
620620 data-sharing agreement, whichever occurs first. Except that a service
621621 provider engaged to perform a function of instruction may retain student
622622 transcripts as required by applicable laws and rules and regulations.
623623 Destruction shall comply with the NISTSP800-88 standards of data
624624 destruction.
625625 (d) (1) Except as otherwise provided in paragraph (2), student data
626626 may be disclosed to any governmental entity not specified in subsection
627627 (b) or (c), or to any public or private audit and evaluation or research
628628 organization, provided that only aggregate data is disclosed to such
629629 governmental entity or audit and evaluation or research organization.
630630 (2) Personally identifiable student data may be disclosed if the
631631 student, if an adult, or the parent or legal guardian of the student, if a
632632 minor, consents to such disclosure in writing.
633633 (e) Notwithstanding the provisions of subsections (b), (c) and (d), an

677677 educational agency may disclose:
678678 (1) Directory information of a student when such agency deems such
679679 disclosure necessary and the disclosure of which has been consented to in
680680 writing by such student's parent or legal guardian;
681681 (2) directory information to an enhancement vendor that provides
682682 photography services, class ring services, yearbook publishing services,
683683 memorabilia services or other substantially similar services;
684684 (3) any information required to be disclosed pursuant to K.S.A. 65-
685685 101, 65-118 and 65-202, and amendments thereto, provided such
686686 information is disclosed in accordance with any provisions of such statutes
687687 regarding the confidentiality and disclosure of such information;
688688 (4) any student data in order to comply with any lawful subpoena or
689689 court order directing such disclosure; and
690690 (5) student data to a public or private postsecondary educational
691691 institution which is required by such postsecondary educational institution
692692 for the purposes of application or admission of a student to such
693693 postsecondary educational institution, provided that such disclosure is
694694 consented to in writing by such student.
695695 Sec. 11. K.S.A. 72-6314 is hereby repealed.
696696 Sec. 12. This act shall take effect and be in force from and after its
697697 publication in the statute book.
