SESSION OF 2025 SUPPLEMENTAL NOTE ON HOUSE BILL NO. 2307 As Amended by House Committee on Higher Education Budget Brief* HB 2307, as amended, would transfer the authority over the prenatally and postnatally diagnosed conditions awareness programs (programs) from the Kansas Department of Health and Environment (KDHE) to the Kansas Council on Developmental Disabilities (KCDD), create the Prenatally and Postnatally Diagnosed Conditions Awareness Program Fund (Fund), and direct a one-time $25,000 transfer to the Fund. The bill would also make technical and conforming amendments. Transfer of Authorization and Oversight The bill would transfer authorization and oversight for the programs from KDHE to KCDD, including the powers, duties, and functions related to the programs. The bill would state that references to KDHE in statute, contract, or other documents in regard to the programs would be deemed to apply to KCDD. The bill would replace references to the Secretary of Health and Environment with KCDD and would further clarify by removing the definition of “Secretary” from the statute. Prenatally and Postnatally Diagnosed Conditions Awareness Programs Fund The bill would establish the Fund in the State Treasury and provide for all moneys credited to the Fund to be expended only for the programs. All expenditures would be made in accordance with appropriation acts upon warrants of the Director of Accounts and Reports issued pursuant to vouchers approved by the Chairperson of the KCDD. The bill would also direct the Director of Accounts and Reports to transfer $25,000 from the State General Fund to the Fund on July 1, 2025. Background The bill was introduced by the Committee on Health and Human Services at the request of Representative Howell on behalf of Kansans for Life. House Committee on Health and Human Services In the House Committee hearing, proponent testimony was provided by a private citizen and representatives of the Disability Rights Center of Kansas, KCDD, and Kansans for Life. The proponents generally stated that KCDD has the expertise and resources to facilitate these programs and provide knowledgeable support to families. Written-only proponent testimony was provided by the Kansas Catholic Conference and Kansas Family Voice. No other testimony was provided. 2- 2307 The House Committee amended the bill to make a technical correction. Fiscal Information According to the fiscal note prepared by the Division of the Budget on the bill, as introduced, KDHE indicates enactment of the bill would not result in a fiscal effect for the agency. The bill would increase transfers out of the State General Fund (SGF) by $25,000 for FY 2026 as it would direct a transfer from SGF to the Fund. The Fund would be available for use for program expenditures under the KCDD, but the bill does not direct a transfer for any future years. Any fiscal effect associated with the bill is not reflected in The FY 2026 Governor’s Budget Report.
