2-AN ACT concerning health and healthcare; relating to prenatally and postnatally diagnosed
3-conditions; transferring the power to authorize and oversee certain activities

9+diagnosed conditions awareness programs from the department of
10+health and environment to the Kansas council on developmental
11+disabilities; amending K.S.A. 65-1,259 and repealing the existing
12+section.
713 Be it enacted by the Legislature of the State of Kansas:
814 New Section 1. (a) Authorization and oversight of prenatally and
915 postnatally diagnosed conditions awareness programs are hereby
10-transferred from the department of health and environment to the
11-Kansas council on developmental disabilities. The powers, duties and
12-functions of the department of health and environment related to
13-prenatally and postnatally diagnosed conditions awareness programs as
14-provided in K.S.A. 65-1,259, and amendments thereto, are hereby
15-transferred and imposed upon the Kansas council on developmental
16+transferred from the department of health and environment to the Kansas
17+council on developmental disabilities. The powers, duties and functions of
18+the department of health and environment related to prenatally and
19+postnatally diagnosed conditions awareness programs as provided in
20+K.S.A. 65-1,259, and amendments thereto, are hereby transferred and
21+imposed upon the Kansas council on developmental disabilities.
22+(b) Whenever the department of health and environment, the
23+secretary of health and environment, or words of like effect, are referred to
24+or designated by statute, contract or other document, and such reference or
25+designation is in regard to any function, power or duty related to prenatally
26+and postnatally diagnosed conditions awareness programs as provided in
27+K.S.A. 65-1,259, and amendments thereto, such reference or designation
28+shall be deemed to apply to the Kansas council on developmental

17-(b) Whenever the department of health and environment, the
18-secretary of health and environment, or words of like effect, are
19-referred to or designated by statute, contract or other document, and
20-such reference or designation is in regard to any function, power or
21-duty related to prenatally and postnatally diagnosed conditions
22-awareness programs as provided in K.S.A. 65-1,259, and amendments
23-thereto, such reference or designation shall be deemed to apply to the
24-Kansas council on developmental disabilities.
25-(c) All rules and regulations, orders and directives of the secretary
26-of health and environment related to prenatally and postnatally
27-diagnosed conditions awareness programs that are in effect pursuant to
28-K.S.A. 65-1,259, and amendments thereto on the effective date of this
29-act shall continue to be effective and shall be deemed to be rules and
30-regulations, orders and directives of the chairperson of the Kansas
31-council on developmental disabilities until amended, revoked or
32-nullified pursuant to law.
30+(c) All rules and regulations, orders and directives of the secretary of
31+health and environment related to prenatally and postnatally diagnosed
32+conditions awareness programs that are in effect pursuant to K.S.A. 65-
33+1,259, and amendments thereto on the effective date of this act shall
34+continue to be effective and shall be deemed to be rules and regulations,
35+orders and directives of the chairperson of the Kansas council on
36+developmental disabilities until amended, revoked or nullified pursuant to
37+law.
3338 Sec. 2. K.S.A. 65-1,259 is hereby amended to read as follows: 65-
34-1,259. (a) The secretary of the department of health and environment

75+Kansas council on developmental disabilities shall authorize and oversee
76+certain activities, including the awarding of grants, contracts or
3777 cooperative agreements to eligible entities to:
3878 (1) Collect, synthesize and disseminate current evidence-based
39-information relating to Down syndrome or other prenatally or
40-postnatally diagnosed conditions; and
79+information relating to Down syndrome or other prenatally or postnatally
80+diagnosed conditions; and
4181 (2) coordinate the provision of, and access to, new or existing
4282 supportive services for women and the spouses of such women who
4383 receive a positive diagnosis of Down syndrome or other prenatally or
44-postnatally diagnosed conditions for their child, including, but not
45-limited to:
84+postnatally diagnosed conditions for their child, including, but not limited
85+to:
4686 (A) The establishment of a resource telephone hotline or website
4787 accessible to women and the spouses of such women who receive a
4888 positive diagnosis of Down syndrome or other prenatally or postnatally
4989 diagnosed conditions for their child;
5090 (B) the development of outreach programs to new and expecting
5191 parents to provide them with up-to-date information on the range of
5292 outcomes for individuals living with the diagnosed condition, including
5393 physical, developmental, educational and psychosocial outcomes;
5494 (C) the development of local peer support programs to effectively
5595 serve women and the spouses of such women who receive a positive
56-diagnosis of Down syndrome or other prenatally or postnatally
57-diagnosed conditions for their child;
96+diagnosis of Down syndrome or other prenatally or postnatally diagnosed
97+conditions for their child;
5898 (D) the establishment of a network of local registries of families
5999 willing to adopt newborns with Down syndrome or other prenatally or
60-postnatally diagnosed conditions, and links to adoption agencies willing HOUSE BILL No. 2307—page 2
61-to place babies with Down syndrome or other prenatally or postnatally
100+postnatally diagnosed conditions, and links to adoption agencies willing to
101+place babies with Down syndrome or other prenatally or postnatally
62102 diagnosed conditions with families willing to adopt; and
63-(E) the establishment of awareness and education programs for
64-health care providers who provide, interpret or inform parents of the
65-results of prenatal tests for Down syndrome or other prenatally or
66-postnatally diagnosed conditions to patients.
67-(b) A grantee under this section shall make the following available
68-to health care providers of parents who receive a prenatal or postnatal

104+care providers who provide, interpret or inform parents of the results of
105+prenatal tests for Down syndrome or other prenatally or postnatally
106+diagnosed conditions to patients.
107+(b) A grantee under this section shall make the following available to
108+health care providers of parents who receive a prenatal or postnatal
69109 diagnosis for their child:
70-(1) Up-to-date, evidence-based, written information concerning
71-the range of outcomes for individuals living with the diagnosed
72-condition, including physical, developmental, educational and
73-psychosocial outcomes; and
110+(1) Up-to-date, evidence-based, written information concerning the
111+range of outcomes for individuals living with the diagnosed condition,
112+including physical, developmental, educational and psychosocial
113+outcomes; and
74114 (2) contact information regarding support services, including
75115 information hotlines and websites specific to Down syndrome or other
76116 prenatally or postnatally diagnosed conditions, resource centers or
77-clearinghouses, local peer support groups and other education and
78-support programs.
79-(c) Information provided under this subsection shall be culturally
80-and linguistically appropriate as needed by women and the spouses of
81-such women who receive a positive diagnosis for Down syndrome or
82-other prenatally or postnatally diagnosed conditions for their child, and
83-approved by the secretary Kansas council on developmental
84-disabilities.

162+(c) Information provided under this subsection shall be culturally and
163+linguistically appropriate as needed by women and the spouses of such
164+women who receive a positive diagnosis for Down syndrome or other
165+prenatally or postnatally diagnosed conditions for their child, and
166+approved by the secretary Kansas council on developmental disabilities.
85167 (d) In distributing funds under this section, the secretary Kansas
86-council on developmental disabilities shall place an emphasis on
87-funding partnerships between health care professional groups and
88-disability advocacy organizations.

89171 (e) On or before January 12, 2015 11, 2027, the secretary Kansas
90-council on developmental disabilities shall prepare and submit a report

93-of the programs supported by such grants, contracts and cooperative
94-agreements.

111190 (6) "Prenatal test" means diagnostic or screening tests offered to
112-pregnant women seeking routine prenatal care that are administered on
113-a required or recommended basis by a health care provider based on
114-medical history, family background, ethnic background, previous test
115-results or other risk factors.
116-(7) "Secretary" means the secretary of the department of health
117-and environment.
118-(g) (1) There is hereby established in the state treasury the
119-prenatally and postnatally diagnosed conditions awareness programs
120-fund. All moneys credited to the prenatally and postnatally diagnosed
121-conditions awareness programs fund shall be expended only for
122-prenatally and postnatally diagnosed conditions awareness programs.
123-All expenditures from the prenatally and postnatally diagnosed
124-conditions awareness programs fund shall be made in accordance with HOUSE BILL No. 2307—page 3
125-appropriation acts upon warrants of the director of accounts and
126-reports issued pursuant to vouchers approved by the chairperson of the
127-Kansas council on developmental disabilities.

128250 (2) On July 1, 2025, the director of accounts and reports shall
129251 transfer $25,000 from the state general fund to the the prenatally and
130252 postnatally diagnosed conditions awareness programs fund.
131253 Sec. 3. K.S.A. 65-1,259 is hereby repealed.
132254 Sec. 4. This act shall take effect and be in force from and after its
133255 publication in the statute book.
