---|
7 | 7 | | home-based business fairness act; providing that such businesses shall |
---|
8 | 8 | | be a permitted use and prohibiting additional permit or licensing |
---|
9 | 9 | | requirements by a municipality; requiring that municipal regulations be |
---|
10 | 10 | | narrowly-tailored with respect to such businesses; supporting the |
---|
11 | 11 | | development and growth of such business by limiting the regulatory |
---|
12 | 12 | | powers of municipalities. |
---|
13 | 13 | | Be it enacted by the Legislature of the State of Kansas: |
---|
14 | 14 | | Section 1. Sections 1 through 8, and amendments thereto, shall be |
---|
15 | 15 | | known and may be cited as the no-impact home-based business fairness |
---|
16 | 16 | | act. |
---|
17 | 17 | | Sec. 2. As used in this act: |
---|
18 | 18 | | (a) "Goods" means any merchandise, equipment, products, supplies |
---|
19 | 19 | | or materials; |
---|
20 | 20 | | (b) "home-based business" means any business for the manufacture, |
---|
21 | 21 | | provision or sale of goods or services that is owned by the owner or tenant |
---|
22 | 22 | | of a residential dwelling and operated by the owner or tenant at the |
---|
23 | 23 | | location of the residential dwelling; |
---|
24 | 24 | | (c) "municipality" means any city, county or consolidated city and |
---|
25 | 25 | | county; |
---|
26 | 26 | | (d) "no-impact home-based business" means a home-based business |
---|
27 | 27 | | for which: |
---|
28 | 28 | | (1) The total number of on-site employees and clients does not |
---|
29 | 29 | | exceed the municipal occupancy limit for the residential property; and |
---|
30 | 30 | | (2) the business activities: |
---|
31 | 31 | | (A) Are limited to the sale of lawful goods and services; |
---|
32 | 32 | | (B) do not generate on-street parking or a substantial increase in |
---|
33 | 33 | | traffic through the residential area; |
---|
34 | 34 | | (C) occur inside the residential dwelling or within the private |
---|
35 | 35 | | premises; and |
---|
36 | 36 | | (D) are not visible from the street; and |
---|
37 | 37 | | (e) "rural no-impact home-based business" means a home-based |
---|
38 | 38 | | business located outside the boundaries of a city or with private premises |
---|
39 | 39 | | exceeding 1 acre in size and for which the business activities: |

---|
76 | 76 | | (2) occur inside the residential dwelling or within the property limits. |
---|
77 | 77 | | Sec. 3. The use of a residential dwelling for a no-impact home-based |
---|
78 | 78 | | business or a rural no-impact home-based business shall be a permitted |
---|
79 | 79 | | use. This permitted use shall supersede any deed restriction, covenant or |
---|
80 | 80 | | agreement restricting the use of land or any master deed, bylaw or other |
---|
81 | 81 | | document applicable to a common interest ownership community entered |
---|
82 | 82 | | into by a no-impact home-based business or a rural no-impact home-based |
---|
83 | 83 | | business on or after July 1, 2025. |
---|
84 | 84 | | Sec. 4. A municipality shall not prohibit a no-impact home-based |
---|
85 | 85 | | business or a rural no-impact home-based business or otherwise require a |
---|
86 | 86 | | person to apply, register or obtain any permit, license, variance or other |
---|
87 | 87 | | type of prior approval from the municipality to operate a no-impact home- |
---|
88 | 88 | | based business or a rural no-impact home-based business. |
---|
89 | 89 | | Sec. 5. A municipality may establish or enforce regulations on a no- |
---|
90 | 90 | | impact home-based business if the regulations are narrowly tailored for |
---|
91 | 91 | | any of the following purposes: |
---|
92 | 92 | | (a) The protection of the public health and safety limited to |
---|
93 | 93 | | regulations for fire and building codes, health and sanitation, |
---|
94 | 94 | | transportation or traffic control, solid or hazardous waste, pollution and |
---|
95 | 95 | | noise control; |
---|
96 | 96 | | (b) compliance with state and federal laws; and |
---|
97 | 97 | | (c) payment of applicable taxes. |
---|
98 | 98 | | When considering the establishment or enforcement of a regulation in a |
---|
99 | 99 | | narrowly tailored manner with respect to a rural no-impact home-based |
---|
100 | 100 | | business, the municipality shall identify factors differentiating the |
---|
101 | 101 | | circumstances of a rural no-impact home-based business as compared to |
---|
102 | 102 | | residences that are no-impact home-based businesses, including, but not |
---|
103 | 103 | | limited to, the relative isolation of the rural no-impact home-based |
---|
104 | 104 | | business, relative size of the premises and proximity to other residences |
---|
105 | 105 | | and shall apply an analysis favoring less regulation for a rural no-impact |
---|
106 | 106 | | home-based business based on such factors. |
---|
107 | 107 | | Sec. 6. A no-impact home-based business shall not be used for the |
---|
108 | 108 | | purposes of selling illegal drugs or liquor, operating or maintaining a |
---|
109 | 109 | | structured sober living home for drug or alcohol based recovery, selling |
---|
110 | 110 | | pornography or providing nude or topless dancing or other adult-oriented |
---|
111 | 111 | | businesses. |
---|
112 | 112 | | Sec. 7. A municipality shall not require a person as a condition of |
---|
113 | 113 | | operating a no-impact home-based business to seek rezoning of the |
---|
114 | 114 | | property for commercial use or install fire sprinklers in a single family |
---|
115 | 115 | | detached residential dwelling, any residential dwelling consisting of more |
---|
116 | 116 | | than two dwelling units or any additional buildings on the property. A |
---|
117 | 117 | | municipality shall not require a rural no-impact home-based business or a |
---|

165 | 165 | | Sec. 8. The question of whether a regulation of a municipality |

166 | 166 | | complies with this act shall be a judicial question. The municipality that |

167 | 167 | | enacted the regulation shall establish by clear and convincing evidence |
---|
168 | 168 | | that the regulation complies with this act. |
---|
169 | 169 | | Sec. 9. This act shall take effect and be in force from and after its |
---|
170 | 170 | | publication in the statute book. |
