66 AN ACT concerning health and healthcare; requiring that certain written
77 information be provided to patients when a physician or healthcare
88 provider administers or prescribes any medicine or drug for the purpose
99 of inducing an abortion.
1010 Be it enacted by the Legislature of the State of Kansas:
1111 Section 1. (a) Any physician or healthcare provider who prescribes,
1212 dispenses or administers any medicine or drug for the purpose of inducing
1313 an abortion shall provide the patient receiving such medicine or drug with
1414 a written notice that reads:
1515 "NOTICE TO PATIENTS HAVING MEDICATION ABORTIONS:
1616 If you decide to take any abortion-inducing medicine or drug to end
1717 your pregnancy, the state of Kansas wants you to be aware that you and
1818 your family may hold the manufacturer, distributor and your physician or
1919 healthcare provider financially accountable should you die, suffer injury,
2020 complication or any debilitating side effects, or should the physician or
2121 healthcare provider fail to address side effects, or should the medication
2222 fail to work such that your pregnancy continues, resulting in an incomplete
2323 abortion or in your being required to undergo surgical intervention.
2424 You and your family may also hold the abortion-inducing medicine or
2525 drug provider, the physician or healthcare provider or an agent of the
2626 abortion-inducing medicine or drug provider, physician or healthcare
2727 provider accountable for failing to inform you of complications.
2828 If you experience complications and are in need of emergency care or a
2929 hospital visit, you have the right to tell the physician or healthcare provider
3030 treating the complications that you have had an abortion-inducing
3131 medicine or drug. Providing this information will not result in any criminal
3232 or civil penalty and will further help save your life."
3333 (b) As used in this section, "abortion" and "physician" mean the same
3434 as defined in K.S.A. 65-6701, and amendments thereto.
3535 Sec. 2. This act shall take effect and be in force from and after its
3636 publication in the statute book.
