66 AN ACT concerning public assistance; relating to the secretary for
77 children and families and the secretary of health and environment;
88 directing the secretaries to enter into agreements with commercial
99 entities and state agencies for the continuous review and comparison of
1010 data for public assistance eligibility; requiring the secretary for children
1111 and families to review federal sources to verify such eligibility.
1212 Be it enacted by the Legislature of the State of Kansas:
1313 Section 1. (a) (1) To verify eligibility for the food assistance program
1414 pursuant to K.S.A. 39-709, and amendments thereto, the secretary for
1515 children and families and the secretary of health and environment shall:
1616 (A) Enter into data matching agreements to compare data related to
1717 households enrolled in food assistance, child support services, medicaid
1818 and other public assistance programs with commercial entities that collect
1919 or maintain data regarding employment and wages as a "payroll data
2020 provider" as defined by the fair credit reporting act, 15 U.S.C. § 1681 et
2121 seq., as in effect on July 1, 2025, to obtain real-time employment and
2222 income data, including up-to-date, non- modeled employment and income
2323 data provided by employers or payroll providers; or
2424 (B) present to the legislative coordinating council prior to November
2525 1, 2025, commercial, state and federal agency options to compare data
2626 options. Upon receipt and review of such options from the secretary for
2727 children and families and the secretary of health and environment, the
2828 legislative coordinating council shall make the determination of approval
2929 of the data matching agreement.
3030 (2) The appropriate secretary shall receive and review data
3131 concerning individuals or households enrolled in food assistance, child
3232 support services, medicaid and other public assistance programs that
3333 indicates a change in circumstances that may affect eligibility for a public
3434 assistance program on at least a:
3535 (A) Monthly basis, from the office of vital statistics, including, but
3636 not limited to, death records;
3737 (B) quarterly basis, from the department of labor, including, but not
3838 limited to, changes in employment or wages;
3939 (C) monthly basis, including, but not limited to, potential changes in

7575 residency as identified by out-of-state electronic benefit transfer
7676 transactions;
7777 (D) quarterly basis, from the department of revenue, including, but
7878 not limited to, potential changes in income, wages or residency as
7979 identified by tax records;
8080 (E) monthly basis, from the department of corrections, including, but
8181 not limited to, incarceration status;
8282 (F) semi-monthly basis, from the department of labor, including, but
8383 not limited to, potential changes in employment, income or assets; and
8484 (G) monthly basis, from the Kansas lottery and the Kansas racing and
8585 gaming commission, to identify households with lottery or gambling
8686 winnings of $3,000 or greater and, to the extent permissible under federal
8787 law, deem the data verified upon receipt, and if such data is not verified
8888 upon receipt, the department shall make referrals for further investigation
8989 to identify households with winnings equal to or greater than the resource
9090 limit for elderly or disabled households as defined in 7 C.F.R. § 273.8(b).
9191 (b) On at least a monthly basis, to assess continued eligibility and act
9292 on findings, the secretary for children and families shall review and act on
9393 the following data from federal sources:
9494 (1) Earned income information, death records, incarceration records,
9595 supplemental security income information, beneficiary records, earnings
9696 information and pension information maintained by the United States
9797 social security administration;
9898 (2) income and employment information maintained in the national
9999 directory of new hires and child support enforcement data maintained by
100100 the United States department of health and human services;
101101 (3) payment and earnings information maintained by the United
102102 States department of housing and urban development; and
103103 (4) fleeing felon information maintained by the United States federal
104104 bureau of investigation.
105105 (c) On at least a quarterly basis, the secretary shall make available to
106106 the public on the Kansas department for children and families website data
107107 from findings of noncompliance and fraud investigations in food
108108 assistance for the following aggregate, nonconfidential and non-
109109 personally identifying information:
110110 (1) Number of households investigated for intentional program
111111 violations or fraud;
112112 (2) total number of households referred to the attorney general's
113113 office for prosecution;
114114 (3) improper payments and expenditures;
115115 (4) moneys recovered;
116116 (5) data concerning improper payments and ineligible recipients as a
117117 percentage of those investigated and reviewed; and

162162 in each state outside of Kansas.
163163 Sec. 2. This act shall take effect and be in force from and after its
164164 publication in the statute book.
