| 6 | 6 | | AN ACT concerning health and healthcare; increasing state financial |
|---|
| 7 | 7 | | assistance to local health departments under certain circumstances; |
|---|
| 8 | 8 | | amending K.S.A. 65-242 and repealing the existing section. |

| 9 | 9 | | Be it enacted by the Legislature of the State of Kansas: |
|---|
| 10 | 10 | | Section 1. K.S.A. 65-242 is hereby amended to read as follows: 65- |
|---|
| 11 | 11 | | 242. For the purpose of insuring ensuring that adequate public health |
|---|
| 12 | 12 | | services are available to all inhabitants of the state of Kansas, the state |
|---|
| 13 | 13 | | shall assist in the financing of the operation of local health departments. |
|---|
| 14 | 14 | | Subject to appropriations therefor, state financial assistance shall be |
|---|
| 15 | 15 | | distributed to local health departments as follows: |
|---|
| 16 | 16 | | (a) First, each local health department shall, upon application |
|---|
| 17 | 17 | | therefor, receive $7,000 $12,000. If sufficient funds are not available to |
|---|
| 18 | 18 | | make this distribution, then the funds which that are available shall be |
|---|
| 19 | 19 | | divided equally among those local health departments making application |
|---|
| 20 | 20 | | therefor. |
|---|
| 21 | 21 | | (b) Second, if any funds are available after the distribution required in |
|---|
| 22 | 22 | | subsection (a), the secretary shall distribute such funds as follows: |
|---|
| 23 | 23 | | (1) A figure equal to the total amount of state financial assistance |
|---|
| 24 | 24 | | available for distribution, before deduction for the distribution in |
|---|
| 25 | 25 | | subsection (a), shall be determined. |
|---|
| 26 | 26 | | (2) The figure determined in paragraph (1) of this subsection shall be |
|---|
| 27 | 27 | | allocated to local health departments making application for assistance |
|---|
| 28 | 28 | | based on the proportion that the population of the county or counties |
|---|
| 29 | 29 | | comprising the local health department applying for such assistance bears |
|---|
| 30 | 30 | | to the total population of all counties comprising local health departments |
|---|
| 31 | 31 | | which that have applied for such financial assistance. |
|---|
| 32 | 32 | | (3) If any local health department making application for assistance |
|---|
| 33 | 33 | | would receive receives an amount equal to or less than $7,000 $12,000 |
|---|
| 34 | 34 | | using the formula in paragraph (2) of this subsection, then such department |
|---|
| 35 | 35 | | shall be paid in accordance with subsection (a) only. If any local health |
|---|
| 36 | 36 | | department making application for assistance would receive receives more |
|---|
| 37 | 37 | | than $7,000 $12,000 using the formula in paragraph (2) of this subsection, |
|---|
| 38 | 38 | | then such department shall be paid based on the proportion that the |
|---|
| 39 | 39 | | population served by the county or counties comprising such local health |
|---|

|---|
| 76 | 76 | | health departments which that have made application for assistance, |
|---|
| 77 | 77 | | except for departments receiving funds under subsection (a), except that in |
|---|
| 78 | 78 | | no case shall the assistance distributed under this subsection (b) to a local |
|---|
| 79 | 79 | | health department exceed the amount that the local health department |
|---|
| 80 | 80 | | receives from local tax revenues for the county fiscal year in which the |
|---|
| 81 | 81 | | state financial assistance is paid. |
|---|
| 82 | 82 | | (c) If local tax revenues allotted to a local health department for a |
|---|
| 83 | 83 | | fiscal year fall below the level of local tax revenues allotted to the local |
|---|
| 84 | 84 | | health department for the preceding fiscal year, the amount of state |
|---|
| 85 | 85 | | financial assistance under this act for which such local health department |
|---|
| 86 | 86 | | is eligible for the fiscal year shall be reduced by a percentage equal to the |
|---|
| 87 | 87 | | percentage of reduction in local tax revenue for that fiscal year. |
|---|
| 88 | 88 | | Sec. 2. K.S.A. 65-242 is hereby repealed. |
|---|
| 89 | 89 | | Sec. 3. This act shall take effect and be in force from and after its |
|---|
| 90 | 90 | | publication in the statute book. |
